CONSENT CALENDAR (continued): %r 5. Resolutions for Adoption: a) Resolution #1289 adopting a policy concerning tennis courts aril other requirements for site development and subdivision. b) Resolution #1290 declaring the intention of said city to vacate and abandon an emergency access easement and portions of certain sanitary sewer and pathway easements located in the city and under the provisions of the "Public Service Easements Vacation I.aw", Section 50430, et. seq., Government Code. c) Resolution #1291 accepting certain improvements in connection with final parcel map, being a portion of Rancho La Purissima Concepcion (Lands of Chaparral Properties, Tracy Court) d) Resolution #1292 accepting certain improvements in connection with Tract 6592, Koch Lane e) Resolution #1293 accepting certain improvements in connection with Tract 6568, Vista Serena The Executive Session - Litigation that was scheduled on the agenda was not held. C. SPECIAL REPORTS: 1. Reports of Starling Camnittees: none 2. Reports of Ptd Hoc camdttees: a) Pl Hoc Public Safety Study Canmi.ttee Bruce Thampson Chairman of the Pd Hoc Caunittee, presented the omnittee's preliminary reoamterlations to the Council: (1) The Crnmittee was unable to reamnend that the City Council support an added tax on the November ballot as was rewnmerdel by Supervisor Steinberg at the last Council Meeting. The Connittee was not convinced the Los Altos Fire District had an oblibation to pay all the so-called deficit. The Cannittee further suggested that the City Council obtain legal advice in regards to the County taking Fire District Bldg. Muds (that were appropriated by the taxpayers and were not so-called "reserves") and using than for operational expenses instead of allotting to the District their fair share of state "bail out" fords. (2) The Cmmittee reoaanended that the Council withdraw Los Altos Hills fnxn the Los Altos Fire District as seen as feasible. The Co mittee was concerned that the present arrangnent gave the city m control over City revenues or expenditures for fire protection of Los Altos Hills. b) Geraldine Steinberg, Board of Supervisors - Fire District Mrs. Steinberg expressed disappointment at the recmverdations made by the Fd Hoc ar ttee and also concern about adequate fire protection for the district. She further noted that the questions asked by the m ttee should certainly be addressed but that the deficit in question was a current problem. Mrs. Steinberg sought Council endorsement for the tax override bill in November which would cover the deficit for this year. -2- CITY COUNCIL MINUPES - July 16, 1980 C. SPECIAL REPORTS: Reports of Ad Hoc Committees (continued): LCouncilmanbers then discussed several aspects of this issue such as: the certain procedures required if and when the Town did want to get out of the District; the status of the capital reserves; the responsibility for the deficit and what, if anything, should be done about the present contract? Council asked the City Attorney to prepare legal responses to these ques- tions for the next meeting. They also asked the City Attorney to have a legal opinion on Item 6 of the Ad Rbc Public Safety Study Committee's 7/15/80 report: . .legal information as to the los Altos Fire District ownership and rights to assets in the Los Altos Fire Department.' It was agreed by Council to continue this item and place it on the August 6 agenda. 3. Reports frau the Planning Ct mmission: Planning Commissioner Lachenbnmch reoomiended to Council that Sections 9-5.208(2) and 9-5.502 of the Ordinance scheduled for public hearing later in the meeting be sent back to the Planning CAmnission for further study. YMON SECONDED AND CARRIED: Moved by McReynolds, seconded by Hillestad and passed unanimously to send Sections 9-5.208(2) and 9-5.502 0£ the proposed ordinance (Item E.lc)) back to the Planning Commission. 4. Public Hearings: a) Resolution #1294 adopting the Palo Alto sewer service chard final report and authorizing transmittal to the Santa Clara County Assessor's Office. K)TION SEOONDED AND CARRIED: Moved by Perkins, seconded by Hillestal and passed unanimously to adopt Resolution #1294 adopting the Palo Alto sewer service charge final report and authorizing transmittal to the Santa Clara County Assessor's Office. b) Resolution # adopting the Los Altos sewer service charge final report and autlnrizing transmittal to the Santa Clara County Assessor's Office. The City Manager asked that this item be deleted frcm the agenda until the negotiations with Los Altos are completed. Council agreed. c) Ordinance # adding Sections 9-5.208(1) and 9-5.208(2) to Chapter 5 entitled "Zoning" of the Ins Altos Hills Municipal Cade, and by amending Sections 9-5.209 and 9-5.502, and Subsection (a) of Section 9-5.503 thereof. (FIRST READING) Planning Camuissioner Lachenbruch recoamende3 that the section on height be con- sidered even though the sections on impervious surface and coverage had been returned to the Planning Commission. -3- CITY COUNCIL MINUTES - July 16, 1980 SPECIAL ORDERS: Item E.lc) continued: `. Councilmenbers discussed whether or not to consider the proposed ordinance as a total package, particularly since a public hearing had been set. Paul Reneau, 13149 Byrd Lane and Walter Babbitt, Jr. 27911 Via Ventana, Los Altos and Ken Pastrof developer and Sunnyvale resident