I, Side I, 426-628 Mayor Perkins called the Special Meeting of the City Council to order at 4:35 p.m. in the Council Chambers of Town Hall. A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Mayor Perkins and Councilmembers Allison, Hillestad, Proft and van Tamelen Absent: None Staff: City Attorney Frank Gillio, City Planner John Carlson, Assistant City Planner Pat Webb and City Clerk Pat Dowd Press: Florence Pallakoff, Los Altos Town Crier; Mary Duenwald, Peninsula Times Tribune; Ed Herring and Lisa Shepard, San Jose Mercury B. COUNCIL PERSONNEL: MOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by Allison and passed by the following roll call vote that Council deplore the fact that Lucile Hillestad has not vacated her Council seat until this matter is resolved. AYES: Mayor Perkins and Councilmembers Allison, Proft and van Tamelen NOES: None ABSTAIN: Councilwoman Hillestad MOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by Allison and passed by the following roll call vote to formally request Lucile Hillestad to vacate her Council seat. AYES: Mayor Perkins and Councilmembers Allison and van Tamelen NOES: Councilman Proft ABSTAIN: Councilwoman Hillestad Proft stated for the record that in his opinion the charges against a fellow Council - member were at this time only charges and it was inappropriate for Council to take action. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen and passed by the following roll call vote that Council formally reassign all committee and outside representations held by Mrs. Hillestad and notify all outside organizations of that action. AYES: Mayor Perkins and Councilmembers Allison, Proft and van Tamelen NOES: None ABSTAIN: Councilwoman Hillestad CITY COUNCIL MINUTES - November 3, 1982 C. MATADERO CREEK SUBDIVISION - OFFERS ON LOTS 1. Lot #20 Jacqueline Wolfe Fox & Carskadon, noted that the list price for Lot #20 was 270,000 and an offer had been received for $250,000. MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and failed by the following roll call vote to increase the price to $255,000 with the remaining conditions of the sale to remain the same. AYES: Councilmembers Hillestad and Proft NOES: Mayor Perkins and Councilmembers Allison and van Tamelen MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen and passed by the following roll call vote to adopt Resolution #1495 accepting proposal and ordering sale of real property, directing payment of real estate commission, authorizing execution and delivery of deed, and accepting deed of trust and authorizing recordation thereof concerning Lot 20, Tr. 7187, Matadero Creek Subdivision. AYES: Mayor Perkins and Councilmembers Allison and van Tamelen NOES: Councilmembers Hillestad and Proft 2. Lot #2 Jacueline Wolfe Fox & Carskadon, presented the new offer which had been received for Lot #2 of 200,000. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen and passed unanimously to instruct the agent to counter with an offer of $210,000; a change for #4 of the terms of sale as follows: $90,000 in the form of a Note secured by a 1st Deed of Trust. . . ..; and the acceptance of the CC&Rs as amended to date. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by van Tamelen and passed unanimously to amend Resolution #1495 to include the CC&Rs as amended to date. There was no Closed Session held for personnel and litigation matters. D.
