I, Side I, 001-582 Mayor Proft called the Regular Meeting of the City Council to order at 7:45 p -m. in the council Chanbers of Toa Hall. A. Actions of the planning Coicdssion: recramended granting of the following: a) LAMS OF BETZ, File SA #3-81 Proft asked the City Engineer to explain the location of the new lot line and the interrelationship between the access to Silins property and a future pathway. MOTION SEOJNDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unanimously by all members present to approve LANDS OF BETZ, File SA #3-81. C. SPECIAL REFORPS: 1. Reports of Standing Committees: Fran Stevenson Chairman/Pathway Committee, addressed the Council and expressed her appreciation to Robert Crowe, City Manager, and Dave Flores, Public Works Superintendent, for their assistance in the construction of several bridges in Tuan, namely, Byrne Preserve, Westwird Barn, O'Keefe, Damridge, Arastradero and on Matadero Creek Trail. 2. Reports of Ad Hoc Committees: Hillestad, Chairman of the 25th Anniversary Cannittee, reported on the Town L Parade and Family Fun Day scheduled for Saturday, May 30. Spaces were available in the Parade and anyorne interested should contact Joseph Dochnahl. Also t -shirts were soon going to be available caunenorating the anniversary and would be avail- able at Town Hall. 3. Reports firm the Planning Commission: Commissioner vanr melen reported that the Planning Cammission would soon be suing to Council a new ordinance on development intensity. 4. Presentations from the Floor: Carol Gottlieb 24290 Sumnerhi ll, requested Council's support of the Loyola PTA's request for a continuation of the paved path along Magdalena from Summerhill to the 280 underpass. Their request had been made to the County and they had stresses the importance of this request in relationship to the safety Of their children. PASSED By ODNSErUDS: To direct the Mayor to send a letter to the Board of Super- visors in support of this request from Mrs. Cxttlieb on behalf of the Loyola PTA. Nw -2 CITY MUNCIL MINUTFS - May 20, 1981 L D. STAFF - REPORTS, CORRESPOMENCE AND ANNOUNCEMENTS: �+ 1. City Manager's Report The City Manager added the following item to his report dated 5/20/81: problem of solid waste disposal. Additional funds of up to $60,000 would be needed from Los Altos Hills in order to proceed with the next stage of this program. The City Engineer would prepare a written report for the next Council Meeting explaininc what the money would be used for, how long the funds would last, etc. Proft asked the City Manager to include an update in his next Manager's Report on the traffic situation at Page Mill Road and Paseo del Roble. This matter had been brought to the Council's attention by Mrs. Garbett of 13906 Page Mill Road. The City Engineer noted he had been in touch with Mrs. Garbett and the developer and would present his report at the next meeting. E. SPECIAL 0RDERS: 1. Public Hearing: a) Resolution #___pmviding for cancellation of Williamson Act Contract - I.IMS OF WILSON It should be noted for the record that Councilman Nystrom arrived at 8:35 p.m. during the public hearing on Lards of Wilson - cancellation of Williamson Act Contract. The City Manager gave a brief overview of Mr. Wilson's letter of 4/28/81 in which he explains his reasons for requesting cancellation of his Williamson Act Contract. Additionally, the City Attorney outlined for Council the steps that were necessary prior to cancellation. He further noted in his 5/15/81 mem the rules of the Williamson Act and the Sierra Club Decision concerning the detemmina- tion of whether a cancellation is consistent with the Williamson Act and in the public interest. William Wilson 13816 Page Mill Road, applicant, reiterated for Council the points mtade in his 4/28/81 letter. Basically several agricultural pursuits had been attempted but none had been successful or economically feasible. Mr. Wilson also expressed the opinion that there was no other reasonable agricultural use for the land. Additionally, be stated that he would be willing to work with the Council concerning the matter of 'public interest' and how it might best be served. Denis Hollwedei, izibu Yrisculn i.w,c ..a.