I, Side I, 001-324 Mayor Nystran called the Regular Meeting of the City Council to order at 7:40 P.M. in the Council Chanbers of Tuan Hall, A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Mayor Nystrom and Councilmsnbers Aillestad and Proft Absent: Councilmanbers McReeynolds and Perkins Staff: City Manager Robert Crowe, city Attorney Frank Gillio, City Engineer/Planner John Carlson and Deputy City Clerk Pat Dowd Press: Florence Pallakoff, Ins Altos Tuan Crier Executive Session - Personnel was postponed to later in the Council Meeting. B. CONSENT CALENDAR: NVrION SECONDED ASID CARRIED: Moved by Hillestad, seconded by Proft and Passed by all menbers Present to approve the Consent Calendar, specifically: 1. Approval of Wsrr nts: $71,831.79 2. Resolutions for Adoption: a) Resolution #1323 camending Richard D. Hayden upon his retirement from tie California Assembly b) Resolm ution #1324 rtnerding Geraldine F. Steinberg upon her retire- ment fran the Board of Supervisors c) Resolution #1325 approving the priority Plan for expenditure of allocation of funds to the County of Santa Clara for park, beach, recreational and historical preservation Purposes Pursuant to the California Parklands Act of 1980- d) Resolution #1326 changing the Wane of Linda lane to Old Page Mill Lane e) Resolution #1327 changing the name of Ruch Lane to Wild Plun Lane 3. Notion for Adoption: Motion approving the Appropriation Lunits Agrem[cnt between the Tann of Ins Altos Hills and the Santa Clara County Library District. (Resolution #1328) C. SPECIAL REPORPS: 1. STAFF -REPORTS, pDRRFSFONDIIICE AM ANNOUNCEMENTS: 1. City Manager: a) City Manager's Report b) Selection of engineering firm The City Manager reported that the City Engineer had reviewed and evaluated the responses from Civil Engineering Consultant firms and Soils and Geologic Consulting firms. The City Engineer recommended and the City Manager con- curred retaining the firm of Nowak and Associates as the Civil Engineering Consultant and Terrasearch Incorporated as the Soils and Geologic Consultant. In response to Mayor Nystran's question as to how these decisions were reached, the City Manager responded that the following were considered: availability, hillside developnent experience, need for expediency, awareness of an environ- mentally sensitive area, familiarity with Town procedunres and Code regulations and cost. Councilman Proft asked. that this item be deferred to the next meeting. He noted that he had just received the background materials and had not had sufficient time to study and evaluate than. Mayor Nystmn noted that time was important and selections of the finis could be made as a matter of policy with final contract approval at the next meeting. �hr Peter Wallace 27975 Via Ventana, addressed the Council and noted that he thought the Palo Alto Unified School District had already Prepared a soils engineering report on the property. The City Manager responded to this noting that while an initial investigation had taken place, the Town required a oinplete report. Mr. Wallace continued expressing the importance of a careful and objective selection of fires. P17TION SEODNDED NO CARRIED: Moved by Hillestad., seconded by Nystrom and passed by the following roll call vote to approve as a matter of policy the considera- tion of contracts with each of the firms, Nowack and Associates and Terrasearch Incorporated, and to refer to the City Attorney for preparation of said contracts for approval by Council at the next meeting. AYES: Mayor Nystrom and COURCi1WCMan Hillestad LADES: Councilman Proft ABSENT: Councilmambers McReynolds and Perkins c) Update on Mefly situation The City Manager reported that a mailing would he going to all Town residents explaining the Town's plan for eradication of the Mediterranean fruit fly. A volunteer progran was being established with assistance from the Town's maintenance craw and bins were being located in three places within the Tom for deposit of fruit. The Tom had also placed Barbara Cordon on the State payroll as volunteer coordinator for the project. Any questions should be 6 addressed to either Barbara Cordon or Pat Webb, Medfly Coordinator. dZ CTry COUNCIL MR02ES - January 7, 1981 STAFF _ REPORTS, CORRESPONDENCE AM (mntinuad) D. 2. City Attorney: a) Report on Saddle Mtn. Estates The City Attorney reported that since the last Council meeting he had been informed that the sale of this property was not going to be completed. HAS ]comes would now be proceeding in terms of the property and whatever work needed to be done. The City Attorney was m working on a revised agreement with the attorney fm BAS tomes and as soon as possible would suhnit a copy of this revised agreement to the Council for their study. At approxdmately 8:00 p.m., Councilman McReynolds arrived. E. SPECIAL ORDERS: 1. Public Hearings: Site Pelmit a) for temuis court/l of p000l/spa51on Filee approval #45 (12169 Padre Court (continued £non 12/17/80 meeting) MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Nystrom and passed by all menbers present to continue lards of dee, Site Development Permit No. 4775 to the next City Council Meeting. b) Ordinance #267 amending Chapter 5 entitled "Zoning" of the Los Altos Hills Municipal Code by amending