MINUTES OF A REGULAR MEETING
Wednesday, September 21, 1977

Mayor Keith Brown called the Regular Meeting of the City Council to order at 7:31 PM
In the Council Chambers of Town Hall.
A. ROLL CALL 8 PLEDGE OF ALLEGIANCE:
Present: Mayor Brown and Councilmembers Cheney, Hillestad, Proft and McReynolds
Absent: None
Staff: City Manager Robert Crowe, City Attorney Frank Gillio, City Engineer
Alexander Russell, Engineer/Planner John Markl, Commissioner Dochnahl
for the Planning Commission, Deputy City Clerk Susan Buttler

B. CONSENT CALENDAR:
Following a statement by Mayor Brown concerning Council's decision to hold
tonight's meeting, Mr. Larry Giller requested that the entire Consent Calendar
be removed as Improper.
Mr. L. Giller, Vinedo Lane, objected to the timing of this meeting, citing It
as an affront to those people who observe the Jewish faith. He further stated
that the City Manager had been notified on Monday of the conflict between this
City Council meeting and the celebration of Yom Kippur.
Mayor Brown reiterated Council's position regarding separation of church and
state and emphasized it was not their intention to slight any resident. Council -
member Cheney stated he did not concur with Council's decision and, since he
felt tonight's agenda Items could be held over, then made a motion to adjourn
this meeting to Monday. Motion died for lack of a second. At approximately
7:45 PM, Councilmember Cheney left the meeting.
Mayor Brown requested that the Minutes of September 7,1977 be removed for
separate consideration for the following change on Page 6:
MOTION SECONDED AND CARRIED: It was then moved by Councilman McReynolds, secon-
ded by Councilman Proft and carried unanimously to amend Condition 21: Reduce
the total number of lots in the subdivision by one lot, to a maximum of 26 lots.
Combine Lots 26 and 27 Into one large lot, adjusting the lot lines on Lots 16
thru 27. Minor adjustments to Saddle Court may be made as deemed necessary.
Mr. G. Dal, Applicant, asked that his Variance request be removed, with discus-
sion following on the merits on Staff recommendation for a retaining wall versus
his desire for structural decking over a Ingress/egress easement. It was deter-
mined to leave the conditions as they were.
4 MOTION SECONDED AND CARRIED: It was moved by Councilman McReynolds, seconded by
�r Councilwoman Hillestad and passed unanimously to approve Lands of Dai, VAR #7043-77
subject to conditions as recommended by the Planning Commission.

MOTION SECONDED AND CARRIED: It was then moved by Councilwoman Hillestad, secon-
ded by Councilman Proft and carried unanl mously to approve the balance of the
Consent Calendar, specifically:
I. Approval of Minutes: September 7, 1977.
2. Approval of Warrants: $21,369.23.
3. Motions for Adoption:
a) LANDS OF NEWMAN, File TM #2068-77, Setting October 5, 1977 as Public
Hearing date.
b) LANDS OF CRIST, File TM #2062-77, Time Extension to 10/26/77.
5. Resolutions for Adoption:
a) Resolution #1067 accepting Grant Deed of Gift and ordering recordation
thereof.
b) Resolution #1068 setting October 5, 1977 as Public Hearing date to con-
sider a proposed amendment to the Zoning Map.
C. SPECIAL REPORTS:
I. Reports of Standing Comm lttees: None
2. Reports of Ad Hoc Committees: None
3. Presentations from the Floor: None
D. STAFF - REPORTS, CORRESPONDENCE 8 ANNOUNCEMENTS:
I. City Manager:
a) Report on Solid Waste Disposal.
Mr. Crowe referenced his memo on the Nine Par Dump Site Closure and the resulting
Increase in rates for garbage disposal, asking for Council direction on the method
of handling this Increase. Councilwoman Hillestad questioned the mechanics In-
volved, while Councilman Proft suggested It would be best to have It absorbed by users.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilwoman
Hl I lasted and carried unanimously to: Direct the City Manager and City Attorney
to amend the Agreement between Los Altos Hills and Los Altos Garbage Company In
order that the rate schedule would absorb the Increase in annual costs.
b) Bid Award - East Branch of Barron Creek.
Questions centered on who would be doing Inspections and the reasons for the large
differences In bid quotes. The City Manager designated the City Engineer to take
care of all Inspections, then cited cast -In place versus pipe as causing the bid
differences.
MOTION SECONDED AND CARRIED: It was moved by Councilwoman Hillestad, seconded by
Councilman McReynolds and passed unanimously to adopt Resolution #1069 awarding
Hackett Construction Company, Inc. the contract for Improvement of East Branch of
Barron Creek.
c) Santa Clara Valley Corridor Study.
The City Manager stated his major disagreement with this Study centered on the
dwelling and land use estimated for the Town. He strongly recommended that the
Council go on record rejecting the balanced estimates, thereby supporting the
concepts of our General Plan.

MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Council-
man McReynolds and carried unanimously to: Direct the City Manager to Initiate a
letter stating their position In support of the Los Altos Hills General Plan con-
cepts and rejecting the balanced estimates of dwelling units as Indicated In the
tables Included In the August 19, 1977 ABAG/MFC Corridor Study.
E. SPECIAL ORDERS:
I. Request for Final Map Approval, LANDS OF BAUMGARTNER, File FM #3033-77.
Discussion centered on the Applicant's request for removal of Condition #4.
MOTION SECONDED AND CARRIED: It was then moved by Councilman McReynolds, seconded
by Councilman Proft and passed unanimously to amend Condition #4 to read: The well
on Parcel A (map of 9/76) shall be used for agricultural purposes only.
MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Council-
man Proft and carr ed unan mously to adopt Resolution #1070 approving the Final
Parcel Map for Lands of Baumgartner and authorizing execution of Subdivision Agree-
ment.
MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Council-
man Proft and passed unanimously to adopt Resolution #1071 approving and authorizing
execution of Refunding Agreement between the Town and A.C. Baumgartner and his wife.
2. Request for Final Map Approval, LANDS OF ROLLING HILLS, File FM #3037-77.
Mayor Brown Instructed Staff to Insert the offer of private road dedication on the
4W Final Map.
MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Council-
man McReynolds and carried unanimously to adopt Resolution #1072 approving the
Final Parcel Map for Lands of Rolling Hills and authorizing execution of Subdivision
Agreement.
MOTION SECONDED AND CARRIED: It was then moved by Councilwoman Hillestad, seconded
by Councilman McReynolds and passed unanimously to adopt Resolution #1073 approving
and authorizing execution of Private Road Agreement between J.W. Simon, J.L. Simon,
J.R. Seiger and R. Seiger, and the Town of Los Altos Hills.
3. Public Hearings:
a) Annexation and Pre -Zoning - Lands of Parrett.
After Introduction by the City Manager, the City Attorney outlined procedures to
be followed noting that the Negative Declaration must be adopted before any further
action could be taken. Discourse followed on the pre -zoning that must be accom-
plished before the Local Agency Formation Commission would act on the application
for annexation.
MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Council-
man McReynolds and carried unanimously to authorize the filing of a Notice of
Negative Declaration for Lands of Parrett, 52.83 Acres, Assessor's Parcel No.
336-25-001.

fir' MOTION SECONDED AND CARRIED: Councilman McReynolds moved, seconded by Councilman
Proft and carried by the following roll call vote to Introduce Ordinance No. 237
amending Section 9-5.303 of Chapter 5 of Title 9 of the Los Altos Hills Municipal
Code by providing for the Pre -Zoning of Certain Property.

b) Request for Tentative Map Approval, LANDS OF BERGER, File TM #2058-77
It was noted that changes had been made as recommended by Council when they re-
turned this matter to Planning Commission for review. The City Manager then
outlined on the transparency the proposed drainage for this subdivision. Council-
man McReynolds questioned the pathway caused noise problems that would be exper-
ienced by the residents of Lots 8 and 9.
Mr. Charles Reed, Applicant, offered his cooperation and stated he felt that a
In lieu deposit for fencing would be a satisfactory solution for both the resi-
dent and the Town.
MOTION SECONDED AND CARRIED: Thereafter, moved by Councilman McReynolds, secon-
ded by Councilwoman H Ilestad and passed unanimously to add as a new sentence to
Condition 18 (b): The developer shall be responsible for planting drought resis-
tant, low profile shrubbery along the pathway between Lots 8 and 9, and shall put
on deposit with the Town, in lieu of fencing, $5.00 per lineal foot. This deposit
shall be held by the Town for one year after occupancy of Lots 8 and 9.
Then to amend Condition 18 (b) (1): Construct a motorcycle barrier at the
northerly end (Altadena) of the path between Lots 8 and 9.
The City Engineer and Commissioner Dochnahl discussed landscaping and fencing
plans for the subdivision, especially along Fremont Road. General discussion also
occurred regarding the Intent of certain Conditions and control, if any, over the
final appearance of this subdivision.
MOTION SECONDED AND CARRIED: Councilman Proft, seconded by Councilman McReynolds
and carried unanimously to amend Condition 16: Any permanent subdivision signs
will be recommended by the Planning Commission and approved by the City Council
before they are constructed.
MOTION SECONDED AND CARRIED: It was moved by Councilwoman Htllestad, seconded by
Councilman McReynolds and passed unanimously to add as a new Condition: Land-
scape plans for the public rights-of-way, particularly along Fremont Road frontages,
shall be submitted in conjunction with the Improvement plans.
Mr. M. Stewart, Chairman of the Planning Commission, agreed with the noise mitiga-
tion measures as outlined by Council, but questioned the necessity of clarification
on certain Conditions.
MOTION SECONDED AND CARRIED: Councilman McReynolds moved, seconded by Councilman
Proft and carried unanimously that a Notice of Negative Declaration be filed for
Lands of Berger, File TM #2058-77.

MOTION SECONDED AND CARRIED: Then moved by Councilman McReynolds, seconded by
Councilman Proft and passed unanimously to approve Lands of Berger, File TM
#2058-77 subject to conditions as recommended by the Planning Commission, and
as amended above.

F. NEW BUSINESS:
Councilman Proft wished to discuss certain agenda Items, i.e., Variances,
Conditional Use Permits and Building Site Approvals, sent Immediately from
the Planning Commission to the Council. These Items cause a problem in that
sufficient information and/or minutes are not available to Councilmembers,
thus affecting the final decision. Concensus among Councilmembers was that
delaying these matters would cause undue hardship on the applicants.
Councilman McReynolds questioned the City Attorney regarding his review of
the contract between the Town and Spangle 8 Associates and was advised that
this would be forthcoming.
0. ADJOURNMENT:
There being no further new or old business, the City Council adjourned at
10:07 PM to their next Regular Meeting, October 5, 1977.
