MINUTES OF A REGULAR MEETING
Wednesday, October 7, 1981

Mayor Proft called the Regular Meeting of the City Council to order at 7:30 p.m.
in the Council Chambers of Town Hall.
A. POLL CALL APED PLEDGE OF ALLEGIANCE:
Present: Mayor Proft, Councilmembers Hillestad, McReynolds and Nystrom
Absent: Councilman Perkins

B. CONSENT CALENDAR:

MOTION SECONDED AMID CARRIED: Moved by Nystrom, seconded by Hillestad and
passed unanimously by all members present to approve the balance of the
Consent Calendar, specifically:
2. Approval of Warrants: $ 30,494.74 (9/16/81)
$140,721.14 (10/7/81)
3. Actions of the Planning Commission: recommended granting of the following:
a) LANDS OF WALLACE, File VAR #2-81
Item Removed:
1. Approval of Minutes: September 2, 1981
Proft had received a phone call from Mildred Gallo requesting clarification of
her comments on page two of the minutes concerning Item 5.b)- He, therefore,
asked that the minutes be amended to read as follow: Page 2, Item 5b), Paragraph
#2 -- 'Mildred Gallo, 25720 Lalanne Court, addressed the council regarding curb-
side pickup and expressed her opposition to the clean-up days scheduled for
the fall and spring.'
MOTION SECONDED APED CARRIED: Moved by Proft, seconded by Hillestad and passed
unanimously by all members present to approve the minutes of September 2, 1981
as amended.

Hillestad congratulated the 251 Anniversary Committee and particularly
Nancy Couperus for a very successful 'Day at Westwind' on October 4, 1981 -
the final event of the Anniversary Celebration.
3. Reports of the Planning Commission: none

STAFF -REPORTS, OORRESPONDENCE AMAN UNCENIF.'NTS:
1. City Manages:
a) Arastradero Road - Tree Situation
The City Manager reported that the trees were being removed.
It was discovered
that along this property there was a 30' easement as opposed to a 20' easement;
therefore, the trees were the Town's property. The residents who had been
notified of the tree situation would be advised that it was the Town's respon-
sibility.
b) Status Report - Matadero Creek Subdivision
1_ Schedule Update
The City Manager reported that the Matadero Creek Subdivision Project was
currently on schedule.
2. Declaration of Restrictions (CC&Rs)
Council and staff discussed the declaration imposing conditions, covenants
restrictions, easements and agreements for the Matadero Creek Subdivision.
The City Planner noted that it was the staff's recommendation that regarding
an Architectural Commit a five member committee be established and Pro-
vision be made for transferring control of this committee ec the datiOsubdivnxswaasn

The discussion resulted in the following changes and/or additions to the CC&Rs:
1) Clause 12 to address the issue of lighting; 2) Clause 13 to include a pro-
vision for the parking of construction vehicles during development of said
subdivision and 3) Clause 17(b) be changed to include a five -i Knber Architec-
tural Control Committee, appointed by the City Council fora specific period
of time. It was agreed the City Attorney would Prepare the appropriate legal
language for these changes, sutinit them to the Council for approval and include
then in the CC&Rs.

"Declaration imposing conditions, covenants, restrictions, easements and agree-
ments upon Tract No. 7187, entitled "Matadero Creek Subdivision" and authorizing
execution thereof, and the recordation thereof .°

1. City Manager:
c) Report on LAFCO application
The City Manager reported that as a result of the unanimous Council notion
to pursue the application to LAFCO for withdrawal from the Los Altos Fire
Protection District, a public hearing had been scheduled for October 14, 1981
and various materials had been submitted to LAFCO. The City Manager further
reported that he and Gordon Tenfold, the Director of Public Safety,
had with LAFco staff earlier in the week. They were infoxned that the staff's
reeom,endation to LAFCO would be to adopt a resolution of intent allowing Los
Altos Hills to withdraw frau the District and also directing the LAFCO staff
to work with the Town and the District regarding the dissolution of assets, etc.

PASSED By CONSENSUS: To direct the Mayor to write a letter to Paul Sagers
clarifying the Town's position that the suggested methods of solving the problems
are not meant to be exclusive; each item is open to negotiation between all con-
cerned parties.
2. City Attorney:
The City Attorney referred to his meso to the Council dated 10/5/81 which
stated that the litigation between David Bellucci and the Tuan had been
terminated.
SPECIAL ORDERS:
1. Ordinance #271 amending subsection (a) of Section 3-1.111 of Article 1
of Chapter 1 entitled "Business Licenses" of Title 3 of the Los Altos
Hills Municipal Code.

Ins Altos Library Commission - request for funding
Barbara Canpobell County Librarian, addressed the Council and referred to her
nano of August 31, 1981 in which she reported that the Board of Supervisors
had aporoved a percentage match for the unincorporated area to any contribu-
tions from the cities to help with the 1981-82 deficit. 8As a result the
amount they were now requesting from the Tam was $5,92
Council discussed this action by the Board of Supervisors. Proft noted that
while he would agree to support the library this year, in the future he would
not contribute support to a project which, in his opinion, the county was not
also adequately supporting.
NOTION SECONDED AMID CARRIED: moved by Hillestad, seconded by McReynolds and
passed unanimously by all members present to appropriate $5,982 frau the General
Fund unappropriated fund balance in support of the Los Altos Library Oa ission.
Moody Road - loose monuments
Proft asked for a status report on the loose MOnMents along sections of Moody
Road. He expressed concern as it was a potentially dangerous situation. The
City Manaaer asked for suggestions on haw to solve this problem and it was
reca ded that he try a rubber sealer (RTV). The City Manager said he would
report back to Council on this matter.
Traffic Situation at Page Mill Road and Paseo del Roble
In response to a request for a status report from the Mayor, the City Manager
responded that the trees had been tri d and there was no longer a site problem
in this area. A letter would be sent to Mrs_ Elizabeth Garbett stating the
staff's opinion on this matter.

On September 30, 1981 the City Manager and

F. GENERAL ORDERS AMID UNFINISHED BUSINESS (continued):
5. City Manager's Reports
PASSED BY CONSENSUS: Council requested the City Manager to follow the
procedure of including a City Manager's report with the Council agenda
packets.
G. NEW BUSINESS:
1. LANDS OF WILSON - Request for Certificate of CoRpliance
Staff reported that this request was a formality; the title early required
a certificate of compliance to issue insurance on both of the Wilson's pieces
of property.
MOTION SECONDED AMID CARRIED: Moved by Hillestad, seconded by Nystrom and
passed unanimously by all members present to approve the request for a
Certificate of Conpliance for the LANDS OF WILSON, 13816 and 13720 Page Mill Rd.
H. ADJOURNMENT:
There being no further new or old business to discuss, the City Council
adjourned at 8:45 p.m.
