I, Side II, 185 -end, Tr. II, Side I, 001 -end Mayor van Tamelen called the Regular Meeting of the City Council to order at 7:30 p.m. in the Council Chambers at Toon Hall. MUTION SEOOfIDID AND CARRIED: Moved by Hillestad, seconded by Proft and passed unani- mously by all members present to change the order of the agenda as follows: Item E.1 would be heard under Itan C. Presentations from the Floor. A. CONSENT CALENDAR: Item Removed: B.1 (City Manager) MOTION SEODNDED AND CARRIED: Moved by Proft, seconded by Perkins and passed unanimously by all members present to approve the balance of the Consent Calendar, specifically: 2. Approval of Warrants: $46,169.93 3. Actions of the Planning Commission: recommended granting of the following: a) LANDS OF MARCUS, File VAR #9-83 C. PRESENTATIONS FROM THE FTWR: 1. Chancellor Thomas Fryer - Foothill-DeAma CaRmuuity college District - Infornstional Presentation Chancellor Fryer addressed the Council on the financial status of the Foothill- DeAnza College District and presented a detailed handout on the subject entitled 'Foothill-DeAnza Twenty -Six Years of Excellence: Mr. Fryer explained the measures C which were being considered to mitigate the financial situation of the District, `r i.e. Project Independence, a special tax election. Chancellor Fryer concluded his presentation by thanking the Council for the opportunity to bring then up-to- date on the recent activities of the District. CITY COUNCIL MEN= - November 16, 1983 D. SPECIAL ORDERS: 1. Ordinance #282 amending Section 9-5.1110 of Chapter 5 of Title 9 of the IAs Altos Hills Municipal Code (concerning procedures for variances and conditional use permits) SENDID READING Planning Commission Representative Lachesbruch expressed concerns on behalf of the Planning Commission regarding the Ordinance as it was now before the Council. It was the Commission's opinion that the following sentence should be a part of the Ordinance: 'Prior to taking any action reversing the decision of the Board of Planning Administration or Environmental Planning Commission, the Council shall refer the matter back to the approving body for review and report within thirty days from the date of the Council referral. The action of the Council shall be effective immediately upon a decision.' Council discussed the need for formalizing the action between the Commission and the Council and concern was also expressed regarding excessive delays to the applicants involved. MOTION SECONDED AMID CARRIED: Moved by Proft, seconded by Perkins and passed unani- mously by all members present to continue this item to the next Council meeting and to appoint Councilman Perkins and Comnissioner Lachenbruch to a subcommittee to review the ordinance and the concerns of the Commission and the Council. E. UNFINISHED BUSINESS: 1. Representatives from the Santa Clara Valley Water District (Boardmanbers Audrey Fishes and James Leniban; Counsel, Albert Henley, and Engineer, William Carlson) - Report on dam at Moody and Rhus Ridge Roads It was noted by Councilman Proft that a field trip had taken place at 4:00 p.m. on November 16, 1983 which was attended by representatives of the SCVWD and CounciimmaTbers Perkins and Proft. Councilman Perkins expressed the Town's concerns that a substantial dam was across a major drainage channel and was causing serious drainage problems. Representatives of the SCVWD discussed the matter with the Council. Mr. Henley commented that the permit issued by the SCVWD allowed the dam to be repaired and the sc-vm did not have the authority to get rid of the dam. Mr. Henley further camnented that the neighbors involved would have to work out the problem together. Mr. Carlson conented that there was a range of solutions which included the expensive decision to take out the dam and reline the creek or the less expensive option of building a bermm around the area in question. Mr. Dennis Ely, engineering technician of the SCM enumerated projects which had been performed by the SCVWD in the Town in the recent past and the approximate costs of the projects. Mr. Marc Kauf man, 14100 Donelson Place, reminded the Council of the strongly expressed opinion in the past that there should be m charge to any natural waterways in the Town. Mrs. Louise Dronkert, 24731 Black Mountain Road, asked