A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS
ALTOS HILLS ORDERING THE PERFORMANCE OF CERTAIN WORK
RESOLVED, by the City Council of the Town of Los Altos Hills, County
of Santa Clara, State of California, that
WHEREAS, the City Council did this day approve and adopt plans and
specifications for certain work in the Town of Los Altos Hills (herein called
the "TOWN"), to wit:
"LupineRoad Storm Drain and Slurry Seal;"
and
WHEREAS, pursuant to the provisions of Section 1773 of the Labor Code
of the State of California, the TOWN has obtained the prevailing rates of per
diem wages and for holiday and overtime work for public work to be
performed in the TOWN from the Director of the Department of industrial
Relations,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED and DETERMINED as
follows:
1. Public interest and convenience require the performance of such
work and said City Council hereby orders that the work and improvement, as
set forth and described in said plans and specifications, be done and made.

Said City Council does further order that all said work and improvement will
be done under the direction of the City Engineer of the TOWN, and all said
work and all the materials used in connection therewith shall be furnished
under the direction of and to the satisfaction of said City Engineer, and all
said work shall be done at the locations shown upon said plans and
specifications and strictly in accordance therewith.
2. Not less than the prevailing rate of per diem wages and for holiday
and overtime work referred to above shall be paid for any work proposed to
be performed in the performance of said public work under said plans and
specifications.
3. The City Clerk of the TOWN is hereby directed to publish by two (2)
successive publications in the Peninsula Times Tribune a newspaper
published and circulated in Santa Clara County, there being no newspaper
published in the TOWN, and not less than five (5) days apart, a Notice inviting
sealed proposals or bids for the construction of said work and improvement
arid referring to the Plans and Specifications on file in the Office of the City
Clerk, the first of which publications shall be at least ten (10) days prior to
. the time fixed for opening bids.
4. All proposals or bids shall be accompanied by a certified check
payable to the order of said TOWN, or cash, amounting to ten percent (l0 ) of
the bid, or by a bond in said amount and payable to said TOWN, signed by a

corporate surety or by the bidder and two sureties who shall justify before
any officer competent to administer an oath, in double said amount and over
and above all statutory exemptions. Said check shall be forfeited or said
bond shall become payable to said TOWN ir1 case the bidder depositing the
same does not, after the contract has been awarded to him, and within the
time specified in said plans and specifications, enter into a contract, in form
as set forth in said specifications, with the TOWN, the faithful performance
of which shall be assured by an undertaking in the amount of one hundred
percent (100%) of the amount so bid, with sureties satisfactory to this City
Council, and which shall be accompanied by a payment bond (labor and
materials) in a sum not less than one hundred percent (100Z) of the amount
of said bid.
5. Said sealed proposals or bids shall be delivered to the City Clerk of
the TOWN on or before 2 o'clock P.11. of the27 day of August 1981 7, at the office
of the City Clerk in the Town Hall, 26379 Fremont Road, in the TOWN, said
time being not less than ten (10) days from the time of the first publication
of said Notice. Bids will be publicly opened, examined and the Council will
take action awarding the contract or rejecting all bids not later than thirty
(30) days after the expiration of the time herein prescribed for the receipt
of bids; provided that the award may be made after the expiration of the
specified time if the bidder shall not have given to the Council notice in

in writing of the withdrawal of such bid or proposal.
6. The said City Council of the TOWN hereby reserves the right to
reject any and all bids.
