MINUTES OF A REGULAR MEETING

Mayor Pro Tem Thomas McReynolds called the Regular Meeting of the City Council
to order at 7:37 P.M. in the Council Chambers of Town Hall.
A. ROLL CALL & PLEDGE OF ALLEGIANCE:
Present: Mayor Pro Tem McReynolds, Councilmembers Nystrom, Perkins and
Proft.
Absent: Mayor Hillestad.
Staff: City Manager Robert Crowe, City Attorney Frank Gillio, City
Engineer John Carlson, Commissioner Arthur Lachenbruch for the
Planning Commission and Deputy City Clerk Susan Buttler.
Press: Florence Pallakoff, Los Altos Town Crier and Jan Shaw, San
Francisco Examiner.
(6�B. CONSENT CALENDAR:
MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by
Councilman Perkins and passed unanimously by all present to approve the
entire Consent Calendar, specifically:
1. Approval of Minutes: December 20, 1978.
2. Approval of Warrants: $13,432.06.

from the Planning Commission:
Commissioner Lachenbruch questioned the status of the Ordinance #239
revision which had been acted upon by the Planning Commission in mid-
November. There was confusion as to whether this had been forwarded to
the City Attorney for review and Councilmembers determined that, in the
future, items from the Commission be brought to the City Manager's atten-
tion for inclusion on his Manager's Report and periodically reviewed by
the Commissioners for progress made.

As it was not yet the hour for Special Orders, Council adjourned for
approximately thirty minutes to an Executive Session for the purpose
of litigation.

E. SPECIAL ORDERS:
1. Public Hearings:
a) Request for Tentative Map Approval, LANDS OF BAHR, File
TM #2079-78, 2 Lots.
After the Public Hearing was opened, the City Engineer advised of the
Environmental checklist that had been prepared by Staff.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by
Councilman Nystrom and carried unanimously by all present to adopt a
Negative Declaration, LANDS OF BAHR, File TM #2079-78.
Mr. Nowack, Applicant's Engineer, requested the deletion of Condition 3C
due to the extreme expense caused by the undergrounding of utilities.
Councilmembers discussed with the City Engineer the requirement being
imposed on the subdivider to underground utilities along South Fork Lane,
past experience with deferring major improvements when the land is further
subdividable, legal problems with enforcing contingency agreements and the
private versus public road issue necessitating the condition.
MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by
Councilman Perkins and passed by the following roll call vote to delete a� 4
Condition 3C because ordinance 232, Section 9-4.1105 allows existing(`
poles on a public right-of-way to remain, therefore, the private road����
of Three Forks Lane shall be considered equivalent to a public road.
AYES:- Mayor Pro Tem McReynolds, Councilmembers Nystrom and Perkins.
NOES: Councilman Proft.
ABSENT: Mayor Hillestad
Discussion followed on the proposed ingress/egress to the subject property,
centering on the following: (1) Studies made and inadequacies found with
regard to Three Forks Lane serving the subdividable property in this area;
(2) Enforcement problems the Town will encounter with an open-ended agree-
ment for future road improvements; (3) The need for a specific traffic
and circulation plan line for this area adjacent to Page Mill Road; and,
(4) Alternative routes of access through Lands of Crist, Lands of Cottrell
or Lands of Country Way, and the need for more information before a
suitable determination might be made.
Mr. Nowack, Applicant's Engineer, advised of the costs of the alternative
routes and suggested the Lands of Crist as the most viable.
Mr. Bahr, Applicant, agreed with his Engineer's suggestion and advised of
excessive tree cutting involved in accessing his property through Lands of
Country Way.
Various solutions were then explored and Council consensus was that this
matter had to be resolved now as it had been carried over too many times
in the past. V
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by 5
Counci man Nystrom an carried by the following roll call vote to send
LANDS OF BAHR back to Staff for clarification of Condition 1D and Q
development of alternative traffic circulation plan lines considering
all properties involved and to recommend precise implementation measures.
It was further directed to continue this Item for thirty days to the
% February 7, 1979 meeting for this purpose.

