Mayor Nystrom called the Regular Meeting of the City Council to order at 7:35 p.m.
in the Oouncil Chanbers of Town Hall.

passed unanimously to approve the Minutes of April 15, 1980 anerde3 as follows:
Page 1, Item A., last paragraph should real, . . . Councilmonbers Lucile Hillesta3,
Willian Perkins and David Proft. . . .Page 2, Item B.5, second sentence of point
1 should read, "It is necessary that these trees mature to minimize existing wird
problams."; Point 4 should read, "The panels have to be raised to avoid shadow
line of the garage; and Point 5 should read, . . .therefore, since the panels
must be raised as described in Item 4 the present need for parking can be conn
4w tined. Page 5, Item G. c) both motions should be recorded as moved by Nystmn,
seconded by Perkins.

MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed
unanimously granting a time extension to June 30, 1980 for Planning Coamission
consideration of the LANDS OF TBOMPSON, File 7M #4-80.
C. SPECIAL REPORTS:
1. Reports of Standing Committees:
a) Traffic & Public Safety CYsnnittee - Proposal for a four-way stop
intersection at Black Mountain and Natoma Roads.
Mrs. Barbara Cordon, Chairman/Traffic & Public Safety 0minittee presented the
Committee's recommendation that the stop signs be moved to Natuna fon Black
Mountain (creating a temporary four-way stop intersection).
Jean Wilcox, Melody Lane; A. Bakst, Edgerton Road and Bob Puette, Black Mountain
Iniad all spoke in favor of placing stop signs on Natuna in addition to the ones
already on Black Mountain.
ODm Lnenbers considered the traffic reports and facts before than including
the staff's recommendation that a four-way stop not be established.
MOTION SECONDED ARID CARRIED: Moved by Proft, seoorded by Hillestal and passed
unanimously to have stop signs installed on Natuna in both directions and for a
traffic count and evaluation of the entire intersection to be made and the results
reported back to Council.
b) Pathways Committee:
Mrs. Fran Stevenson, member/Pathways Cammittee made the following brief report:
the Master Pathway Plan hopefully would be ready to present in a month; 2)
residents helping out in clearing sane of the Town's paths. Mayor to send a
letter of thanks fon the Town; 3) more trails are being marked by the LAH
Horsemens' Association; and 4) if anyone knows of any paths needing work done,
please let the Pathways Cam[nittee knew.
Reports of Ad Hoc Committees: none
Reports from the Planning CYnmission:
a) Tennis Court Policy Statement
Cbnmissioner Stewart presented the Caumission's Tennis Court Policy Statement
for the Council's approval. Councilmeumbers remarked that it was very well done
but they felt that certain areas needed more detailed attention, i.e. setbacks
and landscaping. Councilmenbers Perkins and Hillestad voluntF red to meet with
all or some members of the Planning Camdssion to work out these details and
report back to the Council the end of June.

` 4. Presentations from the Floor:
Mayor Nystrom reported on the May 1 Intergovernmental Council Meeting: 1)
Mrs. Hillestad and Mayor McHugh 94ilpitas) were appointed representatives
on AHAG's Executive Board for two year tenns. 2) Recycling centers on Edith
and on Grant Road for the residents convenience and 3) Bruce Freelen reported
that the County Master Plan would be done in a few months and it strongly
urged pockets and service areas to be annexed.

