II, Side II, 681 -end Mayor Dronkert called the Adjourned Regular Meeting of the City Council to order at 3:30 p.m. in the Council Chambers at Town Hall. The following were present: Mayor Dronkert and Councilnembers Allison, Fuhrman and van Tamelen; Planning Comnissioner Lachenbruch; City Manager George Scarborough, City Attorney Frank Gillio; City Fhgineer Michael Enright; Assistant Staff Planner Lori Scott; and City Clerk Pat Dowd. Also present: Sara Wykes, San Jose Mercury and Gwynne Bashkin, Los Altos Town Crier. F3 IN U-37 7N -Skrol WNS FTMU rCTION SBODM D AND CARRIM: Moved by Allison, seconded by Fuhrman and passed unanimously by all menbers present to approve the Consent Calendar, specifically: 1. Resolutions for Adoption: a) Resolution # setting the time and place of public hearing on an ll application for a Special lard Use Permit (Lards of Henry Harrison, 13490 Page Mill Iniad) This Resolution was not adopted. It was a duplication of a resolution adopted at the 7/17/85 meeting and was placed on this agenda inadvertently. b) Resolution #92-85 setting the time and place of public hearing on an application for a Special Lard Use Permit (Lards of Kornfield, 26209 Dori Lane) c) Resolution #93-85 setting the time and place of public hearing on an application for a Special Land Use Permit (Lands of St. Nicholas School, El Monte Avenue) •. • a••• •I •• a• •e+•aa la The City Attorney reported that the Los Altos City Council had approved the Joint Powers Agreenent at their meeting on 7/23/85 and also appointed two members to the JPA Board. In addition one member was appointed by the Los Altos Library Ccnmission. The City Attorney noted that the Los Altos City Council had amended two sections in the JPA which was before Council (dated 7/10/85). Section 6 was amended to include the rotation that the Ca ssioners would serve at the pleasure of the appointing body for a period of four years or until reioved. Section 16 was amended to delete any reference to binding arbitration as the settlement for disputes. CITY COUNCIL MINUTES - July 24, 1985 B. UOS ALTOS LIBRARY - JOINT POKERS AGREEMENT: rW Janice Yee, ActingCounty Librarian, noted that the JPA would be responsible to the voters and the amount of tax override would not exceed $36.00. A clarification of how the money would be spent would be done at a later time. Allison suggested that both Councils specifically approve the wording of the ballot measure on this issue. Allison was also concerned that the unincorporated area was not included in this Joint yrs Agreement. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Fuhrman and passed unanimously by all ambers present to adopt Resolution #94-85 approving and authorizing execution of North County Library Authority Joint Exercise of Powers Agreement between the City of the Town of Los Altos Hills and the City of Los Altos (including amer&fients to Sections 6 and 16). MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen and passed unanimously by all numbers present to appoint Judy Duque to the North County Library Commission. MOTION SECONDED AND CAR= : Moved by Allison, seconded by EUhnnan and passed by the following roll call vote to appoint CouncilmTp* Mary van Tamelen to the North County Library Cwmmission as an interim appointment until a decision is made �Aw at a later time as to whether Council wishes to permanently appoint a Councilmember or consider outside applications for appointment. AYES: Mayor Dr'onkert and Councilmmmbers Allison and EUhrman NOES: None ABSENT: Councilmember Rydell PRESENT: Councilmenbes van Tenelen MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by Allison and passed unanimously by all manbers present to request the North County Library Coamission to submit the ballot measure to the Councils of Los Altos and Los Altos Hills for review. It was agreed that Allison's concerns expressed earlier in the meeting would be given to van Tamelen as a member of the Commission. C. PIANNING AND ZONING PROCEDURE •• REO3NS`rRU0rI0N OF • 0. DAMACE) IN THE1 1985 FIRE The City Manager recamwsded the Council's approval of the following criteria in addition to adoption of the resolution before then establishing an expedited procedure for the reconstruction of single family residences or other building destroyed in a natural disaster: 1) no more than 158 increase in floor area; 2) architecturally similar; and 3) no increase in setback intrusion. *and if they were not addressed, he would oppose the JPA. PLANNING AND ZONING PROCEDURE FOR RECCNSTRUCPION OF HOUSES DPS IN THE JULY 1, 1985 FIRE (continued): Council and the Planning Cof isSioner discussed the percentage increase in floor area and agreed that it should be 108 instead of 158. It was further agreed that at a later date an urgency ordinance be reviewed by the Planning Ca ssion and the Council as a long-term solution to property destroyed in a natural disaster. MOTION SEONDED AND CARRIED: Moved by van Tamelen, seconded by Fubu:an and passed unanim usly by all members present to adopt Resolution #95-85 establishing an expedited Procedure for the reconstruction of single family residences or other building destroyed in a natural disaster with the following criteria; 1) no more than 108 increase in floor area; 2) architecturally similar; and 3) no increase in setback intrusion. PASSED BY CONSENSUS: To direct the Planning Commission to appoint two members of the Cmudssion to the Disaster Site Development Committee. PASSED BY CONSENSUS: To appoint Mayor Dronkert and Councilmamber Rydell to the Disaster Site Development Committee. D. LANDS OF NOULCK, IDT #1, COUNTRY WAY, RDCUES'f FDR A SPECIAL LAND USE PER= TO ALLOW CONSTRUCTION OF A NEW RESIDENCE HAVING A HEIGHT IN EXCESS OF FIFTEEN FEET The City Council adjourned to a Study Session on this item at 4:50 p.m. and recon- vened at 5:25 p.m. l E.
