A. ROLL CALL AND PLEDGE OF ALLEGLANCE: Present: Mayor Pro Ten Proft, Councilmembers Nystrom and Perkins Absent: Mayor McReynolds and Councilwoman Hillestad Staff: City Manager Imbert Crowe, City Attorney Frank Gillio, City Engineer/ Planner John Carlson, Planning Ccnudssion Representative Michael Stewart, Deputy City Clerk Pat Dowd Press: Florence Pallakwff, IDs Altos Tw n Crier; Richard Harmer, Peninsula Times Tribune Items Re cved: B.1, B.3 a) and B.4. a) (Perkins) MOTION SECONDED AND CARRIED: Moved by Nystrom, seconded by Proft and passed unanimously by all members present to approve balance of Consent Calendar, specifically: 2. Approval of Warrants: $26,738.01 Removed Items: 1. Approval of Minutes: February 20, 1980 NOTION SECONDED AMID CARRIED: Moved by Nystrom, secorded by Perkins and passed unanimously by all members present to approve the Minutes of February 20, 1980 amended as follows: Page 2, Item B.4.b), first paragraph should read, . . . . Therefore, the City Manager arxI the City Attorney agreed it was appropriate to refer the matter to the Site Development Cannittee. 3. Actions of the Variance & Permit Commission - reo�mended granting of the following: a) LANDS OF CLARK, File SA #1-80 R i CITY COUNCIL MINUTES - March 5, 1980 B. CONSENT CALENDAR - Items Removed - 3.a) LANDS OF CLARK (continued) MK7TION SECONDED AM CARRIED: Moved by Perkins, seconded by Nystrom an] passed unanimously by all members present to stipulate that the approval of Site Approval with conditions, LANDS OF CLARK, File #SA 1-80, cp to Site Development and the final parcel map be filed prior to issuance of any permits. 4. Resolutions for Adoption: a) Resolution # opposing any attempt by the California Air Resources Board to change the Air Quality Planning Designation in the Bay Area. MOTION SECONDED AND CARRIED; Moved by Perkins, seconded by Nystrom and passed unanimously by all members present to continue this item to the next Council meeting and for the Mayor to appoint someone to look into it and report back to the Council. Mayor Pro Ten Proft turned the meeting over to Mayor McReynolds. C. SPECIAL REPO=: 1. Reports of Standing Committees: none 2. Reports of Ad Hoc Comittees: none 3. Reports from the Planning Commission: fir Planning Commissioner Stewart reported that at the last Planning Commission meeting a request had been made to recommend an ordinance to the Council in reference to prezoning of four islands within the Town. As the Planning Camission did net have proper background information on this item and there were several questions from the public, the item was continued to the next Planning Comadssion meeting. Mr. Stewart requested the City Manager and the City Attorney be present to provide additional information. 4. Presentations frau the Floor: none D. STAFF - REPORT'S, CIORRESPONDENCE & ANNOUNCEMEIM 1. City Manager a) Report on request for time extension, LANDS OF REISER, File PM #349 M 21 (continued from 12/5/79 meeting). The City Manages reported that the basic requirement for the area was to keep it as natural as possible. Therefore, there was no problem with Mr. Reiser's request for deletion of certain required improvements or for a time extension to install the subdivision improvements. The City Manages did caution, however, that when the lots were later sold, the new owners may wonder why the improvements weren't made. ( -2 CITY ODUNCIL MffNOTFS - March 5, 1980 D. STAFF - l.a) LANDS OF RFSSER, File AM #349 M 21 (continued): Mr. Reiser, applicant, supported his request for the following modifications: 1) Delete the requirement to gravel the emergency access road; 2) delete require- ment for double seal mat; 3) reduce red rock road from 14' width to 12' width; and 4) delete asphalt berms on red rock mad. In response to a conment from Mr. Perkins regarding the 'Maintenance Agreement' and the fact that new owners would be aware of what kind of a situation they were entering into, the City Attorney confirmed that if the requirements were chanced, a new agreement would be made. This would also include the amount of the bonds for improvement bring realistic, i.e. increasing or decreasing depending on the changes made or not made. MOTION SECONDED AMID CARRIED: Moved by McReynolds, seconded by Nystrom and passed unanimously by all members present to delete the requirement to improve the emergency access road but not delete any requirements for an easement. MOTION SEODNDED AMID CARRIED: Moved by Perkins, seconded by McReynolds and passed unanimously by all members present that Dr. Perkins will go out and look at the Reiser property and report back to the Council with a reanmen- dation, preferably by the next Council meeting. b) Agreement with the firm of Harris, Kerr, Forster & Co. to begin Phase I of the feasibility study regarding Adobe Creek site. The City