addressed the Council and expressed concerns and interests in the entire ordinance. MOTION SECONDED IND CARRIED: Moved by McReynolds, seconded by Hillestad and passed by the following roll call vote to refer the ordinance back to the Planning Cowmission and to continue the public hearing of the entire ordinance to the August 20 city Council Meeting. AYES: Mayor Nystrom, Councilmembers Hillestad and McReynolds NOES: Councilmenbers Perkins and Proft d) Request for Tentative Map Approval, LANDS OF TIDMPSON, File TM #4-80 MOTION SECONDED AM CARRIED: Moved by. Perkins, seconded by Hillestad and passed unanimously to adopt the Negative Declaration, LANDS OF THIMPSON, File TM #4-80. The City Engineer reported that the staff and Planning Camuission reaamuended approval of the Tentative Map. He further noted that the issue of the easement had been addressed and Condition 7.B added to the Conditions of Approval. Also letters of agreement were on file. ow Councilmembers questioned Condition 6.A. Concerning the correction of erosion problems the wording seared rather vague. Celene A. Claude 24550 Suumerhill Avenue, noted that the only time there was an erosion problem was when the Thompson house was built; it did not seen to be a recurring problem. PASSED BY NNSENSIS: To amend Condition 6.A. to read". . .erosion problems shall be corrected to the satisfaction of the Tuan Engineer." MOTION SECONDED AMID CARRIED: Moved by Perkins, seconded by Hillestad and passed unanimously to approve the Tentative Map, LANDS OF THINTSON, File TM #4-80, subject to conditions as recomended by the Planning Co mission and as amended by Council. e) Request for Tentative Map Approval, LANDS OF HUTH, File IM #3-80 MOTION SECONDED AND CARRIED: Moved by Proft, secorded by McReynolds and passed unanimously to adopt the Negative Declaration, LANDS OF HUTH, File TM #3-80 with the following mitigation measures: 1) Height limitations and fencing restrictions to mitigate visual impact and 2) Installation of storm drain to mitigate stow runoff. SPECIAL ORDERS: Item E.le) LANDS OF HUTH (continued) %W The City Engineer reported on the several issues which had been addressed by the staff and Planning Camnission before they recaTmercled approval of the Tentative Nap; namely, the addition of conditions 7.A., 9.C., 4.B., 9.D. and 9.E. He further noted that the Wane of Bentley Court bad been agreed to by the Historical Society. Jon Lynch, applicant's engineer, referred to Condition 10.A. and felt that it was unfair to levy these restrictions on this subdivision. Planning Cmemissioner Lachenbruch responded that this condition had been added for two reasons: drainage and the concern over intensity of the development. Mrs. Fran Stevenson, Patlways Camcittee, spoke in favor of adding a bike path to the conditions. Bob Owen, developer, agreed with the value of putting in a bike path if it would eventually ­ part of the Town's bike plan but did not see the sense for a short distance. He also objected to the height limitations. PASSED BY CONSENSIS: To make the following corrections amd/or additions a part of the Conditions of Approval: Condition 6.B. added: A bike path to be put in. Condition 10.A. amended to read: "of amount of impervious surface for each lot not to exceed the following criteria: For a lot with an average slope ranging frau 58 to 258, the allowable impervious surface (sq. ft.) = 15,000 An (1-0.03417 (S-5)). WHERE: n = Net Area (Acres) S = Average Slope of the lot as determined pursuant to Subsection 3 of Section 9-5.501. Lot Units = n (1-0.02143 (s-10)) In calculating impervious surface, portions of driveway up to twelve feet (12') wide and more than one hundred feet (100') from the residence or secon- dary dwelling may be excluded frau the calculations. Condition 11. Height added: No structure or part thereof, including aerial towers and chimneys, shall be constructed or altered to exceed thirty feet (30') in building height. Furthermore, within thirty feet (30') from the structural set- back line, the building height, excepting chimneys, shall be reduced. The building height shall not extend above a plane which is set by: 1. A maximun building leiglYz of fifteen feet (15') of the structural setback line; 2. An increase of one foot (1') in height for each additional two feet (2') frau the setback line; and 3. A maximun building height of thirty feet (30') at points thirty feet (30') or more from the structural setback line. Where the reduced building height areas overlap, the plan requiring the lowest building height shall prevail. NEW BUSINESS: PASSED BY OONSENSW: to send a letter to Irma Goldsmith congratulating her as the recipient of the 1980 Award for Excellence in Historic Resources Preservation. 1. Standing Cammittee Vacancies: MOTION SECONDED AMID CARRIED: Moved by Hillestad, seconded by McReynolds and passed unanimously to appoint John F. Mullen, Jr. to the Traffic and Public Safety Committee for a term expiring June, 1982. MOTION SECONDED AND CARRIED: Moved by Hillestad, seconded by Nystrom and passed unanimously to appoint Ruth B. Sherman Morrison to the Environmental Design Ca ittee for a tern expiring in June, 1982. MOTION SECDPIDED AMID CARRIED: Moved by Hillestad., seconded by Nystrom and passed unanimously to appoint Diana Rowe to the Pathways Committee for a term expiring June, 1982.
