RESOLUTION NO. . -111-87
A RESOLUTION APPROVING PURCHASE OF REAL PROPERTY
FOR THE FREMONT AVENUE WIDENING PROJECT,
AUTHORIZING EXECUTION OF AGREEMENT BETWEEN
THE TOWN OF LOS ALTOS HILLS AND
LYNNE L. MILLER AND WAYNE H. MILLER,
ORDERING PAYMENT OF MONEY, ACCEPTING DEED
AND ORDERING RECORDATION THEREOF
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, in the opinion of the City Council of the Town of Los Altos
Hills the public interest, welfare, and convenience require that it purchase
and acquire certain real property in connection with the Fremont Avenue
Widening Project, more particularly described in Exhibit "A" attached hereto
and incorporated herein by reference (herein referred to as the "Property");
and
WHEREAS, the City Council of the Town of Los Altos Hills has read and
considered that certain Agreement for Purchase of Interest in Real Property
between the Town of Los Altos Hills and Lynne L. Miller and Wayne H. Miller
(herein called the "Agreement"),
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. Public interest and convenience require the entering into of the
Agreement and the Town of Los Altos Hills hereby approves the Agreement.
2. The Town of Los Altos Hills shall enter into, and the Mayor and City
Clerk of the Town of Los Altos Hills be, and they and each of them hereby is
authorized and directed on behalf of said Town, respectively, to execute and
attest the Agreement.
3. That the Town of Los Altos Hills purchase and acquire the Property

for public purposes, namely the Fremont Avenue Widening Project, and pay
therefor the sum of Fifteen Thousand Twenty-One Dollars and Seventy Cents
($15,021.70), together with interest on the sum of Eight Thousand Six Hundred
Dollars ($8,600.00) at the Local Agencylnvestment Fund (LAIF) rate from
June 12, 1986, to the date of close of escrow and conveyance of title to the
Property to Town.
4. That a certain Grant Deed executed by Wayne H. Miller and Lynne L.
Miller, his wife, in which Deed the Town of Los Altos Hills, a municipal
corporation, is named as Grantee, be and the same hereby is accepted, and
the City Clerk of the Town of Los Altos Hills be and she hereby is directed and
ordered to cause said Deed to be recorded in the Office of the Recorder of the
County of Santa Clara, State of California.
5. That the City Treasurer is authorized and directed to pay necessary
funds of the Town of Los Altos Hills in connection with the purchase of the
Property.
6. That the City Attorney be and he hereby is authorized and directed
to take all action necessary to complete the acquisition of title to the
Property.
REGULARLY passed and adopted this 21st day of October, 1987.