�u ••--•• --- - ----- - Laurence Giller 25981 Vinedo Lane John Hettinger, 12372 Priscilla Lane, and Jane Schuller, 15829 Stonebrook each expressed serious concerns regarding this request for cancellation. In their opinion it was setting a precedent. There were twenty-four pieces of property in the Town under the Williamson Act Contract and each owner had been advised of the stipulations of the 10 -year contract. The Williamson Act was important in that it helped maintain the rural character of the Town. Specifically, they questioned what the applicant meant by serving the L 'public interest'. -3- CITY COUNCIL MINUTES - May 20, 1981 t E. SPECIAL ORDERS: Public Hearing l.a) I7NDS OF WILSON (continued): Maurice Sheet=. 27591 Purissima, Melvin Hawley, 13441 Robleda and Jack and the result could be advantageous to the Town. Council had several questions regarding the rules of cancellation with particular emphasis on the aspect of open space. Clarification was needed on law the issue of 'public interest' would be addressed. MOPION SECONDED AM CARRIED: Moved by McReynolds, seconded by Hillestad and passed rmandmously by all members present to send this request for cancellation back to the staff (including the City Attorney) and for the applicant and staff to work together to arrive at the public interest criteria concerning this application. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Nystrom and passed unanimously by all members present to continue the public hearing on Lands of Nilson request for cancellation of Williamson Art Contract to the second meeting in June. F. GENERAL ORDERS AND UNFINISHED BUSINESS: G. NEW BUSINESS: 1. Clarification of Project Manager - Matadero Creek Subdivision 4W MDTION SECDNUED AND FAILED: Moved by Hillestad, seconded by Nystrom and failed by the following roll call vote to continue this iter. AYES: Councilmanbers Hillestad and Nystmn NOES: Mayor Proft and Councilman McReynolds Proft questioned exactly who hal the responsibility of Project Manager for the project and to whrm that person directly reported. Council agreed it was a technicality but should be clarified to avoid future confusion. MOPICN SD_DN)ED AMID CARRIED: Moved by Proft, seconded by McReynolds and passed unanimously by all members present to appoint the City Manager as Project Manager for the Matadero Creek Subdivision and to stipulate that he will report directly to the City Council. 2. PASSED BY CONSEMSUS: Due to several conflicting schedules, Council agreed to hold the second meeting in June on Monday the 15th rather than Wednesday the 17th. -4- CITY COUNCIL MINUTES - May 20, 1981 G. NEW BUSINESS (continued): 3. Public Safety MDTION SENNDED AMID CARRIED: Moved by McReynolds, seconded by Nystrom and passed by the following roll call vote to adopt Resolution #1354 creating a public safety department for the City of the Town of los Altos Hills and establishing the date for its activation. x AYES: Councilmembers Hillestad, McReynolds and Nystrom NOES: Mayor Proft ABSENT: Councilman Perkins MFITION SECONE D AMID CARRIED: Moved by McReynolds, seconded by Nystrom and passed by the following roll call vote to instruct the City Manager to recruit a Director for the Public Safety Department. AYES: Councilmambers Hillestad, McReynolds and Nystrom NOES: Mayor Proft ABSENT: Councilman Perkins MDTION SECONDED AND CARRIED: Moved by McReynolds, seconded by Nystrom and passed by the following roll call vote to instruct the City Manager to prepare guidelines, qualifications and a recommended salary structure for the position of Director of Public Safety and return this information to Council for their consideration. kw AYES: Counciln*nbers Hillestad, McReynolds and Nystrom NOES: Mayor Proft ABSENT: Councilman Perkins 4. 1981-82 Budget The City Manager advised Council that he would have the 1981-82 budget done by approximately May 29. When this was accomplished Council would then schedule budget sessions to study the proposed budget. 5. Town Newsletter Hillestad complimented staff on the May 1981 Newsletter. H.
