II , Side II , 447-end Mayor Tryon called the Adjourned Regular Meeting to order at 12: 10 p.m. in the Council Chambers at Town Hall . She commented that Mayor Pro Tem Siegel was undergoing surgery and everyone wished him their best for a speedy recovery. A. ROLL CALL: Present: Mayor Tryon and Councilmembers Dronkert, Plummer and van Tamelen Absent: Mayor Pro Tem Siegel Staff: City Manager George Scarborough, City Attorney Frank Gillio and City Clerk Pat Dowd B. PREPARATION BY CITY COUNCIL OF REBUTTAL TO ARGUMENT IN FAVOR OF ADOBE CREEK LODGE INITIATIVE: Council had before them two draft arguments which had been prepared by the appointed sub-committee of the Council (Plummer and Tryon) . Judith Carico, 25311 O' Keefe, Sheri Emling, 11853 Murietta Lane, Judy Zurbriggen, 11800 Murietta Lane and Carol Phy, 25616 Moody Road, each addressed the Council with comments/suggestions regarding the draft rebuttals under discussion. PASSED BY CONSENSUS: To agree that the rebuttal to the argument in favor of the Abobe Creek Lodge Initiative would read as follows: The argument in favor of Measure B is misleading. There is nothing in this initiative about the size of housing units or number of occupants. There are no guarantees that the properties will be used only for senior housing. There is no process for public review of "accessory uses and structures" . Measure B purports to be about senior housing, but it really is not. Measure B does not assure more senior housing, only much higher density. B. PREPARATION BY CITY COUNCIL OF REBUTTAL TO ARGUMENT IN FAVOR OF ADOBE CREEK LODGE INITIATIVE (continued) : It would allow any present or future owner to build and operate facilities "including but not limited to" the ones listed. It would be very difficult for the Town to prevent abuse of this broad language. The Town would not have the right to "require CC&Rs" as stated in the argument in favor of Measure B. The process of updating the Town' s General Plan has just begun, with a 15-member citizen Steering Committee. Measure B would allow a developer to re-write our General Plan and Zoning Laws for his own benefit. If the initiative passes, the Town would be required to identify additional sites for future re-zoning. The Town could never amend those sections of its General Plan and Zoning Law re-written by Measure B without further elections. Measure B would create a mechanism for circumventing the planning processes of the Town, both now and forever. The issue of senior housing should not be used to overturn laws the Town has adopted with public involvement and support. Vote "No" on Measure B. C. STATEMENT PRESENTED BY COUNCILMEMBER PLUMMER REGARDING THE APRIL ELECTION AND THE ISSUE OF CABLE TV: lir Plummer presented a letter to the Council in which he stated that due to increasing business commitments , he had decided not to run for a full Council term in April . In addition, Plummer stated that he planned to assist in the formation of a group tentatively called Citizens for Underground Cable TV Access (CUCA) and he also planned to bring up several proposed actions at the next Council meeting on February 3 , 1988 concerning cable tv. (A copy of Councilmember Plummer ' s letter is on file at Town Hall . ) D.
