II, 386 -End Mayor Lucile Hillestad called the Adjourned Meeting of the City Council to order at 4:08 PM in the Council Chambers of Town Hall. A. ROLL CALL & PLEDGE OF ALLEGIANCE: Present: Mayor Hillestad, Councilmembers McReynolds, Nystrom, Perkins and Proft. Absent: None. Staff: City Manager Robert Crowe, City Attorney Frank Gillio, Consul- ting Engineer/Planner John Markl, Commissioner Michael Stewart for the Planning Commission and Deputy City Clerk Susan Buttler. Prior to resuming hearings on October 23, 1978 Agenda Items, Council adjourned to Executive Session. The meeting re -convened at 4:25 PM. E. SPECIAL ORDERS: (Continued) 3. Public Hearings: (Continued) b) Request for Tentative Map Approval, LANDS OF TAYLOR, File TM 42077-78, 8 Lots. During his introduction, the City Manager covered events of previous meetings on this request due to conflicts of access and liaison between Los Altos Hills representatives and Los Altos representatives to deter- mine the best solution for all concerned. Following determination that a Negative Declaration had not been adopted at a previous meeting, the City Attorney advised as to the steps required in the consideration of the Initial Environmental Study. The City Manager then read from the Checklist and the conclusions therein. Mr. Moffatt, Cypress Drive, outlined the concerns of the "Robinwood Association" that the disruptions and resultant landlocking caused by the development of this property combined with public interest,fulfilled State requirements that the Town request an Environmental Impact Report. Council discussion followed with the City Attorney relative to the Town's ability to solve a problem within Los Altos, whether a need existed to impose environmental mitigation measures on this property and the efforts made to date to resolve these same issues. Mr. Myers, Attorney for the Applicant, stated that there was not currently a tentative map application before the City of Los Altos for the adjacent property owned by his client. SPECIAL ORDERS: (Continued) 3. b) LANDS OF TAYLOR (Continued) Mrs. Gallo, La Lanne Court, advised of a petition submitted to the Town by neighboring Los Altos Hills residents against a thru street to Los Altos and objected to the time spent trying resolve a Los Altos problem. MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by Councilman Perkins and passed unanimously to adopt a Negative Declaration for LANDS OF TAYLOR, File TM #2077-78. PASSED BY CONSENSUS: To remove "(Ordinance No. 232, Section 9-4.1110)" from Condition #8. MOTION SECONDED AND CARRIED. Moved by Councilman Prot, seconded by Councilman McReynolds and carried unanimously to amend Condition #21 to read: A five foot (5') Type IIS improved path shall be constructed along the northerly side of Koch Lane from Miranda Road to the common property lines of Lots 4 and 5. Mrs. Struthers, Pathway Committee, spoke for the Type IIB pathway and further requested a 10' easement be granted between Lots 4 and 5 down to the creek. Councilman Perkins stated his objections to the non -rural appearance of the Type IIB pathway. Councilmembers then reviewed the necessity of the 10' easement request, including the Applicant's objection. MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by 40 Councilman Nystrom and passed unanimously to approve LANDS OF TAYLOR, File TM #2077-78, subject to conditions as recommended by the Planning Comis- sion and as amended by Council above. C) Request for Tentative Map Approval, LANDS OF YELTON, File TM #2082-78, 2 Lots. (Appeal - Denied at the Planning Com- mission Meeting of September 27, 1978) Discussion began on the adoption of a Negative Declaration with the Con- sulting Engineer/Planner providing information on conservation easement dedicated and tree plantings as mitigating noise measures. Councilman McReynolds questioned the delineation of the Monte Vista Fault as shown on the map and the geological studies that had been made. He also raised the issues of pollutants and noise from IS280 as serious problems needing to be addressed. Mr. Schmidt, Attorney for the Applicant, offered a brief history of the subject property, stating that development was consistent with zoning regulations of the Town. Mr. Riley, Engineer for the Applicant, spoke for the mitigating measures against noise that would be utilized in the construction of the proposed home. Councilmembers reviewed with Staff results of geologic surface field tests made, stressing the need for more extensive investigations with borings 4W and trenchings. -2- "CITY COUNCIL MINUTES - October 25, 1978 E. SPECIAL ORDERS: (Continued) 4V 3. c) LANDS OF YELTON (Continued) MOTION SECONDED AND FAILED: Moved by Councilman Perkins, seconded by Mayor and failed by the following roll call vote to adopt a Negative Declaration, LANDS OF YELTON, File TM #2082-78. AYES: Mayor Hillestad and Councilman Perkins. NOES: Councilmembers McReynolds, Nystrom and Proft. Councilmembers McReynolds and Proft requested that the following three reasons for their No vote be included in the record: (1) The fault line delineated by the engineer indicates that the fault line has been super- ficially disturbed by the creek bed, by parking lot grading and by IS280 grading and, in fact, the fault line may, and probably does, encompass the entire project. (2) Noise mitigation measures are not sufficient to allow for normal uses of this property that are associated with homes in Los Altos Hills and will result in substantial health hazards to future occupants of this property. (3) The pollutant levels of IS280 are sub- stantial and will probably result in health hazards to the occupants when exposed to them over an extended period of time. Councilman McReynolds further requested that this rationale be forwarded to the Town Geologist for his review. Discussion followed on the ramifications of this failed Motion, alternatives open to the Applicant and that Council's desire was not to obtain an E.I.R., to but only more extensive research into the above listed problems. MOTION SECONDED AND CARRIED: In order to provide for more discussion of this Item at a subsequent meeting and offer the Applicant an opportunity to present additional information for consideration of a Negative Declara- tion only, it was moved by Councilman Proft and seconded by Councilman Nystrom to reconsider the denial of the Negative Declaration. The vote on this Motion occurs at the time of the next Hearing on this Item. F. NEW BUSINESS: L11 Mayor Hillestad requested the City Manager to look into the 911 Emergency phone listing for Los Altos Hills residents There being no further new or old business to discuss, the City Council adjourned at 6:30 PM to a joint meeting with the Planning Commission immediately thereafter.
