Resolutions for Adoption: a) Resolution # approving and authorizing execution of agreanent for geotechnical engineering services between the City of the Town of Ins Altos Hills and Terrasearch, Inc. b) Resolution #_approving and authorizing execution of an agrembant for geotechnical engineering services between the City of the Town of los Altos Hills and Jo Crosby and Associates Council discussed the proposals submitted by both Terrasearch and Jo Crosby. It was noted that it was the City Engineer's recd mendation with the City Manager's concurrence to retain the firm of Terrasearch, Inc. MOTION SECONDED AMID CARRIED: Moved by Perkins, seconded by Hillestad and passed by the following roll call vote to adopt Resolution #1337 approving and author- izing execution of agreement for geotechnical engineering services between the City of the Town of Los Altos Hills and Terrasearch, Inc. AYES: Mayor Nystrom, Councilmenbers Hillestad, McReynolds and Perkins NOES: Councilman Proft V ABSENT: None C. SPECIAL REPORTS: 1. Reports of Standing Camnittees: none 2. Reports of Ad Hoc Committees: none 3. Reports from the Planning Camdssion: none 9. Presentations from the Floor: Mr. Jack Chown, 13822 Page Mill Road, addressed Council concerning Saddle Mountain Estates. He referred to the January 21, 1981 Council Meeting at which time Council adopted Resolution #1339 accepting certain improvements in connection with Tract No. 6297, Saddle Mountain Estates. Mr. Chown, expressed the opinion that he felt there were still some basic problems which had not been appropriately addressed and he hoped for concrete actions in the future. D. STAFF - REPORTS, CORRESPONDENCE AND N NOINCEV=: 1. City Manager: a) Report on public safety study The City Manager noted that the study was underway, information was being collected and a draft would be ready in two -three weeks time for Council's con- sideration and for submission to IAFCO. It was further noted that the Los Altos County Fire Protection District hal a meeting scheduled for February 19, 1981 at which time a proposed revision to contract with the City of Ins Altos was on the agenda. -2- CITY CDUNCIL NIINUPFS - February 18, 1981 E. SPECIAL ORDERS: Public Hearinqs: a) Ordinance #_amerding Chapter 5 entitled "Zoning" of the Ins Altos Hills Municipal Code by ammending subsection (b) of Section 9-5.503 concerning walls and fences (SB OND READING) MOTION SEODNDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unanvmously to continue this iter to the 3/4/81 Council Meeting. b) Appeal of Planning Cammission approval of Site Development Permit for tennis court/pool/spa, File A #4775, 12169 Padre Court NOTION SEODNDED AND CARRIED: Movedy by Hillestad, seconded by Perkin and passed unanimously to continue this item to the 3/4/81 Council Meeting. c) Resolution # approving ani adopting a path and trail element and amending the General Plan for said City The City Engineer reported that the path and trail element described the basic framework for the development of ron-vehicular traffic within the Planning Area. He further noted the general objectives of the element, the principles, stan- dards and classifications. The City Engineer further reported that both the Planning Ccamissioh and the Pathways Committee reoonnended approval of the path and trail element. Councilman Pmft questioned whether principle #1 and #12 conflicted? The City Engineer responded that #1 was to establish criteria which would be used for existing lots and subdivisions whereas #12 would be to instill a philosophy for nes lots that would not impinge on present lots. Councilman Perkins suggested that parts of the element should be carefully studied grammatically for clarifi- cation purposes and he further suggested continuing this item to the next meeting so that the statement could be carefully gone over. MOTION SEODNDED AND CARRIED: Moved by Hillestad, seconded by McReynolds and passed unanimously to continue this iter to the next meeting so that points of clarification could be inserted in the path and trail element where necessary. d) Appeal of Variance and Permit Cammission denial for IANDS OF SOMIDEF, File VAR #11-80 Assistant Planner Pat Webb reported that on October 22, 1980 the Variance and Permit Commission had considered and denied a variance request for a thirty foot maximum encroachment into the rear yard setback line for a wind screen above the six foot height limit. The applicants returned with a new plan and on December 10, 1980 the Variance and Permit Commission considered a variance request for a 24 foot maximum encroachment into the rear yard setback line for a wind screen to exceed six feet in height. This request was denied because Condition #2 of the Variance Requirements had not been met and there were other alternatives the applicant