who had paid for the removal of the tree when the SCVWD had issued the permit concerning the dam. Mrs. Dronkert was informed the owners, net the SCVWD, had paid for the tree. `. Mrs. Mary Stutz, 25310 Elena Road, cautioned against removal of the dam in �r question ani ending up with a cement structure. It was very possible, in Mrs. Stutz' opinion, that the dam had prevented certain problems. -2- CITY OOUNCIL MIN= - November 16, 1983 E. LNFINISBED BUSINESS: (continued) - Item 1 MMION SECONDED AMID CARRIED: Moved by Proft, seconded by Hillestad and passed unan;mously by all members present to direct the staffs of the SC4WD and the Town Hall to work together on the problem of the dam at Moody and Rhus Ridge Roads with the assistance of the Town's Geologist, William Cotton toward a cooperative inmediate solution. It was further stated the owners of the tree m question should be notified and asked for any suggestions they might have regarding the issue. 3. Pepresentative from the Sheriff's Department (Lt. Houston) - plan for enforcement of the Town's traffic ordinances Lt. Houston explained to the Council that the contract with the Torn was based on activity tours in Torn. He further noted that there were responsibilities in addition to traffic enforcement, i.e. burglary investigations. Lt. Houston asked what specific concerns the Council had so that the Sheriff's Department could focus on these areas more effectively. Lt. Houston suggested, and Council agreed, that an effective Nay to channel these requests and concerns would be to coordinate then through Andrew Cochran, C1 rmwn of the Safety Committee. Mrs. Alma Wood, 12151 Stonebrook, questioned whether the Sheriff's Department could enforce the speed of the trucks on Stonebrook and was informed that while the truckers of course had to obey the speed laws as did anyone else, it was difficult to enforce because the truckers had CB radios and transmitted the infor- mation to each other that a deputy was nearby. Items Removed from the Consent Calendar: a) Approval of Minutes: November 2, 1983 PASSED BY CCNUSENSUs: To approve the November 2, 1983 City Council Minutes with the following ammn ents: Page 3, Item D.4b), first paragraph should read as follows: 'van Tamelen announced that on December 9 in San Jose the State Assembly local Government Committee was sponsoring a seminar on long-term financingg';Page 4, Item E.l.c) should read as follows: 'The City Manager reported that the responses to the PF'Ps had been received...........; Page 6, Item F.l.b) the following roll call should be added after the last paragraph; AYES: Mayor van Tamel.en and Council- merbers Allison and Perkins - NAES: Councilman Proft. Councilman Proft left the meeting at 9:15 p.m. � 1. Reports from Standing Committees: a) Cammuv.ty Pel.ations Caanittee: Ed Barnes, Chai.rnan, reported that there would be a Town Newsletter in December; the Orientation Day had been delayed until Spring of 1984 and the Awards Luncheon would be held on Friday,. Reports frau the Planning Coavdssion: Cmmissioner Lachenbrvch referred to Chairman Rydell's recent letter to the Council which requested that the Planning Coimiission be involved in the decision-making process concerning professional planning services for the Turn. PASSED BY CONSENSUS: To approve the presentation from the City Manager of her recommendations concerning staffing and professional planning services to the Planning Commission, prior to Council's final decisions. Commissioner Lachenbruch further reported that the Canmission was reviewing the discretionary provisions of the Town's Cade, i.e. what can and should the Than do to protect neighbors' views, etc.; the possibility of a re -landscape plan was being considered as an option. 