b) Request for Tentative Map Approval, LANDS OF LENZEN, File
TM #2092-78, 2 Lots.
MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by
Councilman Perkins and approved by all members present to adopt a Negative
Declaration, LANDS OF LENZEN, File TM #2092-78.
Mr. Pastrof, Applicant's Representative, questioned the need for Conditions
1.0 and l.D and advised of the proposed improvements to Campo Vista Lane.
MOTION SECONDED AND CARRIED: Following a brief discussion on the merits
of this condition, it was moved by Councilman Perkins, seconded by Council-
man Nystrom and carried unanimously by all present to delete Condition 1.C.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by
Councilman Perkins and passed unanimously by all present to delete the
last sentence of Condition I.D.
Mr. Jensen, Campo Vista Lane, asked that the Council address the pro-
viding of additional parking and street repairs necessitated by the pro-
posed construction on Campo Vista Lane.
Determination followed that the suggested hammerhead terminus configura-
tion should provide extra space for both parking and traffic turn around
with an additional condition to resolve future needed private road improve-
ments and repairs.
MOTION SECONDED AND CARRIED: Moved by Mayor Pro Tem McReynolds, seconded
by Councilman Nystrom and carried unanimously by all members present to
add as new Condition 6.B: These parcels will enter into a Private Road
Maintenance Agreement at such time as one becomes available on Campo Vista
Lane.
Discussion followed on the merits of Private Road Maintenance Agreements,
the improvements proposed for Campo Vista Lane with stress on maintaining
its rural character and methods of providing a conditional exception to
enable the City Engineer latitude in approving deviations from the standard
street improvement specifications.
MOTION SECONDED AND CARRIED: Moved by Mayor Pro Tem McReynolds, seconded
by Councilman Nystrom and carried unanimously by all members present to
amend Condition 1.A to read: The applicant shall make an irrevocable offer
for dedication to the Town of Los Altos Hills by the Final Map, right-of-
way for a roadway and a turn -around, public utilities, and pedestrian and
equestrian pathways within the easterly portion of the proposed Lot 2
(Ord. 232, Section 9-4.1206(e)).
MOTION SECONDED AND CARRIED: Moved by Mayor Pro Tem McReynolds, seconded
by Councilman Proft and passed unanimously by all members present to add
the following sentence to Condition 1.D: A conditional exception shall be
granted to the standard street improvement specifications of the Los Altos
Hills Municipal Code.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by
Councilman Nystrom and passed unanimously by all present to approve LANDS
OF LENZEN, File TM #2092-78, subject to conditions as recommended by the
Planning Commission and as amended above.

c) Ordinance #246 amending Section 9-5.214, and Subsection (E) of
Section 9-5.703, respectively, of Chapter 5 of Title 9 of the
Los Altos Hills Municipal Code.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by
Councilman Proft and passed by the following roll call vote to waive
further reading of Ordinance #246.
AYES: Mayor Pro Tem McReynolds, Councilmembers Nystrom, Perkins and
Proft.
NOES: None.

F. GENERAL ORDERS & UNFINISHED BUSINESS:
t 1. Request from C. M. Ford for reconsideration of pathway clearance.
Mr. Ford, La Cresta, outlined the objections contained in his letter of
November 30, 1978 to the proposed oleander cutting on the path in front
of his residence as being an unnecessary elimination of screening.
Mrs. Gottlieb, Chairman/Pathway Committee, told of the Committee's efforts
to have property owners clear paths, eliminating Town expense to get the
work done.
Mrs. Stevenson, Pathway Committee, advised of the safety hazards to
pedestrian and equestrian pathway users on La Cresta in traversing out
into the road to avoid the path obstructions.as well as their communica-
tions with Mr. Ford to resolve this problem..
Councilmembers discussed with Mr. Ford the placement of pathways along La
Cresta, the types of uses common to these paths, traffic safety problems
caused and compromises that might be worked out. Consensus of Council
was to direct that the oleanders be trimmed back carefully in order to
leave screening for Mr. Ford's house and also, provide clearance on the
existing pathway easement.
2. Request from Mr. & Mrs. G. Leight for amendment of pathway condition,
Tract #6112.
Mr. Leight, Shol.es Court, stated that the pathway in front of his property,
at the end of a cul-de-sac, ended there and was broken up by his driveway
and walkway, thus making two short sections unnecessary. His request was
to not have these sections base rocked, but leaving the easement dedication
Mrs. Gottlieb, Chairman/Pathwa Committee, spoke for the use of this path
y not only equestrians, but c i dren as well for access to school.

Discussion followed on the safety provided at the end of most cul-de-sacs
for pedestrian/equestrian traversing, the lack of a pathway around and
out this street and the inability of these two sections to provide much
additional path terrain.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by
Councilman Nystrom and carried unanimously by all members present to
grant Mr. & Mrs. Leight's request to delete base rock on two sections
of path in front of their residence.
3. Request for reduction in conservation easement size, LANDS OF DUWE,
File VAR #7046-77.
Mr. Duwe, Applicant, outlined his request for shortening the conservation
easement on the rear of his property for lawn installation.
Councilmembers discussed the purposes of conservation easements with
consensus that adding vegetative growth should not be considered an
infringement on the concepts addressed in the Town's General Plan.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by
Councilman Nystrom and passed unanimously by all members present to
reduce the conservation easement from 180' to 1401, LANDS OF DUWE, File
VAR #7046-77.
`, 4. Council review and recommendations on pertinent items from Steering
Committee Report.
Discussion ensued on the three areas designated to be addressed by Council
with consensus to have Councilmembers Perkins and Proft work up a priority
list and schedule a Study Session on Monday, January 15, 1979.
G. NEW BUSINESS:
Councilmembers discussed a potential conflict of interest resulting from
the soils engineer for Saddle Mountain Estates holding a financial interest
in the project. Determination was to direct the City Manager and City
Attorney to transmit to the developer Council's concerns and a request
that every effort be made to enlist the services of an unbiased soils
engineer for this development.
There being no further new or old business to discuss, the City Council
adjourned at 11:30 p.m. to a Study Session on Monday, January 15, 1979
at 4:00 p.m.
