I, Side I, 615 -end; Tr. 1, Side 11, 001-195 Mayor Nystrom called the Regular Meeting of the City Council to order at 7:30 p.m. in the Council Chanbers of Town Hall. A. Approval of Warrants: $23,524.92 Item P�ed: 1. Approval of Minutes : March 4, 1981 Councilman Proft requested that the following correction be made: Page 4, Item E.c), Paragraph #1, the motion sbould be amended to read: "Moved by proft, seconded by Hillestad and passed by the following roll call vote to adopt Resolution #1339 approving and adopting a path and trail element as presented in the City Engineer's staff report dated 2/27/81 as men3ed by Council and merd.ing the General Plan for said City. MOTION SEMNDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unanimously by all members present to approve the minutes of March 4, 1981 as mended. C. SPECIAL REPORTS: 1. Presentations from the Floor: none CITY COUNCIL MINUTES - March 16, 1981 D. STAFF - REPORTS, CORRESPONDUCE AND ANNDtK0,=S: 1. City Manager's Report: The City Manager did not have a report to present to Council. 2. City Attorney: The City Attorney presented to Council a � regarding Willianson Act Contract Cancellations for their stiAy. In view of the � laws, Councilman Perkins asked the City Attorney to also review the alternatives to the Williaason Act. E. SPE= ORDERS: 1. P�esolution #1341 concerning annexation of certain property, IAH 81-1 La Ima. The City Manager noted that this property was contiguous to Los Altos Hills; it met the requirements for annexation and had been approved by LAFCO. Additionally, IAFOD's resolution of approval did not specify my special terms or conditions for the proposed anne�a tion. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Nystrom and passed unaniwously by all members present to adopt Resolution #1341 approving the annexation of certain uninhabited territory designated as IAH 81-1 annexa- tion to the City of the Town of Ios Altos Hills. 2. PD:Iuest for EncroacIment Permit, LAMS OF WIIKINS30N, Tract #2065 The City Manager noted that this request was for a fence and landscaping within the right-of-way of a public street. One of the reasons the applicant had given for requesting this permit was the problem of debris being tossed on the back of his property. Alex Russell, 26618 Ascension Driver addressed the Council on behalf of the applicant. He noted additional reasons why the applicant was making this reqi�t; namely, a fence would help in keeping outside lights frcm shining into his home and would also help keep his dogs on the property. CouncihTembers discussed this item and various points were made. Perkins expressed concern over rights-of-way being transferred to private property; Proft noted that the landscaping might be appropriate but that the fence resulted in less of a feeling of openness. Hillestad, on the other hand, preferred the fence in that it was less permanent and could be taken out at a future time if necessary - the landscaping should be on the applicant's property. MOTION SECONDED AM FAILED: Moved by Perkins , seconded by Nystrom and failed by the following roll call vote to approve encroaclinent penrit, 26343 Esperanza. AYES: Mayor Nystran, Council�an Hillestad NOES: Counci1members Perkins and Proft �4w ABSENr: Councilman McReynolds MOTION SBCDNHED AND CARRIED: Moved by Hillestad, seconded by Nystrcm and passed unanimously by all members present to continue consideration of this item so that the applicant could present his landscaping plans to Council for their review. -2- CITY ODUNCIL MINUTES - March 16, 1981 *4w E. SPECIAL oRDERs (continued): 3. Public Hearings: a) ordinance # mending Chapter 5 entitled "Zoning" of the Los Altos Hills Municipal Code by adding sections 9-5.215(l) and 9-5.231, and by anenJing subsection (b) of Section 9-5-503, respectively, concerning walls and fences (SEODND REMING) MOTION SEODNDED AND CARRIED: Moved by Perkins, seconded by Hillestad and passed un animo usly by all manbers present to waive further reading of Ordinance #267. Councihnanbers expressed various opinions and concerns regarding the ordinance that was before them: 1) the ordinance would be administered with great diffi- calty; 2) existing fences would not be affected; 3) contained too much archi- tectural control; 4) why wasn't it possible to ban certain types of fences?; 5) the possibility of requiring the penuit process to get fencing; 6) clarifi- cation of such terms as "openness" . MOTION SECONDED AND CARRIED: Moved by Nystrom, seconded by Hillestad and passed unanimously by all members present to refer this item back to the Planning Comission for further consideration including the