Reel 140, Side I, Tract I, 000-200 Mayor Perkins called the Adjourned Regular Meeting of the City Council to order at 4:00 p.m. in the Council Chambers of the Town Hall. A. ROLL CALL: Present: Mayor Perkins and Councilmembers Allison, Hillestad, Proft and vanTamelen Absent: None Staff: Acting City Manager Marty Tarshes; Assistant City Attorney William Hughes; City Engineer/Planner John A. Carlson; Secretary Leslie Penfold Press Florence Pallakoff, Los Altos Town Crier; Mary Duenwald, Peninsula Times Tribune The City Council then adjourned to a Closed Session for Litigation at 4:00 p.m. and reconvened at 4:40 p.m. B. MATTERS RELATED TO MATADERO CREEK SUBDIVISION: Mr. Tarshes indicated to the City Council the 4 lots previously sold (9, 10, 12 and 17)the owners have requested a change in finanical arrangements, noting these lots were bought under the bidding conditions. The owners propose to pay the balance in cash at this time,provided a ten percent discount from the amount of purchase price is approved by the City Council. The request is in the best interest of the Town, Mr. Tarshes indicated, and seems to be acceptable. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by vanTamelen and passed unanimously that the City Council place a policy that any of these people who have notes with Matadero Creek Subdivision (Lots 9, 10, 12 and 17) as a condition of reconveyance to be required to accept the Covenants, Conditions and Restrictions as amended. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Proft and passed unanimously that Resolution 41511 be accepted approving a discount and accepting tender of cash payment for the adjusted balance of the purchase price of Lot #9, Tract 4 #7167, Matadero Creek Subdivision and authorizing execution r and delivery of a reconveyance thereof. MATTERS RELATED TO MATADERO CREEK SUBDIVISION: MOTION SECONDED AND CARRIED: Moved by Allison,seconded by Proft and passed unanimously that Resolution #1512 be accepted approving a discount and accepting tender of cash payment for the adjusted balance of the purchase price of Lot #12, Tract #7187, Matadero Creek Subdivision, and authorizing execution and delivery of a reconveyance thereof. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously that Resolution #1513 be accepted approving a discount and accepting tender of cash payment for the adjusted balance of the purchase price of Lot #17, Tract #7187, Matadero Creek Subdivision, and authorizing execution and delivery of a reconvenance thereof. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Proft and passed unanimously that Resolution 41514 be accepted approving a discount and accepting tender of cash payment for the adjusted balance of the purchase price of Lot #10, Tract #7187, Matadero Creek Subdivision, and authorizing execution and delivery of a reconveyance thereof. Mr. Hughes indicated to the City Council Resolution #1515 needed adoption for a previously approved sale on Lot #18, Matadero Creek Subdivision; needing to be formally accepted. MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unanimously to approve Resolution #1515 accepting proposal and ordering sale of real property, directing payment of real estate commission, authorizing execution and delivery of deed concerning Lot #18, Tract #7187, Matadero Creek Subdivision. Ms. Jacque Wolfe, Fox & Carskadon, informed Council an offer has been made for Lot #1, Matadero Creek, all cash offer of $235,000 less 108 for a total of $211,500, to close January 28, 1983. MOTION SECONDED AND PASSED: Moved by Allison, seconded by Proft and passed unanimously to approve Resolution #1516, accepting offer on Lot 41, Matdadero Creek Subdivision Ms. Jacque Wolfe, Fox & Carskadon, informed Council of another offer for Lot #15, noting the asking price is $310,000, the offer is $240,000 with 108 discount, carry financing 508 of purchase price for 3 years at 148, to close within 30 days, contigent to approval of financial statement. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by Hillestad and passed unanimously to direct the City Manager to make a counter offer of $291,400 with 68 discount at 508 down payment, for Lot # 15, Matadero Creek Subdivision. �4w' . NEW BUSINESS: MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Proft and passed unanimously to approve Resolution #1510, appointing Leslie Penfold as Acting City Clerk until January 5, 1983. Councilman Allison requested an update on letters that have been received by the City Council; what further action needs to be taken. A report will be given at a later date. Councilman Allison requested two items be included on the January 5, 1983 Agenda; Cable Television, inlight of what is going on in Los Altos; and Police Protection Report by the Ad Hoc Committee. MOTION SECONDED AND CARRIED: Moved by Allison, seconded by vanTamelen and passed by acclamation to prepare a Resolution for Marty Tarshes for his service as Acting City Manager. D. ADJOURNMENT: MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Allison and passed unanimously to adjourn to Tuesday, December 28, 1982 at 4:OOp.m. for matters related to Matadero Creek Subdivision.
