A. Approval of Minutes: March 5, 1980 3. Resolution for Adoption; a) Resolution #1269 setting April 2, 1980 as the Public Hearing date for Pre -Zoning of Unincorporated Areas. 4. Time Extension Requests: a) Request for extension to Nlovember 1, 1981 for filing of final map, LANDS OF IOW, File #TM 2088-78 P�ed Items : 2. Approval of Warrants: $21,385.69 Council�maxl Hillestad pointed out that there were two different registration fees shcwn for ABAG. It was noted that each fee should be $20 and the warrant list was adjusted to correct the $5.00 error. $be CITY COUCIL MINUTES - March 19, 1980 4W B. CONSENT C.A�DAR - Items Removed - 2. Approval of Warrants (continued): MOTION SBCOhDED AND CARRIEDi Moved by Hilleatad, seconded by Perkins and passed unanimously by all members present to approve the Warrant Idst as corrected, $21,380.69. Actions of the Variance and Permit Commission - recmwended granting of the following variance application: a) LAIMS OF CHENG, File VAR #2-80 CDuncihiembers discussed Dr. Cheng's request for a variance for a solar panel system. Mayor McReynolds questioned why the solar panels could not be on the roof and also if there was a tr�ue question of hardship in this request. The City Manager reported that he had just received a letter from Dr. Cheng which the Council had net had the opportunity to consider. MNION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to continue this item to the next meeting and at that time have an explanation of why the installation is on some kind of structures and can not be incorporated into the roof structure. 6. Resolution for Adoption: a) Resolution kopposing any attenpt by the California Air Resources Board to change the Air Quality Planning Designation in the Bay Area. 4W Hilleatad felt that there was no constructive reason for co -designation and remarked that as a local goverrment a stand should be taken on this issue. Hillestad moved that the resolution be adopted but there was no second to the motion. Perkins stated that Council should respect the position of ARB in their responsibility for meeting the requirements in preparation of the State Impl�ntation Plan and it was up to them to designate such lead agencies as they saw fit. McReynolds noted that t1iis was a highly technical matter which was becoming even more cmplicated as political issil� became involved. Reports of Standing Comnitte a) Pat1ways Committee Mrs. Carol Ciottlieb, Chairman/Pat1ways Committee reported that Ron Shibuya had conpleted his Eagle Scout Project and that 24 signposts were in place and 6 more had been branded. Mrs. Gottlieb asked the Mayor to send letters of thanks to Ron, his father and the other smuts who worked on the project of marking the trails. -2- CITY COUqCIL MINUTES - March 19, 1980 SPECIAL REPORTS (continued): 2. Reports of Ad Hoc Committees: none 3. Reports frcm the Planning Commission: Planning Commissioner Lachenbruch extended the invitation to CouncilmoTbers to attend the Planning Commission mee�tings. He felt this would contribute to better lines of communication between the Commission and the Council. Presentations from the Floor: none vv I I , D ID I City Attorney: a) Agreement with the firn of Harris, Kerr, Forster & Go. regarding Adobe C�k Site The City Attorney reported that the services being provided by Harris, Kearr, Forster & Go. would not be a duplication of an earLier report on the Adobe property that the Town had received. The earlier report was incomplete and lacking in information the Town needed. In response to a question reqarding costs, the City Attorney noted that any expenses incurred under Item 4 of the Agreement could be cleared first with the City Manager, if Council so wished to add this stipulation. MOTION SEMMED AM CARRIED: Moved by Perkins, seconded by Proft and passed OW unani�ously by all members present to adopt Resolution #1270 approving and authorizing em�ution of an agreement for financial consultant services between the City of the Town of Los Altos Hills and Harris, Karr, Ferster arri Ccmpae�y including clarification of additional expenses. On the subject of Adobe Creek, Mayor McReynolds asked the City Manager to formally contact prior members of the Club soliciting their interest in writing. Regarding the possible foreclosure of part of the land, the City Attorney reported that presently there was a temporary restraining order against tl-ds foreclosure and the hearing on this case had been postponed to mid-April. McReynolds asked that a report on Adobe Creek be put on the next Council agenda so that Councilmembers will be kept up-to-date on tl-ds issue. The City Attorney reported on a case presently pending in appellate court, namely, the Bownds Case which concerns the State Housing Guidelines. The Department of Housing considers these guidelines mandatory while the cities consider t1on as guidelines - the discretion up to the local agencies. If upheld as mandatory, this would be a severe blow to home rule. The housing quideline will be the test wli-Lher local goverrments have control over their zoning. The firm of Rutan & Tucker is representing the cities in this case and has asked for support from as many cities as possible. AW -3- CITY COLZrIL MINUTES - March 19, 1980 D. STAFF - REPORTS, CORRESPONDENCE & AU4011iCEMITS 1. City Attorney (continued) Mayor McReynolds proposed a resolution encouraging mties to go to the State Legislature to dissolve the State Housing Autbority as an economy measure particularly in light of Proposition 9. The City Attorney will write this resolution and it will be presented at a later meeting. 