Mayor Nystrom called the Regular Meeting of the City Council to order at 7:35 p.m.
in the Council Chambers of Town Hall.
A. FULL CALL AND PLEDGE OF ALLEGIANCE:
Present: Mayor Nystrom, Counci]members Hillestad, McReynolds and Proft
Absent: Councilman Perkins

B. CONSENT CALENDAR:
MOTION SEOX1DED AMID CARRIED: moved by Hillestad, seconded by Proft and passed
by all members present to approve the Consent Calendar, specifically:
1. Approval of Minutes: September 3, 1980
2. Approval of Warrants: $70,386.62
3. Actions of the variance and Permit Ca utission - recommended granting of
the following:
a) LANDS OF STRAYER, File VAR #6-80
C. SPECIAL REPORTS:
1. Reports of Standing Ccmnittees: none
2. Reports of Fd Hoc Committees:
Bruce Tho mosori Chairman of the Pd Hoc Public Safety Study Committee, asked the
City Council to investigate the following two Points: 1) seek legal information
as to Los Altos Fire District's ownership and rights to assets of Los Altos Fire
Department and 2) obtain legal assurance that the furls paid to the County for Los
Altos Hills fire purposes will be transferred to a new Ins Altos Hills fire pro-
tection entity. The CamAttee needed answers to these legal questions in order to
effectively make a recommendation.

PASSED BY CONSENSUS: Directing the City Attorney to investigate these legal
questions and report back to Council with a recommendation.
MOTION SECONDED AM CARRIED: Moved by McReynolds, seconded by Hillestad and
passed by all members present to adopt Resolution #1311, application of the City
of the Town of Los Altos Hills of the County of Santa Clara to the Local Agency
Formation Commission of Santa Clara County for the detachment of the territory
within the City of the Tuan of Los Altos Hills from the Los Altos Fire Protection
District.

a) Claim - Dawn D. Storey
The City Attorney reoenmexded that the claim of Dawn D. Storey be rejected and sent
to our Ins Altos Insurance Company, Flamer and Company.
MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Nystrom and passed by all
members present to reject the claim of Dawn D. Storey and refer it to the Town's
insurance company.
b) Resolution #1312 approving and authorizing execution of agreement for
performance of services as City Attorney between the City of the Town
of Los Altos Hills and Frank Gillio
MOTION SECONDED AMID CARRIED: Moved by Hillestad, seconded by Proft and passed by
all members present to adopt Resolution #1312 approving and authorizing execution
of agreement for performance of services as City Attorney between the City of the
Town of Los Altos Hills and Frank Gillio.
3. City Engineer:
a) Report on letter from Ramona S. Chuan
The City Engineer reported on the Chown's letter concerning their disfavor with the
retention basin being installed as part of the street improvements for the Saddle
Mountain Estates Subdivison. In response the City Engineer reviewed the following
points: levee size - conceptual vs. actual; visual concern; retention basin effec-
tiveness; siltation; levee stability and alternatives to retention basin.

3. City Engineer - report on letter from Ramona S. Chown (continued) :
Mr. and Mrs. Clean 13822 Page Mill Pond, addressed t}e Council on this matter
and reviewed their position on the points made by the City Engineer. Their opinion
was that what was in place was not doing the job.
Councilmenbers noted that the required improvements would not be accepted by the
Town if they did not work properly and also noted that after the improvements were
accepted, a bond would be required. Additionally every effort would be male to keep
the environment rural. It was suggested that Mr. Chuan address his suggestions
and problems to Steve Stern of Bas Hanes, Inc. with copies of his correspondence to
Council.
b) Report on Lards of Lynch, 25701 lcmita Linda Court
The City Engineer reported on the September 10 Planning Cramnission meeting where a
majority of the anments pertained to the legality of the caboose and not the visual
aspects. He further noted that the Planning Commission had accepted the City
Attorney's opinion that the caboose was a legal structure.
Paul Nowak, 24696 Olive Tree Court, spoke in favor of the caboose.
Don Beck 12150 Winton Way ani Fd Barnes 23750 Ravensbury Avenue, expressed the
opinion that the calxnose was an illegal structure and demanded that a second legal
opinion be obtained.
Council noted that the Tann had an opinion from the City Attorney but if the group
opposing the caboose wanted to obtain a second opinion it was their option.
E. SPECIAL ORDERS:
1. Ordinance # amending Article 3, entitled "Seder Use" of Chapter 4 of Title
6 of the Los Altos Hills Municipal Code by re -numbering the article and
sections thereof. (FIRST READING)
The City Attorney noted that this ordinance was being introduced simply to correct
the numbering in the above mentioned chapter of the code.
MOTION SEO7NDED AND CARRIED: Moved by Proft, seconded by McReynolds and passed
by all members present to waive further reading of Ordinance #265.
MDTION SEMMED AND CARRIED: Moved by Hillestad, seconded by Proft and passed by
all members present to introduce Ordinance 4265 amending Article 3, entitled "Sewer
use" of Chapter 4 of Title 6 of the Los Altos Hills Municipal Code by re-nunbering
the article and sections thereof.

2. Public Hearings: The applicants for the scheduled three public hearings
requested that they be continued to the October 1, 1980 Council meeting.

passed by all members present to continue the following three public hearings to
the October 1, 1980 meeting.
a) Appeal of Planning Commission approval of Site Development permit for
tennis court/pool/spa, File A #9775, 12169 Padre Court
b) Request for Tentative Map Approval, LANDS OF BUMICK, File TM #2101-79
c) Appeal of Variance and Permit Commission denial for LANDS OF SPILKER,
File VAR #8-80.

NEW BUSINESS:
It was reported that the Municipal Facilities Building (Barn) had been nominated
to receive an award at the 'Orchids and Onions' program, sponsored by the Santa
Clara Valley Chapter of the American Institute of Architects.
