II, 001 -End Mayor Thomas McReynolds called the Regular Meeting of the City Council to order at 7:33 p.m. in the Council Chambers of Town Hall. A. ROLL CALL & PLEDGE OF ALLEGIANCE: Present: Mayor McReynolds and Councilmembers Hillestad, Nystrom, Perkins and Proft. Absent: None. Staff: City Manager Robert Crowe, City Attorney Frank Gillio, City Engineer John Carlson, Planning Commission Representative Michael Kuranoff and Deputy City Clerk Susan Buttler. Press: Florence Pallakoff, Los Altos Town Crier. B. CONSENT CALENDAR: MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilman roft and passed unanimously to approve the entire Consent Calendar, specifically: 1. Approval of Minutes: September 5, 1979 2. Approval of Warrants: $22,527.94. 3. Time Extension Requests: a) Granting time extension to October 31, 1979 for Planning Commission con- sideration, LANDS OF MELCHOR, File TM #2100-79. b) Granting time extension to October 31, 1979 for Planning Commission con- sideration, LANDS OF HILLESTAD, File TM #2095-79. 4. Resolutions for Adoption: a) Resolution #1235 amending Resolution #1020 establishing rules for travel expense reimbursement. b) Resolution #1236 formalizing the procedure for reimbursement of certain expenses to Planning Commissioners. C. SPECIAL REPORTS: 1. Reports of Standing Committees: None 2. Reports of Ad Hoc Committees: None 3. Reports from the Planning Commission: None 4. Presentations from the Floor: Mrs. Goldsmith, Historical Society, told of the Society's wish to plant an amber tree at nza Park in memory of Mrs. Gould's son and thanked the Council for their cooperation with this matter. She further stressed the need for maintaining of the plants at the Park and suggested that, perhaps, plants needing less water be considered. She also suggested the installation of a bench which might be accomplished by a resident, Mr. Brubaker, who has experience of this nature. Councilmembers commended Mrs. Goldsmith. CITY COUNCIL MINUTES - September 19, 1979 C. SPECIAL REPORTS: (Continued) tE At approximately 7:40 p.m. Council adjourned to Executive Session - Litigation. o Council reconvened at 8:12 p.m. D. STAFF - REPORTS, CORRESPONDENCE & ANNOUNCEMENTS: 1. City Manager: a) Report on storm drain improvements - Dr. Buch. The City Manager briefly reviewed the discussion at the last meeting, subsequent site inspections by he and the City Engineer and the recommendations contained in his September 13, 1979 memo. Councilmembers offered objections to the lack of information before them, specifically, those items directly requested, and reiterated the need for: 1) Staff report with sketches or maps; 2) A brief history of how the problem developed; 3) More precise cost estimates; and, 4) Complete engineering work on the proposals. Mr. Buch, Summitwood Road, questioned whose responsibility the easements in the area were, provided more background and objected to his having to pay for any of the improvements. MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilwoman Hillestad and passed unanimously to direct that the Staff set this matter high on their priority list and come back with better defined proposals by the next meeting (October 3, 1979). Also, that by the next meeting the legal responsibility issue be resolved by the City Attorney. 2. City Engineer: a) Report on status of Final Map, ASTRA ESTATES, File Tract #6527. The City Engineer described the map errors that had been found, the reasons for bringing this matter to Council and the two recommendations contained in his memo of September 14, 1979. Mr. Mitchell, Attorney for the Applicant, advised of the copying error from one map to another that has now been corrected and expressed their desire that Council rule for an amended map rather than the filing of a new Final Map. Following a brief discussion by Council as to the impact on each lot size of the errors in question, the City Attorney stated that State requirements would permit the preparation of an amending map or certificate of correction, which was his suggestion for the handling of this matter. MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Nystrom and carried unanimously to direct the City Attorney to prepare the appropriate Resolution for a certificate of correction, ASTRA ESTATES, Tract #6527, and charge all excess Staff time expended on this subdivision to the applicant. E. SPECIAL