City Manager:
a) Public Safety Department
The City Manager presented his report which outlined current police and fire
services, gave a brief description of the Scottsdale, Arizona plan and
explained a public safety department including a projected budget. The City
Manager stated that this report did not at this time go into complete detail
as he was seeking a policy direction from the (ouncil.
Councilmenbers had several questions and concerns: 1) quality of service most
remain excellent; 2) other oaamnities such as IDs Altos and Palo Alto should
be explored regarding providing IDs Altos Hills with these services; 3) where
would we get the fiats for such a department?; 4) what plans are there if the
current fire and police contracts which expire June 30, 1980 are cot renewed?;
and 5) what kind of training will be provided for the members of this depart-
ment? Councilman Perkins also requested the City Manager to prepare an his-
torical chart of Ins Altos Hills costs for fire and police for the last five
years showing, among other things, the following: 1) how much did it cost?;
2) where the revenue came from; 3) effects of Propositions 13 and 9; and 4)
past and future obligations.
MZIrION SBOONDID AM CARRIED: Moved by McReynolds, seconded by Hillestad and
passel unanimously to proceed with plans for an independent fire and police
department, explore alternatives and also prepare a contingency plan in the
event the current providers discontinue service after July 1, 1980.
John Sanders, Ins Altos Fire Chief, requested a copy of the City Manager's
report and Ed Rutherford IDs Altos Fire Department, spoke against IDs Altos
Hills establishing its awn public safety department.
City Engineer:
a) Reports on drainage inquiries at 12720 Dianne Drive and 12838
Concepcion.
The City Engineer reported that for each of these drainage problems the owners
should hire Civil Engineers to assist them in correcting problems and they
should thesemake the corrections at their own expense.

4W Mr. and Mrs. Curtis, 12838 Concepcion Road, explained why they felt these
drainage problems were the Town's responsibilities.
Councidmeobers expressed concern that there was not enough information
available to make a decision on the drainage problem at 12838 Concepcion.
MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Nystrom and passed
unanimously to continue this matter giving the Curtis' the opportunity to study
the City Engineer's report and attempting to resolve the matter with the City's
staff. If it can't be resolved, they are to return to Council.
Mrs. Larin, 12720 Dianne Drive, referred to her letters dated April 1 and
May 1, 1980 to Council explaining the storm drainage easement on her property.
She further explained to Council why she felt this situation should be corrected
by the Town.
The City Attorney stated that regarding these drainage inquiries, there was
m evidence that the City was responsible and he supported the City Engineer's
reaaanenlation in each case. A potential property owner had the obligation to
fully investigate the property and when making improvements on property one is
responsible for any possible side effects. The City Attorney went on to say
that a resident could file a claim with the City. If accepted, it would be
paid. If rejected, it would be sent on the City's insurance carrier.
( 3. City Attorney's Report: The City Attorney stated that he did not have a
`, report to present to the Council.
Andrea Allison, 27360 Natuna Road, spoke before Council concerning his complaint
about barking dogs. The City Attorney responded that the Town had adopted by
reference Santa Clara Ordinance Nb. NS -600 relating to animals. The City could
direct the City Attorney to brina about civil action against an individual but
rot criminal action. The City Attorney recommended. that the irdi.viduals con-
cerne3 attempt to resolve the matter.
PASSED By CONSENsus: Not to discuss this item any further at this meeting
since it was not placed on the agenda.

Ordinance #262 amending Article 3 of Chapter 4 entitled "Subdivisions"
of Title 9 of the Los Altos Hills Municipal Code by Priding Section 9-4.311
thereto. (SECOND READING)
MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed
unanimously to waive further reading of Ordinance #262.
MOTION SEOONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed
unanimously to adopt Ordinance #262 by title.

2. Public Hearings:
a) Ordinance # mending Section 9.5-303 of Chapter 5 of Title 9
of the los Altos Hills Municipal Code by providing for the pre -
zoning of certain property (FIRST READING).
MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passel
unanimously to approve the Negative Declaration for prezoning of unincorporated
areas.
Lorraine Morgan, Altamnt Circle, spoke on behalf of the Altamont Hills hon
owners association. Mrs. Morgan asked what rights the property owners would
have if annexed and what the steps were in this procedure. She also went on
record as strongly objecting to the way the residents had been notified of this
public hearing on prezoning.
The City Attorney reported that the annexation procedure require) a totally
different set of requirements including the notification process. If the
property was going to be annexed in the future, this prezoning was necoessary.
The City Attorney suggested and Council agreed to schedule a Public Hearing
for the secord reading of this ordinance on May 21, 1980.
Mrs. Hartman, 27866 Altamont Circle, questioned whether her 2 lots (1.2 acres)
would he affected by this prezoning. The City Manager reported that since it
had already been legally subdivided, it would not be affected by prezoning.
Mr. Sill Brown, Altawnt Circle, expressed concerns over exactly what their
obligations would be as a result of prezoning.
MOTION SBOONDED AMID CARRIED: Moved by Hillestad, seconded by McReynolds and
Passed unanimously to waive further reading of Ordinance #263.
Councilman Perkins remarked that he was not sure it was a benefit to annex
Altamont Circle or even to go thru the method of prezoning because essentially
the area was already developed.
The City Manager responded that prezoning was simply a preliminary step. Once
area was prezoned, that area would be evaluated. When and if annexation was
presented to Council, a total package with all the details, etc. would be
included.
MOTION SEOOM ED ASID CARRIED: Moved by McReynolds, seconded by Hillestad and
passed by the following roll call vote to introduce Ordinance #263 amending
Section 9-5.303 of Chapter 5 of Title 9 of the Los Altos Hills Municipal
Code by providing for the prezoning of certain property.

