MINUTES OF A REGULAR MEETING
Wednesday, January 4, 1978

Mayor Keith Brown called the Regular Meeting of the City Council to order at 7:42 PM
In the Council Chambers of Town Hall.
A. ROLL CALL 8 PLEDGE OF ALLEGIANCE:
Present: Mayor Keith Brown, Counclimembers Cheney, Hlllestad, McReynolds and
Proft
Absent: None
Staff: City Manager Robert Crowe, City Attorney Frank Glllio, City Engineer
Alexander Russell, Engineer/Planner John Markl, Commissioner Judith
Carico for the Planning Commission and Deputy City Clerk Susan Buttler
B. CONSENT CALENDAR:
The City Manager requested the removal of Item 4-d) and the Engineer/Planner
removed Item 3-a) for separate consideration.
MOTION SECONDED AND CARRIED: It was moved by Councilwoman Hlllestad, seconded
by Councilman McReynolds and passed unanimously to approve the balance of the
Consent Calendar, specifically:
I. Approval of Minutes: December 21, 1977
2. Approval of Warrants: 826,026.04
4. Resolutions for Adoption:
a) Resolution #1092 requesting the Board of Supervisors to permit the Regis-
trar of Voters to render services relating to the 1978 General Municipal
Election.
b) Resolution #1093 fixing compensation of Election Officers and other costs
for the 1978 General Municipal Election, and ordering the City Clerk to
canvass returns.
c) Resolution #1094 approving Williamson Act Contract.
Mr. Markt asked that the time extension date In Item 3-a) be changed to March 8,
1978, thereafter, Mr. Crowe requested that Public Works Director be inserted in
place of City Engineer in all data under Item 4-d).
MOTION SECONDED AND CARRIED: Then moved by Councilman McReynolds, seconded by
Councilman Cheney and carried unanimously to approve the remaining Items on the
Consent Calendar, specifically:

a) LANDS OF DAWSON, File TM #2073-77, Granting Time Extension to 3/8/78 for
Planning Commission consideration.

d) Resolution 1095 approving completion of the 1977 Street Resurfacing Project
and authorizing final payment.

3. Presentations from the Floor:
Mrs. Carico, O'Keefe Lane, asked if Council and Staff were aware of a bill pending
action at the State level which could mandate low cost housing In all communities.
Mayor Brown and Councilman McReynolds agreed that this might pose a serious threat,
requested that any Information on this legislation be put before the Legislative
Review Committee for study and stressed that local government strength would come
from citizen awareness and Involvement.

E. SPECIAL ORDERS:
I. Public Hearing:
( a) Request for Tentative Map Approval, LANDS OF HUTCHINS, File TM #2053-77:
MOTION SECONDED AND CARRIED: Following introduction by the City Manager, It was
moved by Councilman Cheney, seconded by Councilwoman Hillestad and passed unan-
imously to adopt a Negative Declaration for LANDS OF HUTCHINS, File TM #2053-77.
Councilman Proft questioned the distance of the barn from the property line and
the Engineer/Planner Mr. Mark 1, outlined the new field survey that had been made
which placed the barn well within the proper setbacks.
MOTION SECONDED AND CARRIED: It was moved by Councilman McReynolds, seconded by
Councilman Cheney and carried unanimously to delete Condition 12-(a), specifically:
The Town shall determine, if possible, when the barn at the southwest corner of
Parcel "2" was constructed. At the time the parcel is field -surveyed for the pre-
paration of the parcel map, the Town shall, by field Investigation, determine the
actual setback of the barn from the nearest external boundary and report the findings
to the Planning Commission prior to the submittal of the Parcel Map.
Discussion followed on the chain link fence existing on the property, the roadway
dedication requested from the Applicant and geological review that had been conducted
on the land In question. Determination of Altamont as an arterial road precluded the
thirty foot dedication from being excessive, seismic setback zones for buildings had
been included In response to geological hazards and the fence question was resolved
with the following amendment (included within the motion for Tentative Map approval).
MOTION SECONDED AND CARRIED: Moved by Councilman McReynolds, seconded by Councilwoman
Hillestad and passed unanimously to approve LANDS OF HUTCHINS, File TM #2053-77 sub-
ject to conditions as recommended by the Planning Commission, as amended by Council
and, with this change to the last sentence of Condition 16: Fence removal shall be
accomplished prior to the filing of the Final Map or a bond of sufficient amount to
guarantee future removal shall be posted with the Town.