ORDERS: 1. Ordinance #256 amending Title 7 of the Los Altos Hills Municipal Code by adding thereto Chapter 5 entitled "Flood Damage Prevention". (SECOND READING) The City Attorney advised as to the basic tenets of procedures and coverage offered 4W through the adoption of the proposed Ordinance and answered Council questions as to applicability to residents in various areas of the Town. -2- CITY COUNCIL MINUTES - September 19, 1979 E. Ordinance #256 (Continued) MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by Councilwoman Hillestad and passed unanimously to waive further reading of Ordinance #256. MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Councilman Nystrom and carried unanimously to adopt Ordinance #256 amending Title 7 of the Los Altos Hills Municipal Code by adding thereto Chapter 5 entitled "Flood Damage Prevention". At approximately 8:55 p.m. Mayor McReynolds left the meeting and Mayor Pro Tem Proft then presided. 2. Public Hearings: a) Consideration of an amendment to proposed Subarea Plan Element, Chaparral Way area. Due to possible conflict of interest, Mayor Pro Tem Proft and Councilwoman Hillestad stepped down from consideration of this matter. Councilman Perkins and the City Engineer provided a brief history of previous action on this item. Thereafter, Commissioner Kuranoff told of the extensive public hearings held by the Planning Commission, the feelings garnered from residents in the area to leave Chaparral Way much as it is now and the Commission's current intent to abide by their recommendation of July 27, 179 and as outlined in his memo of that same date. Mr. Poole, Chaparral Way, spoke for the safety of the road as he had lived there since 1950 and then stated that the area down near Moody Road, where further subdivision would have the greatest impact, could be taken care of with a cul-de-sac when sub- division occurred. Council then discussed the liability factors on this road which is partially private and partially public and their desire to adopt a plan which would be acceptable to the majority of residents involved while providing the greatest safety. Thereafter, the following amendments were made to the Planning Commission recommended Amendment - Subarea Plan Element to the Los Altos Hills General Plan, dated July 27, 1979: PASSED BY CONSENSUS: To amend Item #6, page 2 to read: All drainage channels that receive storm water from improved areas shall be improved to accept excess drainage either with an underground system or by other means consistent with the rural nature of the area. The improved drainage channel shall discharge to a storm drain collection pipe, a paved street with a gutter or Adobe Creek. PASSED BY CONSENSUS: To change "Moody Creek" to "Adobe Creek" in Item 7, page 2. PASSED BY CONSENSUS: To delete Item 11, page 2 and re -number appropriately. PASSED BY CONSENSUS: To number the last paragraph, page 2, as Item 12 and add the following—and two sub -topics to it: The following principles will apply during development: a) Except for emergency use, Chaparral Way will not at any time be used as a vehicular connection between Moody Road and Altamont, b) The Town will take necessary steps to retain the option of connecting upper Chaparral Way to Altamont which is only to be acted upon if future need arises. MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by Councilman Perkins 4 and passed by the following roll call vote to adopt Resolution #1237 adopting the Amend- ment to the Subarea Plan Element of the Los Altos Hills General Plan with above changes. AYES: Councilmembers Nystrom and Perkins. NOES: None. PRESENT: Mayor Pro Tem Proft and Councilwoman Hillestad. ABSENT: Mayor McReynolds. 3_ 4 CITY COUNCIL MINUTES - September 19, 1979 F. NEW BUSINESS: 1. Designation of Town representatives to the Northwest Flood Control Zone Advisory Committee. Mayor Pro Tem Proft introduced the letter citing expiration of current terms and the City Manager advised that either the former representatives could be re- appointed or new designees could be made. MOTION SECONDED AND CARRIED: Moved by Mayor Pro Tem Proft, seconded by Councilman Perkins and passed by all members present to re -appoint City Engineer John Carlson (Representative) and Councilman William Perkins (Alternate) to a one year term on the Northwest Flood Control Zone Advisory Committee.