could take. -3- CITY CDUUIL MITq= - February 18, 1981 E. SPECIAL OIDERS: Public Hearing l.d) Lands of Sokoloff (continued): Norman Sololoff, applicant, addressed the Council and noted that for their information he had distributed a letter dated 2/13/81 stating his reasons why he thought the variance should be granted and to assist in documenting this letter, he had also distributed verbatim minutes of the October 22, 1980 and December 10, 1980 Variance and Permit Commission meetings. Included in these minutes was a transcription of the Laois of Zepp variance request which Dr. Sokoloff had included for comparison. In addition to these docvnents Dr. Sokoloff also read a prepared statement to the Council outlining what steps he had taken, what suggestions he had received from hislandscape architect and what reasons he felt supported the granting of the variance. (These docur merits are on file at Town Hall.) Mrs. Norman Sokoloff, applicant, noted for the Council's information that a six foot fence would provide m wird protection and there was no way to plant an adequate wind screen. Additionally, planting would cause drainage problems. Mr. henry Sumaraga applicant's landscape architect, renirded Council that he had considered all the possibilities for the Sokoloff's property and what was before Council for their consideration was the best solution. Mr. Alan Stewart, 12165 Hilltop Avenue, presented to Council his reasons why this variance should not be granted specifically mentioning his concern for drainage problams. Mrs. Judith CaricoPlanning Cemission Representative, noted the Commission's opinion that other alternativesto granting the variance were possible; namely, planting without the structure (redwood posts); moving the structure within the 30' setback or lowering the height of the structure. Cotscilmanbers discussed the six conditions that needed to be met in order to grant a variance. McReynolds noted that there were other alternatives available and he felt that conditions one, two and three had not been met. Perkins stated that these was a wind problem and the use of the property was strongly affected by this problem. myrION SECONDED AM CARRIED: Moved by Nystrom, seconded by MCReymlds and passed by the following roll call vote to uphold the Variance and Permit Conudssion's denial of the variance request, Lands of Sokoloff, File VAR #11-80, on the basis that conditions one, two and three of the requirauents to grant a variance had not been met (Los Altos Hills Municipal Code, Section 9-5.1107) AYES: Mayor Nystr , Councilmembers Hillestad, McReynolds and Proft NOES: Councilman Perkins -4- CITY COUNCIL MINUPFS - February 18, 1981 E. SPECIAL ORDERS (continued) : 2. Consideration of Alternate Driveway location - LANDS OF RIO;EN, File TM #2095-79 Due to a possible conflict of interest, Councilwoman Hillestad removed herself from consideration of this matter. Mr. Dexter Ahlgren, applicant's encuneer, reported to Council on the alternate driveway location which had a maximun of 208 slope and asked Council to approve with conditions the lard division based upon the alternate driveway location. PASSED BY CONSENSUS: to return this item to staff for a report and comments and to place the item on the 3/4/81 Council Agenda. F. GENERAL ORDERS ADD ONFINISIM BUSINESS: G. NEW BUSINESS• 1. Correspondence from Mrs. Elizabeth Garbett regarding traffic situation at Page All Rural and Paseo del Roble. Mrs. Elizabeth Garbett, 13906 Page Mill Rural, addressed the Council concerning the traffic situation at the intersection of Page Mill Road and Paseo del Roble, t Lot #13, resulting frau the construction of an earth berm. Mrs. Garbett also expressed the opinion of several neighbors that visibility was very poor and the traffic problem was dangerous. Council asked staff to investigate this matter and report back to Council at the next Council meeting. 2. 'Town Newsletter - editorial review policy Councilman Perkins stated his opinion that the Town Newsletter should have a policy statement. Perkins further noted that controversial items, for example, should be in the newsletter only if both sides are expressed and by signed articles. Councilwanan Hillestad suggested that guidelines hal been con- sidered regarding the Newsletter and a policy had been followed. Mary van Tamelen subnitte3 her resignation as editor of the newsletter which the Council accepted and they thanked her for help in this area. MMON SECONDED AND CARRIED: Moved by Perkins, seconded by McReynolds and passed m-,usly to direct the Mayor to ask staff to prepare a policy statement regarding the newsletter. 3. PASSED BY CONSENSUS: to sena a letter to John Carlson, City Engineer/Planner, appointing him project chief for the school district property which the Town recently purchased. H.
