MINUTES OF A SPECIAL MEETING
Friday, March 25 , 1988

Mayor Tryon called the Special Meeting of the City Council to order at
7: 00 p.m. in the Council Chambers at Town Hall .
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Mayor Tryon and Councilmembers Dronkert, Plummer,
Siegel and van Tamelen

B. INFORMATION ON MEASURE B:
The City Manager read the following report dated 3/25/88 :
' Staff has reviewed the provisions of Measure B and is concerned about
the following issues:
1 . Measure B does not insure the construction of a senior housing
project. Measure B allows the construction of clustered housing at
higher density than allowed by present ordinances but provides no
specific enforcement mechanism to insure the units will be occupied by
seniors.
2 . The Town ' s Site Development Ordinance is designed to address
physical development of property exclusively. The Site Development
Ordinance cannot be used to insure that housing units are reserved for
seniors or , in general , to control use.
B. INFORMATION ON MEASURE B: (continued) :
3 . Measure B permits the construction of housing on the Adobe Creek
Lodge property at a significantly higher density than permitted under
present ordinances . The Adobe Creek Lodge property is known to be an
environmentally sensitive property with numerous constraints to
development. However, since no project application has been submitted
for Town review, staff is unable to analyze the negative environmental
impacts of the development of the property that will be permitted by
Measure B.
4 . Measure B will allow institutional type social and recreational
activities as accessory uses without the community controls provided
by a use permit.
5 . Measure B does not limit the number of occupants , guests or group
activities in the development it will permit.
6 . Section 8 of Measure B provides that if provisions of the Town' s
General Plan or Town ordinances, regulations , or policies are found to
be inconsistent with any provision of Measure B, the provision of
Measure B will govern.
Additionally, staff has a number of concerns over the practical
41/ difficulties in the implementation of Measure B if it is adopted,
including conflict in legal interpretations . '
Mayor Tryon then opened the meeting to comments and/or questions from
the audience.
Mr. Stephen Gaither, 26200 Moody Road, asked the City Attorney for an
interpretation concerning whether the Unruh Act would apply to Measure
B. Mr. Gaither also commented that there can be a secondary dwelling
only if there is a primary dwelling on the property and stated that
Measure B called for ' clustered senior housing. He also inquired
whether or not the Council felt it would have the authority to impose
CC&Rs on the property.
Mr. Guy Gugliotta, 25351 Moody Road, supported Mr. Gaither ' s proposal
and asked that the project be considered fairly. He felt that Mr.
Gaither was taking one step at a time and the cost of the units was
not pertinent to the project at this stage.
Mrs . Shari Emling, 11853 Murietta Lane , inquired whether there was any
provision in Measure B for convalescent or extended care for the
residents . Mrs . Emling did not support the concept of approving a free
reign for the project with the details to be worked out at a later
time.

Mrs . Rosemary Meyerott, 27100 Elena Road, stated that in her opinion
the Town ' s zoning was fine and no special zoning districts were
needed.
Mrs. Judith Carico, 25311 O' Keefe Lane, inquired, if Measure B passed,
would the owner of property similar to Adobe Creek who wanted to have
a similar project have to go the Council for approval or back to the
voters.
The City Attorney stated that the General Plan of the Town was a
blueprint for development and everything must be consistent with it.
The elements of the General Plan were reviewed on a regular basis with
legal advertisements and public hearings held on such reviews .
Concerning the CC&Rs, the City Attorney noted that in some cases
cities could add CC&Rs as a condition to the subdivision agreement.
Regarding the requirement of at least one person 62 years of age or
older being in each residence, the City Attorney stated that there was
no real definition of this requirement and this aspect would have to
be clarified. Questions were raised such as a spouse younger than 62
surviving. Would they be ineligible to stay? What if they remarried?
There was no extended care provided for in Measure B; however, it
could be arranged for off-site.
` Mayor Tryon thanked everyone for their comments and questions and
noted that staff was available if anyone needed any additional
information on Measure B.
C. ADJOURNMENT:
There being no further new or old business to discuss, the City
Council adjourned at 8 : 00 p.m. to an Adjourned Regular Meeting on
Wednesday, April 6 , 1988 at 5 : 00 p.m.