convents made by Council. b) P:esolution �__approving and adopting aTentTents to the General Plan for said City The City Attorney pointed out that it was necessary that a notice be given regarding the negative declaration. Since no action could be taken until this was done, he recomemded that this item be continued to the April 1, 1981 meeting. MOTION SECONDED AM CARRIED: moved by Nyst�, seconded by Proft and passed unanimously by all mextbers present to continue this itm to tha next Council meeting. Although m action could be taken, the following resident asked to address the Council concerning this matter. O%W Peter Wallace, 27975 Vi ana, suggested that the following phrase not be added to the Paragraph Wmntleu "iesidential Unit No. 1": "arid distributed among the residential lots". Mr. Wallace felt this phrase was too restrictive and further noted that no planning had been done to date on low the open space nature of the school property should be distributed. Mr. Wallace was of the opinion that deletion of this phrase would give the Planning Comnission and the council the opportunity of attaining the goal of open space and ruralness. C) Request for Tentative Map Approval, UANDS OF RIGGEN, File TM #2095-79 Due to a possible conflict of interest, oDmcil�on Hillestad rmoved herself from consideration of this matter. -3- CITY COUNCIL MINUTES - March 16, 1981 IAW E. SPECIAL ORDERS: Public Hearing 3.c) Lands of Riggen (continued): The City Engineer presented his report and noted that he and the Planning C�ssion recennended approval of the Negative Declaration. Councilman Proft stated that no new driveway configurations had been presented to Council for their study as had been requested at the last meeting. The concerns he had expressed earlier concerning the driveway had net been addressed. Since this land was now being considered for two lots as opposed to the original one lot, the safety hazard had increased by 100%. The issue at hand was the health, safety and Welfare of the ocamunity and the specifics should be clearly defined by the applicant. Mr. Dexter Ahlgren, �aaljcantls enqineei�, addressed the Council and noted that the concept of the presentation joelore tnem was siq�dficantly new - 25% grade reduaed to 20%. Mr. Cecil Riggen, aalicant, noted that they had expert opinions attesting to the health and safety of tne Plans; the issue had been addressed. Councilman Perkins offered the following observations regarding the property: the possibility of a guard or barrier on lower side of the mad; a different angle where the proposed driveway enters; the entryway slightly more tangent to Chaparral. YACTION SECONDED AM CARRIED: Meved by Proft, seconded by Perkins and passed by the follcwing roll call vote to continue this itm until all the plans are before Council for their consideration. AYES: Councilmanbers Perkins and Proft NOES: Mayor Nyst mm A13SENT: Councilman McReynolds GENERAL ORDERS AND uWFINISHED BUSINESS: 1. Report fmn City IMgirp r concerning traffic situation at Page Mill Road and Paseo del Roble (continued fmn 3/4/81 meeting) The City Engineer presented his report which stated that there was adequate sight distance for the posted speed limit for the left turn into the Garbett driveway. While the berm was not a problem, them was a problem of umain- tained weeds which were on Town property. This problem would be taken care of. The City Engineer did fird, hc�er, that when the property was developed across the street frcm the Garbett's and the driveway was put in, the bem� would have to be modified to provide adequate sight distance. Mrs. Elizabeth Garbett, 13906 Page Mill Ptoad, disagreed with the City Engineer's findings. In her opinion it was a �ardous situation which would only get werse when the bexm was landscaped. Mrs. Garbett further stated that while it was true other sections of Page Mill had visual problems with original land- scaping, this problem was being caused by a betm which the developer had been told to put in. -4- A CITY COLMIL MINJTES - March 16, 1981 F. GENERAL ORDERS AND MINISHED BUSINESS: Item I (continued): PASSED BY CONSENSUS: That the City Engineer would discuss this matter with the developer and see what corrections could be made regarding the berm. G. NEW BLEINESS: 1. Progress Report and Trans�ttal, in response to the IGC charge to the subco�ittea. Councilman Proft asked Council for its opinion concerning the proposed ccnc�ept statement for the proposed inter -agency project referral process. Council did not support nor rec3wRend this process. The cities and the City Managers worked well together without this additional layer of quverrment.