Manager reported that subsequent to the Council's action at the last meeting he had become aware of a document which had originally been prepared for another organization and which had quite a bit of this information already developed. MOTION SBOONDED AMID CARRIED: Moved by McReynolds, seconded by Nystrom and passed by the following roll call vote to continue this agreement item until the material on hard can be evaluated and then prepare a different agreement, if it's necessary. MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Nystrom and passed una m+usly by all members present to adopt a Negative Declaration, LANDS OF ENGLISH MF.PD(74S, File TM #2103-79. l -3- CITY ODUNCIL MINUTES - March 5, 1980 E. SPECIAL ORDERS: Public Hearings - LANDS OF ENGLISH MEADOWS (continued): Mrs. Gottlieb, Chairman/Pathways Ca mittee explained to the Council where the Camdttee was rewmmerding pathrays. Due to the heavy traffic on Page Mill, Mrs. Cottlieb stressed the critical importance of a good pathway system being developed. It was also noted that included in this request was the construction of three bridges which the Planning CaTndssion had recommended be done at the Town's expense. Mayor McReynolds firmly stated that the Town would not pick up the cost of constructing these bridges and suggested that the pathways be better designed so the need for bridges is minimized. Coumcilmembers expressed a variety of concerns regarding this Tentative Map which included the following: 1) subsurface drainage and how it should be included in the Conditions of Approval; 2) pathways not clearly defined - shnuld be a prominent part of the Tentative Map, 3) flaw line condition needs to be included, 4) clearer definition of easements and lot lines, 5) the removal of the buildings. presently on the land should be made a part of the subdivision agreement, 6) the wording, dates and numbers on the Conditions of Approval should be corrected for accurate reference, and 7) official slope density calculations need to be recorded. Mr. Al Nbolworth, developer, supported his application for approval of the Tentative Map. Mr. Fbolworth noted that he had worked with the Planning t Commission and the Pathways Committee to arrive at satisfactory plans; he now requested that Councidmmlbers walk the lard and see for themselves. M72ION SEOOMIDED APED CARRIED: Moved by Nystrom, seconded by Proft and passed by all members present to add as new Condition 1.D (iv): The owner shall provide a right of entry and dedicate a 10' storm drain easement adjacent to the pathway easement along the southerly boundary of the subdivision. NATION SENDIDED AID CARRIED: Moved by Proft, seconded by Nystrom and passed by all members present to amend Condition 9.A. to read: The name of the street will be Baleri Ranch Road and the name of the subdivision will be Baleri Ranch Subdivision. MOTION SECONDED APED CARRIED: Moved by Nystrom, seconded by Proft and passed unanimously by all members present to continue this item to the next Council meeting. NEW BUSINESS• The City Attorney's memo regarding barking dog complaints - continued to next mtg. Abandonment of Lowell Avenue - no action by Council necessary at this time. Letter from the Palo Alto School District regarding the acquisition of school sites. The City Manager reported that now this was an informational item only. The Town developments. Mayor an interest in the property and asked to be kept informed of developmen ..:. Mayor McReynolds, speaking as a member of the Transportation Commission, reported on a hill before the senate which would provide for an independent transit dis- trict board - not one subordinated to the County Board of Supervisors. He urged Council to support this bill and to discuss it at the next ICC Meeting. Mr. Proft referred to the City Manager's Report which stated, in part, that the City of Palo Alto had allowed Stanford to relocate the overhead facilities along Arastradero to the Los Altos Hills side of the street but still in Palo Alto city limits. The City Attorney stated that since it was within their city limits, our only recourse was a letter of protest. =ON SECONDED AMID CARRIED: Moved by Nystrom, seconded by Proft and passed unanimously by all members present to send a strong letter recounting all the details and protesting this action to the Mayor of Palo Alto from Mayor McReynolds. Mr. Proft asked for an update on the Rancho Murietta Subdivision. The City Manager reported that an on-site meeting had taken place including the City Manager, City Engineer and the Soils Engineer and that another meeting was going to be scheduled including the subdivider. Dr. Perkins asked about the storm drainage on 11511 Summitwood Road. The City Engineer reported that there is a problem due to a lack of plans but he has been in communication with the owner.