2. Councilman Perkins a) LANDS OF REISER, File PM #349 M 21, request for time extension an-] improvement modifications (continued from 3/5/80 meeting) Councilman Perkins reported that Mr. Reiser has a dream - he wants to sub- divide his property and maintain the rural environTent. One of the problems is that the dream and the improvement plan don't mesh; however, the basic Problem is that the improvement plan and the Corditions of Approval need to be reviewed. MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to grant a time extension to Dacauber 31, 1980 to complete the subdivision improvements. MOTION SECONDED AND CARRIED: Moved by Perkins , seconded by Proft and passed unanimously by all members present to have Mr. Reiser, his engineer and the Town Engineer go over Mr. Reiser's letter dated 11/12/79, the Conditions of Approval and the mprovement plan before the end of October, 1980. 4W E. SPECIAL ORDERS: ILE 1. Public Hearing: (continued from 3/5/80 meeting) a) Request for Tentative Map Approval, LANDS OF BALERI RAkUH (formerly English Meadows), File TM #2103-79 Mrs. Carol Cbttlieb, Chairman/Patlways Committee asked for an explanation of exactly where the pathways were on the new map. She furtl,,-x explained Patlways Committee original request. and reported on which paths now being considered would be acceptable to the Pathways Cowmittee. John Lynch, applicant's engi , explained the pathways systems being presented. Mr. Al TAboluorth, applicant supported Ids request for Tentative Map approval. Mrs. Hubbard, La Ioma Drive, stated that the path#ays werc� not clear to her and she asked for clarification. Mr. Dougherty, St. FranMS Drive, and Larry Faber of Palo Alto both expressed com� about the use of ramps, particularly from a safety viewpoint. Mr. Couperus , Page Mill Pload, stated that the idea of remps appealed to him but he did point out several—pmblems with the use of ramps. -4- CITY ODUNCIL MINUTES - March 19, 1980 E. SPECIAL ORDERS: l.a) LANDS OF BALERI RANCH (continued) CouncihTmbers unanmously agreed that the rmp concept was not acceptable and also agreed that the Town was not going to pay to have any bridges built. Council then made the following corrections and/or additiom to the Conditions of Approval: Condition l.B.(i) amended to read: . . . . . . . A wire fence shall be permitted in the open space -conservation easenent area on Lots 8, 9, 10, 1 and 2 where there is a public patluay. Condition l.D. (i) mended to read: along the northaest property line of lot 3 adjacent to Lot 2 within the sanitary sewer easement required in Condition l.C. The path ease�ent shall be for pedestrian purposes only. Condition I.D.(iii) mended to read: along the east side of Mataderc, Creek within the open space conservation easemant of Lots 8, 9, 10, 1 and 2 as required in Corrliton 1.B and shown on the Tentative Map dated "Revised, March 13, 1980" for the Baleri Ranch Subdivision and connecting to the bridge required in Condition 6.B at the southwest corner of Lot 8. Condition 6.A. mended to read: A Type 1A path shall be installed within the pathway easement along Lots 8,9, 10, 1 and 2. Condition 6.B. mended to read: Pedestrian and equestrian bridge shall be can- structed across Matadero Creek at the southwest corner of Lot 8 to the specifica- tions of the City Engineer. 40 Condition 9.D added; The finished floor elevations of all residences shall be 8' higher than the flow line of the creek, as shown on skeet 4 of the revised map dated March 14, 1980. Resolution #1271 apprcving Final Subdivision Map, LANDS OF GIGLI, File FM #3079-79, Tract 6763 The Historical Society suhnitted a letter requesting that the nme be changed frcm Gigli to Iockh=d Lane. Council considered this request ca fully but felt that it had been received too late at this request for final map approval and the name should stay Gigli. MOTION SBCDNDED AM CARRIED: Moved by Hillestad, seconded by Perkins and passed unan�mo usly by all members present to adopt Resolution #1271 approving final subdivision map of the Lards of Gigli and appxcving and authorizing execution of subdivision agreement. MIZ CITY OXMIL bUNUrES - March 19, 1980 F. GENERAL ORDERS AND =NISHED BLISIMISS: M�. Hillestad noted that if improvements were made at the corner of IS280 and Page Mill, even more cars would be able to park there. The City Encp-near reported that the Town had already been contacted regarding this matter and the Town had asked to see all the plans , including landscaping. Mrs. Hillestad remarked that she had received several requests about where to take recycling materials. She suggested we call Mr. Bob Wenz1au who gives a talk "Is there gold in your gax�bage?" and try to arrange a presentation at one of the Council meetings. Dr. Perkins discussed the problem of chuckholes and how they are repaired. The City Manager reported that if the Town is advised of the problem, they will repair it; however, there is no mechanism for repairing all of then in Town. G. NEW BLERESS: Standing cenmittee Vacancies: Since the Ncwsletter will be going out within the next two weeks, it was decided to place an article about these vacancies in the issue. Thus, this item was continued until, hopefully, all the vacancies could be filled at one time. Town's 25th Anniversary - 1981 - Plans Council appointed the Historical Society in charge of the plans for the 25th 4W Anniversary celebration. Mirs. Hillestad will act as liaison between the Council and the Historical Society. �W 3. B= Dedication The City Manajer reported that on April 19, 1980 in conjunction with the opening of Little League Season, the multi-purpose Barn will be officially dedicated. The City Council then adjourned to Executive Session for Personnel at 10:50 p.m. and reconvened at 11:20 p.m. There being ne further new or old business to discuss, the City Council adjo urn ed at 11:20 p.m. M Respectfully sikmitted .