2. Ordinance for Adoption (Urgency Ordinance - Effective Immediately):
The City Attorney Introduced the Ordinance, amending portions of Chapter 4 of Title
9 of the Municipal and offered corrections to certain errors contained therein.
Council questioned the clarity of Item (7) (c) on pages 9 and 10 and the City Engineer
was directed to re -write with a motion to follow later In the meeting.
Mr. Giller, Vinedo Lane, criticized the necessity of this being put through as an
urgency measure without having more public hearings.
Mrs. Schick, Weston Road, concurred with Mr. Giller's criticism, stating that there
were many Interested residents who had wished to attend public hearings on this amend-
ment at both the Planning Commission and City Council level.
It was then determined that this matter dealt with subdivision regulations, not zoning
changes; that it had been pending for some time with appropriate hearings by the Plan-
ning Commission and; Commission members had requested that these changes be treated
urgently due to subdivision concerns now before them.
MOTION SECONDED AND CARRIED: Following title reading by the City Manager, it was
moved by Councilman McReynolds, seconded by Councilman Proft and carried unanimously
to waive further reading.
Discussion then followed on time Involved if Council did choose to not handle this as
an urgency Ordinance and legal problems that might arise.
Mr. Giller, Vlnedo Lane, spoke on slope density calculations, suggesting It be handled
on a lot by lot basis which, In turn, would provide for environmentally sound and
aesthetically pleasing subdivisions.
Councilman McReynolds explained the problems Involved with this approach and outlined
the many areas of Input utilized In the preparation of this amendment.
MOTION SECONDED AND CARRIED: It was moved by Councilwoman Hlllestad, seconded by
Councilman Proft and passed unanimously to adopt as an urgency Ordinance No. 239
amending Sections 9-4.102, 9-4.204, 9-4.205, 9-4.227, 9-4.229, 9-4.258, 9-4.501,
9-4.508, and 9-4.712, Subsection (7) of Section 9-4.506, Subsections (a) and (e)
of Section 9-4.603, Subsection (d) of Section 9-4.703, the first sentence and Sub-
sections (a), (b) and (c) of Section 9-4.604, the first sentence of Section 9-4.701
and 9-4.710; adding Subsection (c) to Section 9-4.603, and Article XV; and repealing
Section 9-4.103, respectively, of Chapter 4 entitled "Subdivisions" of Title 9 en-
titled "Planning and Zoning" of the Los Altos Hills Municipal Code.
Included In the motion was the amendment to Item (7) (c) on pages 9 and 10 to read:
An exception shall be permitted In a proposed subdivision creating not more than
three (3) lots where the parcel proposed to be subdivided was formed prior to the
Incorporation of the City. For slope density calculations, the area (A) shall be
computed from the existing right-of-way line, except when the existing right-of-
way Is less than forty feet (40'), in which case the area (A) shall be computed
from a line twenty feet (201) from the center line of the existing right-of-way.
F. GENERAL ORDERS 8 UNFINISHED BUSINESS:
I. Request by Transportation Commission - Removal of Barriers at Bus Stops.
MOTION SECONDED AND CARRIED: Following introduction by the City Manager, It was
moved by Councilman Proft, seconded by Councilman McReynolds and carried unanimously
461 to endorse the report from the Ad Hoc Committee on Transportation for the Handicapped
entitled Recommendations on Removal of Barriers at Bus Stops.

2. Request by U. H. Chan for deletion of Condition #9 - LANDS OF SMITH, File
BSA #6061-75.
Continued to the meeting of January 18, 1978 by the request of the Applicant.
3. Request by H. N. Reiser for time extension on completion of Improvements -
LANDS OF REISER, File Parcel Map 349 M 21.
Continued to the meeting of January 18, 1978 by the request of the Applicant.
G. NEW BUSINESS:
Councilman Proft questioned when the Ordinances concerning brick walls and organ-
ized jogging would be forthcoming and was advised by the City Attorney that they
would be ready for the next meeting. He also asked if it would be advisable to
have a meeting before the next meeting to clarify all Issues of the Adobe Creek
Country Club Conditional Use Permit and consensus of Council was that they did
not see the need at this time.
H. ADJOURNMENT:
There being no further new or old business to discuss, the City CounclI adjourned
at 9:15 PM.
