HomeMy WebLinkAbout03/02/1983CITY COUNCIL TagN OF LOS ALTOS HELTC 26379 Fremont POad Los Altos Hills, California MINUTES OF A REGULAR MEETING* Wednesday, March 2, 1983 Mayor Perkins called the Regular Meeting of the City Council to order at 7:30 p.m. in the Council Chambers at To.•mn Hall. Present: Mayor Perkins and Councilmembers Allison, Hillestad, Pmft and vanTamelen (Hillestad arrived at 7:40 p.m. and Mayor Perkins left the meeting at 7:50 p.m. due to illness) Absent: Mayor Perkins after approximately 7:50 p.m. Staff: City Manager Ann Hinshaw, City Engineer John Carlson, City Attorney Frank Gillio, Planning Cannission Representative Richard Rydell and City Clerk Pat Dowd Press: Florence Pallakoff, Los Altos Town Crier; Fd Hering, San Jose Mercury; Mary Duenwald, Peninsula Times Tribune 1. Matadem Creek Subdivision - Offers on lots and Related Matters Council noted that item B.4a) on the Consent Calendar pertained to Matadero Creek and agreed to remove that item frau the Consent Calendar and consider it at this time during the meeting. MOTION SECONDED AMID CARRIED: Moved by Proft, seconded by Allison and passed unanimously by all muenbers present (Hillestad not present) to adopt Resolution #1526 rescinding Resolution #1516 concerning Lot 1, Tract 7187, Matadero Creek Subdivision. a) Lot #1 Jackye Welfe, Fox & Carskadon, reported that she had received two offers on lot first o er was m all cash offer of $211,500 with a closing date in 45 days. The second offer was an all cash offer of $211,500 with a close of escrow ninety days or sooner. A discussion follaed concerning the contingencies of both offers. Mayor Perkins left the Council meeting due to illness. MOTIOtN SECONDED AMID WITHDRAWN: Moved by Allison, seconded by Proft and withdrawn to adopt the next resolution in order accepting the second offer on lot #1. Council reconsidered the offers before then. The potential purchaser of lot #1 who made the first offer agreed to increase his offered price by $5,000. Since both potential purchasers were not present, Council agreed to give an additional 48 hours for resubmission of offers and to consider these offers at the next .i1. Matadero Creek Subdivision - Offers on Lots and Related Matters (continued) ,ter a) Lot #1 (continued) t✓i71'ION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously by all members present to give the prospective purchasers of lot #1 48 hours to modify offers. b) Lot #8 Jackye Wolfe, Fox & Carskadon, reported that she had received an offer on lot #8 of $216,000 (all cash offer) with no contingencies and a close of escrow of 3/16/83. M3TION SECONDED AIM CARRIED: Moved by Proft, seconded by Hillestad and passed unanimously by all members present to adopt Resolution #1529 accepting proposal and ordering sale of real property, directing payment of real estate wnnission, authorizing execution and delivery of deed, and accepting deed of trust and authorizing recordation thereof concerning Lot #8, Tract No. 7187, Mata ero Creek Subdivision. C) Lot #7 Jackye Wolfe, Fox & Carskadon, reported that she had received two offers on lot 7. The first offer was an all cash offer of $180,000 with a close of escrow in 60 days. A discussion followed of the contingencies of this offer as stated in the addendum to purchase agreement dated 2/26/83. The second offer for lot #7 was an all cash offer of $180,500 with no contingencies and a close of escrow to be decided by Council. MOTION SECONDED AMID WITBDRAWN: Moved by Allison, seconded by Proft and withdrawn to present a counter-offer to the potential purchaser of lot #7 (second offer) of a closing date of March 15, 1983. Council discussed the situation of having multiple offers on the same lot and again noted that both potential purchasers of lot #7 were not present at the meeting. It was agreed to follow the same procedure as earlier in the meeting regarding lot #1, i.e. to alloy the prospective purchasers an additional 48 hours to resuhmi.t their offers. MOTION SECONDED AMID CARRIED: Moved by Allison, seconded by Proft and passed unani- mously by all members present to give the prospective purchasers of lot #7 48 hours to modify their offers. d) Lot #5 MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Proft and passed unani- mously by all members present to grant a three-day extension to the buyers of lot #5 for the increase of deposit. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen area passed unanimously by all members present to accept the buyer's request (lot #5) for a partial discount of 2.25% for an additional $50,000 payment by 12/31/83. -2- %w CITY ODUNCIL MINUIES - March 2, 1983 1. Matadero Creek Subdivision - Offers on Lots and Related Matters e) Multiple Offers on Lots Counc>>+Tembers, the City Attorney and Jackye Wolfe of Fox & Carskadon discussed the procedures involved when more than one offer was received on a lot. The possibility of an auction was reviewed; however, it was suggested this may not be the most productive manner in which to consider multiple offers. The City Attorney noted that prospective purchasers of the lots and their agents should be present at the next Council meeting when these offers are reviewed. It was futher noted that at that time Council would decide which, if any, of the offers would be accepted. B.
