MINUTES OF A REGULAR MEETING

Mayor
Proft called the Regular Meeting of the City Council to order at 7:40 p.m. in
the Council Chambers of Town Hall.
A.
ROLL CALL AM PLEDGE OF ALLEGIANCE:
Present: Mayor Proft and Councilmembers Hillestad, McReynolds, Nystrom & Perkins
(Camcilmmbers Hillestad and McReynolds arrived at 7:45 p.m.)
Absent: None

CONSENT CALENDAR:

MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Nystrom and passed
unanimously by all nembers present to approve the balance of the Consent Calendar,
specifically:
2. Approval of Warrants: $49,952.69
Items Removed:
1. Approval of Minutes: January 14, 1982 and January 20, 1982
Andrew Allison, 27360 Natoma Road, had several coments, suggestions and/or
corrections to the minutes of January 14 and January 20, 1982.
PASSED BY CONSENSUS: Council directed the Deputy City Clerk to check the tapes
of these meetings and to continue approval of these minutes to the next Council
meeting.
3. Actions of the Planning Catmission: remumended granting of the following:
a) LANDS OF GIGLI, File CUP #2-81 (continued from 1/20/82 meeting)

Mr. Frank Gigli, applicant, asked that the wording in Condition #5 be changed to

Council aril staff discussed this requested change and its possible ramifications.
MOTION MADE AND SECONDED: Moved by Hillestad, seconded by Perkins to change
Condition #5, Lands of Gigli, to read as follows: I. . .when all through path.
connections are made between Adona Court and Elena Road.'
PASSED BY OCNSENSUS: To direct staff to clarify the wording of this condition
and to consider the applicant's request later in the Council meeting.
MOTION SECONDED AND CARRIED: Moved by McReynolds, seconded by Perkins and passed
unanimously to table the motion to change the wording of Condition #5, Lands of
Gigli.

4. Presentations from the Floor:
Andrew Allison, 27360 Natama Road, presented a report to Council in which he
stated that 'a considerable amount of misinformation concerning the history and
E likely future of the cost of Sheriff provided police protection had emanated
from City Hall of late.' Mr. Allison requested Council and staff to 'refrain
from further distortion of the facts relating to Sheriff provided services.'
A copy of this letter is on file at Town Hall.
D. STAFF - REPORTS, CORRESPONDENCE AM A[VOUNCU=S:
1. City Manager:
a) Public Works Communication System
The Mayor read a request from the City Manager for authorization to solicit
proposals to supply a Public Works communications system and to select a proposal
that most closely reflected the Town's needs.
Marc KauSnan, 14100 Donelson Place, reported to Council that he, Gordon Penfold
and the City Manager had met at length to discuss the original request for a
communications system, what was actually needed, frequency allocations, etc.
In Mr. Kaufman Is opinion the request before Council had been carefully studied
and was reasonable.
Council discussed the request before then noting that the statements of the bids
must be very clear. McReynolds also suggested that the bids be negotiated as
opposed to closed. It was also pointed out that the equipment in question could
be used for any go function.

Council expressed their thanks and appreciation to Mr Kaufman for his
assistance and advice on this matter and further appointed him a Citizen's
Participation Committee of one to continue to work with the Town on the
issue of c mnunications.
MOTION SECONDED AND CARRIED: Moved by McReynolds, seconded by Nystrom and
passed unanimously to authorize the City Manager to Proceed with negotiated
bids (bidding by more than one qualified vendor) for a Public Works Crumuni-
cations System.
b) County Joint Powers Agreement
MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Perkins and passed
unanimously to decline to participate in the County Joint Powers Agreement.
c) Report on Lands of Meredith, File SA #2-80
In response to a complaint raised at the January 20, 1982 Council meeting
reqarding multiple dwelling units on the Lands of Meredith, the City Engineer/
Planner presented to Council the City Manager's report on this matter dated
January 29, 1982 which gave a brief historical overview of the Lands of Meredith.
in addition the City Engineer/Planner presented an additional report which he
had prepared dated February 3, 1982. In this report he described the four
buildings in question (three unoccupied and one occupied by a construction
worker/guard while remodeling is being completed) and noted that at present
the owner was complying with the intent of the Municipal Code and staff would
continue to work with the owner.
Kenneth Young 14740 Manuella Road, expressed concerns again regarding the
timeliness and efficiency on the Part of staff and Council regarding the Lands
of Meredith, File SA #2-80.
E. SPECIAL ORDERS:
1. Public Hearing:
a) Request for Tentative Map Approval, LANDS OF TOKHEIM & GREEN, File
TM #5-81
NOTION SECONDED AND CARRIED. moved by Nystrom, seconded by Perkins and passed
unanimously to adopt the Negative Declaration, LANDS OF TOKEO;IM & GREEN, File
TM #5-81 with the following mitigating measure: "All potential impacts on the
environment, which are primarily related to surface water runoff, will be
mitigated by the inclusion of a storm drain easement and surface water drain -
fields in the development of the project."
Timothy Sandi.s applicant's engineer, noted that the owners of the property
had taken a careful and sensitive approach to the development of their land
and had been working on the plans since 1979. The plans now before Council
were thought to provide an adequate building site without unduly disrupting the
terrain.

MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Proft and passed
unanimously to amend Condition 1.D to read: "The owner shall dedicate a thirty
foot (301) pedestrian/equestrian easement as shown on the Tentative Map, dated
Received, January 7, 1982."
MOTION SEDOEDED AM CARRIED: Moved by Hillestad, seconded by Perkins and passed
unanimously to add Condition 1.E. aS follows: "The owner shall indicate that
habital structures shall be prohibited from the setback area for the Berrocal
Fault."
MOTION SDOCNDED Am CARRIED: Moved by Proft, seconded by Perkins and passed
unanimously to amend Condition 1.A to read: "On Lots 2 and 3 surface rain water
shall be captured in underground drainfields in order not to excessively
increase surface runoff."
MOTION SEOOMED AND CARRIED: Moved by Hillestad, seconded by Proft and passed
unanimously to amend Condition 1.B to read: "Plans for work over the Frampton
property to Hal Creek as proposed in a letter by Edwin Green dated September 9,
1981 and accepted by Mrs. W.D. Frampton on October 9, 1981, are to be incor-
porated in with the subdivision improvement plans."
PASSED By CONSENSL6: To add Condition 10.0 to the Conditions of Approval as
follows: "Appropriate storm drainage easements shall be established to carry
surface drainage from lots 2 and 3 to the drainage swale.
MOTION SECONDED AND CARRIED: Moved by Nystrom, seconded by Hillestad and passed
unanimously to approve the Tentative Map, LANDS OF TOKHELN & GREEN, File TM #5-81,
subject to conditions as remmended by the Planning Camdssion and as emended by
Council.
GENERAL ORDERS AND UNFINISBED BUSINESS:
1. Lands of Gigli, File CUP #2-81
MOTION SEEDNDED AM CARRIED: Moved by McReynolds, seconded by Hillestad and
passed unanimously to removed from table the motion to change the wording of
Condition #5, Lands of Gigli.
PASSED By CONSENSUS: To withdraw motion to change Condition #5, Lands of Gigli,
to read as follows'. . .when all through path connections are made between
Adona Court and Elena Road.'
Council and staff discussed the present path situation on and near the property
in question, present and future path needs and implications of different wordings
of Condition #5.
Fran Stevenvson Chaiznian/Pathways Crnmittee, advised Council that as she under-
stood the applicant's request the Pathways Committee was in agreement.

F GENERAL ORDERS AM UNFINISHED BUSINESS: Item 1 - Lands of Gigli (continued):
MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by McReynolds and
passed unanimously to delete the word "any" from Condition #5.
MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Perkins and
passed unanimously to approve the Conditional Use Permit for the Lards of
Gigli, File CUP #2-81 as reccmnended by the Planning CcMission and as
amended by Council.
2. Cost and Distribution of City Council Agendas and Minutes
MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Nystrom and
passed unanimously to continue the present policy of cost and distribution
of City Council Agendas and Minutes.
G. NEW BUSINESS:
1. Intergovernmental Council
Proft asked Council for their comments and/or suggestions regarding a questionnairE
he had received from Janet Gray Hayes, Mayor of San Jose, concerning the IGC.
CouncihTembers responded that in their opinion the Inter -City Council was of
much more benefit to the cities than the IGC and both organizations were not
necessary.
6V 2, Fire Damage Report - Tanglewood Lane
Council discussed the Building Official's report on the recent fire at 26750
Tanglewood Lane. In addition to stressing the importance of better education
regarding fire retardant measures, Council also questioned whether there were
ways of reducing the possibility of fire in the steeper developed areas.
H. ADJOURVMENr:
There being no further new or old business to discuss, the City Council adjourned
at 9:50 p.m. to an Adjourned Regular Meeting at 7:30 p.m, on Tuesday, February 23,
1982.
