CONSENT CALENDAR: Itans P�ed: B. 2 (Hillestad) , B. 3a) , B. 4a) and B. 4b) (Perkins) MOrION SECONDED AM CARRIED: Moved by Proft, seconded by Nyst= and passed unan�mously to approve balance of Consent Calendar, specifically: 1. Approval of minutes: March 19, 1980 3. Actions of the Variance and Penult Camiission - re�ended granting of the following variance applications: b) LANDS OF MARER, File VAR #3-80 P�Mved Items: 2. Approval of Warrants: $35,084 Oouncil�woman Hillestad pointed out that there were two exact charges for Nunes Turfgrass. The City Manager =firmed that there had been two exact orders for sod grass for the Little League fields. Actions of the Variance and Permit Comission - reccumended granting of the following variance applications: a) IAMS OF CHENG, File VAR #2-80 (continued from 3/19 meting) Dr. Chong, applicant, supported his request for a variance for solar panels. tie explainect why he felt that of the 10 panels planned no more than two could be placed on the roof. He furtter noted that he had consulted his neighbors and they were in favor of his solar panels as planned. (buncalmembers discussed why more of the panels could not be placed on the roof. If that were the case, then a variance would not be needed. It was also noted that according to state law certain requirements needed to be met for variances. Thus, variance requests needed to be quite seriously considered. This was the first variance request for solar� panels; therefore, an important consideration for future policy. MOTION SEODNDED AND CAMIED: Moved by Perkins, seconded by Pmft and passed by the following roll call vote to continue this item to the next meeting with the Mayor designating one or two councilmembers to look at the property so that the issue can be clearly unlerstood. AYES: Mayor McReynolds, Councilmembers Hillestad, Perkins ard Proft MES: Councilman Nystrom 4W It was pointed out to Dr. Cheng that the next Council meting would be at 5:00 p.m. on Tuesday, April 15 so that he could schedule being there. 4. P�esolutions for Adoption: a) Resolution #1272 setting May 7, 1980 as the Public Hearing date for the Pxe-Zoning of Unincorporated Areas of Altamnt Circle and Casa Mia Way - Councilmen Perkins questioned why these areas were being prezoned. The City Manaqer reported that it was part of the process leading toward the eventual possibility of annexation. First, spheres of influence were established, then put into urban service areas and then prezoninq. All areas being considered were in our urban ser�vice areas. Councilman Perkins still expressed co� over several questions: what benefit was this to the Town? was it necessary? MOTION SECDNDED AM CAMUED: Moved by McReynolds, seconded by Nystrom and passed by the following roll call vote to schedule the public hearing on this prezoning. Concerns and questions will be brought to the attention of the City Manager ahead of time and he will address them at the publ�c hearing. AYES: Mayor McReynolds, Councilmembezz Hillestad, Nystrom and Proft WES: Councilman Perkins; PASSED BY ODIZENSLU: To schedule this Public Hearing at the next regular City Cbuncil metinQ to be held on May 7, 1980. Presentations frcm the Floor: Mrs. Patricia Larin, 12720 Dianne Drive, read a letter to the council explaining the storm drainage easement problEms they were having. It was decided that Staff would look at the site and determine if it was the Town's responsibility. A report would be presented at the next Council meeting. Mrs. Carico, Planning Cm�mission Representative, noted that many holding tanks were being built in the Hills for diesel f�uel. She asked if any safety precau- tions were being taken? The City Manaqer reported that permits were required and they were put in under the supervision of the Fire Department. Mrs. Marilyn Curtis, 12838 Concepcion, reported on the serious problems at her home being caused by the creek. The staff has looked at this problem before but it was agreed that they would not only look at the present problem but also research the background of the problem and report at the next meeting. 1. City Manager a) Report on Adobe Creek The City Manager reported that he had received Preliminary information from the firm of Harris, Kerr, Forster & 00. and that they hoped to have a draft report for the next Council meeting. The questionaire to previous members will be sent out in the near future. The City Council then adjourned to Executive Session for Litigation at 8:35 p.m. and reconvened at 9:55 p.m. E. SPECIAL ORDERS 1. Public Hearing: a) Ordinance #261 mending Section 9-5.303 of Chapter 5 of Title 9 of the Los Altos Hills Municipal Code by providing for the prezoning of certain property. (FIRST READING). SPECIAL ORDERS Publ-ic Hearing - Ordinance #261 (continued) �W MOTION SECONDED AM CARRIED: Moved by Nystrom, seconded by PerRins and passed unanimously to waive furtl�er reading of Ordinance #261. The City Manager reported that the imanoorporated areas were within our urban service areas. He also noted that annexation of these unincorporated areas that were contiguous to the Tbwn was a possibility. Several reasons would support this action: development should take place in cities not in the counties; first by prezoning then by annexation, them would be more control ever development and the revenue received would offset the expense of residents using the Town's services but paying tleir taxes to the county. Before any hearings on annexation, however, complete backgrotmd information and reports would be made available for study. WTION SEMMED AM CARRIED: Moved by Nystrom, seconded by Hillestad and passed unanimously to introdice Ordinance #261 �nding Section 9-5.303 of Chapter 5 of Title 9 of the Los Altos Hills Municipal Code by providing for the prezoning of certain property. F. GENERAL ORDERS A1,JD =NISHED BUSINESS: The City Manager introduced a resolution autherizing the filing of an application with the Metropolitan Transportation Ocimnssion for allocation of Transportation Development Act Funds for fiscal year 1960-81. This would enable Los Altos Hills to participate in the VANTRANS progrm with Mountain View and Ios Altos. There were state furds available strictly for transportation; there would be no cost to the Town, although a slight cost to the participants. The progran would be operated by the Mountain View Community Services. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Perkins and passed unanimously to adopt Resolution #1273 authorizing the filing of an application with the Metropolitan Transportation Cormission for allocation of Transportation Development Act Funds for fiscal year 1980-81. Item B.4b): removed from Consent Calendar to New Business: Resolution #1274 urging the State Legislature to teiminate the e-Kistence of the Department of Housing ard Oomunity Developnent. Geouncilman Perkins questioned what was hoped to be accomplished by this resolution perhaps this agency has done some good. He was concerned that this approach might be counterproductive. Mayor McReynolds reported that he had found no support for this agency in the cities he was in contact with. It was counterproductive; an extreme duplication of efforts and it also assuTed a legal position in the State that it did net have.
