Mayor Perkins called the Special Meeting of the City Council to order at 1:35 p.m.
in the Council Chanbers of Town Hall.

Present: Mayor Perkins and Councilmembers Allison, Proft and van Tamelen
Absent: Councilwoman Hillestad
Staff: City Attorney Frank Gillio and City Clerk Pat Dowd

The City Council adjourned to a Closed Session for personnel and litigation at
1:40 p.m. and reconvened at 2:15 p.m.
MYPION SEODDIDID AND CARRIID: Moved by Allison, seconded by Proft and passed unani-
mously by all members present to reject the claim of Frank I. Yoshida and Chiedo
Yoshida, as amended.

Mr. Stan Davis, Almaden - San Jose, addressed the Council and stated that he
accepted the counter-offer made by the Council at their meeting of 10/21/82. While
Mr. Davis did agree with the price of $256,500, he did, however, request a change
to condition #9 of the addend= to purchase agreement. Mr. Davis and the Council
discussed the changes Mr. Davis wanted to make concerning the site develgment
committee approval process and it was agreed Mr. Davis would review this matter
with Fox & Carskadon and the matter would be agendized for the 11/8/82 Council meeting.
Mr. James Viso, owner of Lot #12 at Matadero Creek, expressed serious concerns about
uncil lowering the pri
Coces for the remaining lots. Council informed Mr. Viso that
a 108 discount was being offered for all cash offers but the prices were not being
lowered.

C. ODUNCIL PERSONNEL:
�I The City Attorney comented that although questions had been recently raised
regarding certain actions of a councilmember, he did not think it appropriate
for Council to take any action until the investigation was cm pleted. The City
Attorney further co mented that if a Councilmmber were absent for sixty days
or convicted, their council seat became vacant. At that time the remaining members
of the Council could appoint someone or call for a special election; this appoint-
ment uvald be for the unexpired term.

PASSED By OONSENSUS: To temporarily appoint Andrew Allison as the Tam's repre-
sentative to the Solid Waste Management Board and Nary van Tamelen as the Town's
liaison with the representatives from People Who Care Recycling.

at 2:90 p.m.