subsection (b) of Section 4-5.503 concerning walls and fences. (FIRST READING) MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed by all members present to waive further reading of Ordinance #267. The City Manager noted that the Town's Code did not include definitions for screens, barriers, opaque materials. Without such definitions and not kc ing the Planning Cccuauission's intent, he foresaw enforcement problems. It was agreed to introduce the Ordinance and then to send it back to the Planning Comuission for an anendment including such definitions. MOTION SECONDED APED CARRIED: Moved by Proft, seconded by Hillestad and passed by all members present to introduce Ordinance #267 amending Chapter 5 entitled "Zoning" of the Los Altos Hills Municipal Code by amending subsection (b) of Section 9-5.503 concerning walls and fences. C) Request for Tentative Map Approval, LANDS OF BANE, File 7M #6-80 M=ON SFIJDWED AND CARRIED: Moved by Hillestad, seconded by Nystrom and passed by all manbers present to adopt the Negative Declaration, LANDS OF KANE, File TM #6-80. -3- CITY ODUNCIL MURYTFS - January 7, 1981 E. SPECIAL ORDERS: Public Hearing l.c) LANDS OF KANE (continued) Paul Nowack applicant's engineer, spoke to the council noting that the sole purpose of this tentative map request was to assist the applicant in putting his estate in order. He had no intentions of developing in the near future. Mr. Ralph Kane, applicant, noted that on December 23, 1980 he had received a letter of approval from the Health Department concerning the sewage disposal system to Lot 4 (Conditions of Approval 4.13). A copy of this letter had been sent to Town Hall for the files MOTION SEODWED AM CARRIED: Moved by Hillestad, seconded by Nystrom and Passed by all members present to approve Conditional Exception 8.A: A Conditional Exception shall be granted to approve a forty foot (40') right of way and a forty foot (40') bulb. NOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed by all members present to approve the Tentative Map, LAW OF KANE, File FM #6-80, subject to conditions as recammended by the Planning Commission. d) Appeal of Variance and Permit Cemnission denial for LANDS OF BELLUCCI, File VAR #12-80. The City Engineer reported that in a letter dated January 3, 1981 Mr. BellUCCi had requested that the appeal to allow kitchen facilities be dropped. The appeal to allow a permanent resident in the secondary dwelling remained before Council. MDTION SBD3NDED AND CARRIED: Moved by Hillestad, seconded by McReynolds and passed by all members present to deny the variance for LANDS OF BELILUCI, File VAR #12-80. F. GENERAL ORDERS AND UNFINISHED BUSINESS: 1. Request that the Town of Los Altos Hills file a certificate of Compliance, LANDS OF BELLUCCI, File TM #2104-79. Councilman Proft requested that this item be continued to the next meeting. In the meantime he asked staff to prepare background materials including explanation of request, excerpts from code, etc. r4DTION SBaMED AND CARRIED: Moved by Prmo�f�tGC, seconded by Hillestad and Passed by all members present to continue the request that the Town of Ins Altos Hills file a Certificate of Compliance, LANDS OF BELL=, File TM #2104-79 to the next meeting. CITY ODUNCIL MINUTES - January 7, 1981 `m' G. NEW BUSINESS• Mayor Nystrom reported that the Council needed to appoint a metier to the Los Altos Fire District Commission. Councilman Proft was opposed to the Council appointing a member to the Fire District Commission until the Board of Supervisors re -reviewed the Council's request that the CO.,milmembers be appointed as representatives to the Fire District Commission and until they redid their Resolution changing the permissive 'may appoint' to 'shall appoint'. In Councilman Proft's opinion, the Council should participate when their terms were met. Mayor Nystrom and Councilmenbers Hillestad and McReynolds fully agreed with Councilman Pmft's comments but were most concerned that if they did mt appoint a member, the Fire Comission would meet and make decisions with no Town representation on the Commission. A decision should be made as soon as possible, particularly since the Fire Commission had a meeting scheduled for January 15. Councilman McReynolds requested a litigation executive session on thus issue. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Nystrom and passed by the following roll call vote to reoammend to the Hoard of Supervisors that James Nystrom be appointed to the los Altos Fire District Commission. AYES: Mayor Nystrom and Councilmombers Hillestad and McReynolds NDES: Councilman Proft ABSENT: Councilman Perkins The record should show that on the basis on Councilman Proft's moments, Mayor Nystrom and Councilmenbers Hillestad and McReynolds voted for this motion under protest. MDTION SEEDDIDED�AND CARRIED: Moved by McReynolds, seconded by Nystrom and passed by all manbers present to direct the Mayor to send a letter to the Hoard of Supervisors expressing the Council's displeasure at the Board's lack of responsiveness to the needs of the Tann of Los Altos Hills in the area of public safety and proper budget management. The City Council then adjourned to Executive Session for Litigation and Personnel at 8:90 p.m. and reconvened at 9:95 p.m.. H.