4. Couaents from the Council: a) Mayor van Tamelen: i) Announcenent of 'Winter Storm Preparedness Week' - November 13-19, 1983 PASSED BY CONSENSUS: To approve announceuent of 'Winter Storm Preparedness Week' - NoveNber 13-19, 1983 and to include a similar article in the Town's Newsletter. ` ii) Report on Board of Supervisors 11/22/83 meeting concerning zoning changes PASSED BY CONSENSUS: To direct the Mayor to attend the meeting on the 22nd and to write a letter stating the Council's opposition to any changes in the hillside zoning. iii) Status report on recycling center van Tamelen reported that the recycling center was scheduled to close the end of December. They may get a now center in San Jose but that was presently uncertain. Tan Henderson, General Manager - Solid Waste Management Authority, had offered to assist in working out an interim solution. It was agreed the City Manager would contact both Tom Henderson and Ios Altos Garbage Company for interim assistance with recycling. iv) Report on Neary Quarry van Tamelen reported that a meeting had been scheduled with Supervisor Morgan for Wednesday, November 30, 1983 at Town Hall with a field trip following the meeting to the quarry. All interested persons were welome to attend. G. STAFF - REMITS, CORRESPONDENCE AND AMULZ 3!4KgrS: 1. City Manager: (� a) Status report on Tuan radio financing y The City Manager reported that the Bank of Anerica was processing the loan request and an answer should be received next week. In addition, Motorola had been asked what amount their loan could be paid off for and hopefully the issue would be settled by the beginning of December. -4- kw CITY COUNCIL MINUTES - Novmiber 16, 1983 G. STAFF - REPORTS, NRRPSPONDENCE APED ANNOUNCENEMUS (continued): 1. City Manager (continued) b) Report on compliance with State Law concerning Town Budget The City Manager reported that the Town was in compliance with two exceptions: 1) the financial report to the State Controller would be mailed and posted on the 17th of November and 2) information was still required to complete the monthly reports; the matter hopefully would be resolved by the beginning of December. c) I= - Legislative Briefing MXTGN SECDNDED APED CARRIED: Moved by Perkins, seconded by Hillestad and passed unanimously by all members present to approve the City Manager's attendance at the December 8, 1983 IOCC Legislative Briefing at a cost of approximately $30. d) Audit and Matadero Creek Financial Report The City Manager oomiented that a meeting of the Finance Caimittee, the City Manager and the Auditors was scheduled for 3;30 p.m. on Tuesday, November 29, 1983. 2. City Engineer: a) Report on La Palana Drainage Issue The City Engineer presented his report dated 11/14/83 which included the Planning Ccmnission's recmriendation that the City Council hire a consulting engineer to help the City Engineer solve the problems at the La Paloma Drainage Basin on a short-term basis and that a study be prepared by an engineering firm which would provide an overall drainage improvement plan for the La Paloma Drainage Basin. Staff concurred with these recommendations. Mrs. Rose Pfefer, 26089 Todd Lane, conmpnted that action was needed not a study. Water was being diverted onto their land which was causing the problems. What could they do to help themselves? In response to this question, the City Engineer noted that the plans developed would be public docwrents which the owners could take to their own engineers for work on their property. MOTION SEODNDED AMID CARRIED: Moved by van Tamelen, seconded by Hillestad and passed unanimously by all members present to authorize hiring a consulting engineer (up to a naximmm expense of $2,000) to provide plans of the La Palcma Drainage Basin and to include expedient suggestions for the drainage problems at the Basin. It was further directed that the Roads and Drainage Committee would be contacted for their input before said engineer was hired. -5- kaw CSTY OOUNcIL MINUTES - November 16, 1983 H. NEW BUSINESS: 1. ODmideration of relocation of Town's notice boards van Tamelen camiented that it had been brought to her attention that the notice boards might be relocated so that residents could reach then more easily. It was also reported that to advertise the Council's agendas in the Los Altos Tuan Crier The Peninsula Times and the San Jose Mercury would cost approximately $5,300 On an annual basis. PASSED BY OONSE31SLS: To agendize the item of notification of Council meetings for the December 7, 1983 meeting. 2. Appointment to Environmental Design, Parks and Recreation Camuittee MOTION SE]CaZED Am CARRIED: Moved by Hillestad, seconded by Perkins and passed unanimously by all members present to appoint Mary Stutz to the Environmental Design, Parks and Recreation Committee. I. CASED SESSION: The Council did not have a Closed Session. J.