b) Request for Tentative Map Approval, LANDS OF PHILBRICK, File
TM #2102-79.
MOTION SECONDED AMID CARRIED: Moved by Perkins, seconded by McReynolds and
passed unanimously to adopt the Negative Declaration dated 4/4/80, LANDS OF
PiffT CK.
MOTION SECONDED AND CARRIED: Moved by McReymlds, seconded by Hillestad and
passed unanimously to approve the Tentative Map Request, LANDS OF PHIIBRICK,
File TM #2102-79, subject to conditions as reoammended by the Planning
Camuission and including all amendments made at this Council meeting.
MOTION SECONDED AMID CARRIED: Moved by Proft, seconded by Perkins and passed
unanimously to add the following sentence to Condition 1.B.: The location
and width of the 10' pathway is to be determined in the field and approved by
the City Engineer in consultation with the Pathway Committee prior to the
filing of the final map.
Councilman Proft asked that the word slvuld be changed to shall in Condition
8.0 (. . .special attention shall be paid to . . . .). Councilman Perkins asked
the City Engineer if there were any potential drainage problems with this sub-
division. The City Engineer responded that alis issue had beer addressed.
MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by McReynolds and
passed by the following roll call vote to amend Condition 10 to read: There
will be no vehicular access to Westwind Way within one hundred feet (100') of
the returns Ian LaPalma and Concepcion Roads.
AYES: Mayor Nystran, Coumcilmombers MicReymlds, Perkins and Proft
ABSENT: Councilwoman Hillestad
PASSED BY CONSENSUS: To adopt the following reoaumesdations made by Councilman
Perkins: 1) a notation clearly placed on the Conditions of Approval stating
whether or not Conditional Exceptions were required; 2) The Conditions of
Approval (green skeet) be referenced to map as clearly as possible with revision
schedule, nunber and date showing on map and on green skeet.
G. NEW BUSINESS•
1. Standing Cortnittee Vacancies:
MOTION SBODMDED AMID CARRIED: Moved by Hillestad, seconded by McReynolds and
passed unanimously to appoint Paul Reneau to fill a vacancy on the Emirormental
Design OXraittee for a term expiring June, 1981.

MOTION SECONDED AM CARRIED: Moved by McReynolds, seconded by Proft and
passed unanimously to appoint Melvin Anderson to fill a vacancy on the Noise
Abatement Crnmittee for a tern expiring Jame, 1981.
V02ION SECONDED AND CARRIED: Moved by McReynolds, seconded by Proft and passed
unanimously to appoint Marilyn Iong to fill a vacancy on the Pathways Oomuittee
for a tern expiring Jame, 1981.
2. Agreement adjusting percentage distribution of fines and forfeitures
Penal Code Section 1463.
MOTION SECONDED AND CARRIED: Moved by McReynolds, seconded by Proft and
passed unanimously to adopt Resolution #1279 approving and authorizing
execution of agreement between the City of the Tuan of Ins Altos Hills and
the County of Santa Clara to adjust the percentage distribution of fines and
forfeitures.
The City Council then adjourned to Executive Session for Litigation at 11:00 p.m.
and reconvened at 12:40 a.m.
Council unanimously agreed to authorize the firm of Harris, Kerr, Forster and
Company to continue with Phase II of their study regarding Adobe Creek.
There being no further new or old business to discuss, the City Council
adjourned at 12:41 a.m. to an Adjourned Meeting at 5:00 p.m. on Wednesday,
May 14, 1980.
