II, Side I, 001-417 Mayor Perkins called the Special Meeting of the City Council to order at 3:30 p.m. in the Council Chambers at Town Hall. A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Mayor Perkins and Councilmembers Allison, Hillestad, Proft and van Tamelen Absent: None Staff: Acting City Manager Marty Tarshes, City Attorney Frank Gillio, City Planner John Carlson, Planning Commission Representative Arthur Lachenbruch and City Clerk Pat Dowd Press: Mary Duenwald, Peninsula Times Tribune, Florence Pallakoff, Los Altos Town Crier and Ed Herring, San Jose Mercury `, The City Council then adjourned to Closed Session for Personnel at 3:30 p.m. and reconvened at 3:45 p.m. B. CITY MANAGER POSITION MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Proft and passed unani- mously to adopt Resolution #1499 appointing Ann Hinshaw as City Manager for the City of the Town of Los Altos Hills. Ann Hinshaw thanked the Council for the appointment as City Manager and noted that she was looking forward to working with them. C. MATADERO CREEK SUBDIVISION - Lot #2 MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously to adopt Resolution #1500 accepting proposal and ordering sale of real property, directing payment of real estate commission, authorizing execution and delivery of deed, and accepting deed of trust and authorizing recordation thereof concerning Lot 2, Tract No. 7187, Matadero Creek Subdivision. D. MATADERO CREEK SUBDIVISION - Lot #18 The City Planner reported that the Lot Review Committee had met on 11/22/82 and had the following recommendations concerning Lot #18: approval of 14,900 square feet (split vote); possibility of increase to 555' height limitation with proper plan. f The Committee had no recommendations concerning color of house and landscaping. CITY COUNCIL MINUTES - November 22, 1982 MATADERO CREEK SUBDIVISION - Lot #18 (continued): 41A►' Gary Filler, potential buyer, addressed the Council and explained his reasons for requesting t e increase in height and development area. Planning Commission Representative Arthur Lachenbruch expressed concern that the Town be consistent in dealing with the individual lots. He strongly urged the Council to adopt a formal procedure for establishing criteria to apply for relief from certain regulations imposed on the lots. Frank Saul, 27977 Via Ventana, questioned the procedure regarding Lot #18. He had been under the impression that all of the contingencies had been worked out except the height limitation. MOTION SECONDED AND WITHDRAWN: Moved by Allison, seconded by Hillestad and withdrawn to issue a counter offer for Lot #18 of 14,900 square feet with the possibility of further slight extension through the variance procedure and with a 555' height limitation. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Proft and passed by the following roll call vote to approve a 555' height elevation for Lot #18. AYES: Mayor Perkins and Councilmembers Allison, Hillestad and Proft NOES: Councilwoman van Tamelen van Tamelen commented that she did not agree to the increase in the height limi- tation because she did not feel there had been an effort on the part of the `, potential buyer to compromise regarding this issue. MOTION SECONDED AND FAILED: Moved by Proft, seconded by Hillestad and failed by the following roll call vote to approve a maximum development area of 15,365' and to adopt a resolution so amending the CC&Rs. AYES: Councilmembers Hillestad and Proft NOES: Mayor Perkins and Councilmembers Allison and van Tamelen MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed by the following roll call vote to adopt Resolution #1501 approving a further "amend- ment to declaration imposing conditions, covenants, restrictions, easements and agreements" upon Tract No. 7187, entitled "Matadero Creek Subdivision", and authorizing execution and recordation thereof. (This change to the CC&Rs was as follows: approval of 15,165' maximum development area for Lot #18.) AYES: Councilmembers Hillestad, Proft and van Tamelen NOES: Mayor Perkins and Councilman Allison MOTION SECONDED AND CARRIED: Mored by Allison, seconded by van Tamelen and passed unanimously to approve the house location for Lot #18 as shown. on Site Plan for Lot #18, Matadero Creek Subdivision, dated received 11/19/82. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Perkins and passed unanimously to approve the following colors for the house on Lot #18: Q5 -26P, Q5 -6P, Q5 -46P, Q5 -7P and Q5 -47P. (These colors are shown on a report on file from Fox & '�✓ Carskadon to the Council dated 11/18/82.) -2- CITY COUNCIL MINUTES - November 22, 1982 D. MATADERO CREEK SUBDIVISION - Lot #18 (continued): A/ MOTION SECONDED AND CARRIFD: Moved by Hillestad, seconded by Allison and passed unanimously to approve the following landscape plan for Lot #18: The designated open space and landscape areas will be planted in natural plants and trees as required by the City. 80% to 85% of the remainder of the lot not covered by development will be in sod. The remainder will be in dwarf trees, small plants and flowers. - Gary Filler potential buyer, stated for the record, when asked by Mayor Perkins, that he planned to landscape the front of his property on Lot #18 according to the Town's requests. Jack e 1121R Fox & Carskadon, reported that her client was planning to discuss the above changes with nis designer and he would make his decision by midnight 11/22/82 and report his decision to Ms. Wolfe. E. MATADERO CREEK SUBDIVISION - CC&Rs MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously to continue review of further proposed changes in the CC&Rs for Matadero Creek Subdivision to the next Council meeting. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously to adopt the following policy statement regarding the CC&Rs for Matadero Creek Subdivision: No exceptions will be recommended to the CC&Rs unless the following conditions are met- a) There are special circumstances or �,. conditions affecting such property so that the strict application of the CC&Rs would deprive the applicant of the reasonable use of his land and b) By granting the conditional exception applied for, any other landowner sha-rnot be deprived of the reasonable use of his land nor be subjected to undue burdens or hardships or be deprived of any material use or enjoyment of his property. PASSED BY CONSENSUS: To direct the City Clerk to send a copy of this motion to Fox & Carskadon, present lot owners and to make the information available to any potential purchasers. F. MATADERO CREEK SUBDIVISION - consideration of amendment of amounts and method of payment of purchase prices for lots previously sold in Tract 7187 MOTION SECONDED AND b!ITHDRAWN: Moved by Proft, seconded by Allison and withdrawn to table consideration of this item. .`, MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Allison and passed unani- mously to direct the City Manager to discuss with lot owners their possible interest in all cash offers and to report back to Council on this matter.
