RQ1 CALL: Present: Councilmen Brown, Proft, Councilwoman Hillestad, Mayor Pro Tem Grabowski Absent: Mayor Cheney Staff: City Manager Robert Crowe, City Attorney Frank Gillio, City Engineer Alex Russell, Deputy City Clerk Norma Hislop B. ANNOUNCEMENTS: Mayor Pro Tem Grabowski requested that City Attor,iey Frank Gillio inform Council and members of the public of the decision just handed down by the California Supreme Court in relation to Sewer Assessment District k9: Mr. Gillio announced that he had been informed that the Court had upheld the decision of the lower courts in favor of the Town with reference to the litigation over Sewer Assessment District A9. Mr. Gillio said he had not yet received a copy of the decision, but when he had read this he would be better able to respond to questions Council Members might have pertaining to the subject. C. UNFINISHED BUSINESS: 1. Approval of Pre -Conditions for Conditional Use Permit - Adobe Creek Country Club: a) On -Site Circulaticn Plan and Traffic Movement and Evaluation Plan: Mayor Grabowski requested that the Applicants appoint one spokesman to whom Council could address any questions they might have relative to this subject, and who could speak on behalf of the Country Club. Mr. Williao 7oller, attorney for the Applicants, addressed Council with regard to the Staff's recommendation that Moody Road be re -aligned near the entrance to the Club. He stated that this recommendation would be ` a substantial and costly improvement for the Club at this time, whichhe I 4+ ferdany decisionot feel wonithisprove matternf rione yeartodetermine 5that whetherlsuch improvement was absolutely necessary, and at the time of yearly review, :. "He suggested that Council defer any decision on this matter for one year to determine whether such an improvement was absolutely necessary. ane at the time of yearly review, make such determination at that time." �+s CITY COUNCIL MINUTES - April 12, 1976 ADOBE CREEK COUNTRY CLUB USE P_RiJTT Co-rt'di: Mr. Zoller also suggested that the recommendation with reference to the split road for the purpose on ingress and egress would interfere with existing landscaping, and this decision might also be deferred until the yearly re- view of the Use Permit for dateradnation at that time. Mr. Zoller disagreed with the recommendation of the City Engineer relative to the paving of all parking areas and returning lot V. which would not be needed for parking, to its natural state thrrugh landscaping. He felt that lot #7 would return to its natural state without the Club's landscaping the area in a short period of time if it was not used for additional parking. Mr. Zoller also thought the parking areas could remain natural or gravel rather than paving all the areas. Speaking from the Floor: Mrs. T. Schick, Weston Road2 Planning Commissiorcr: Commented that the Conenission had worked on the conditions, 'out hap rr_rer seen a final copy of the Use Permit as granted by the City Council. Also fait ti,it the paving of the parking areas should be required for the safety of Club members. In response to the Mayor, City Manager Robert Crova stated that copies of the final Use Permit had not been reproduced for the Commission and various Te,:.,n 4W Committees; however, they had been informed that an approved copy was available at Town Hall if they wished to review it. Mr. Gillio also commented on the Town's liability resoensibilites as it pertained to private property. Plannin i Commission Chairman J. Carico: Stated that fir. Crowe had informed her that a copy of the se Permit was available for the Coimnission's review if they desired. Mr. Thomas f4cRevnolds, Moody Road: Did not believe the On -Site circulation p an was adequate as submitted, and did not feel Council would be able to enforce it if it were approved as it now stood. Councilman Proft addressed Council regarding many discrepancies in the plot plan as presented to Council. He stated that there was a disparity between the map and actual measurements of the rcaoways; the plan d1d not show the water tank on the site or the location of one of the structures. He felt that many questions were still unanswered this evening. Discussion between Staff and Council er.sr!Pd regarding the plot plan as sub- mitted by the ar:licant. Councilman Proft moved, seconded by Councilwoman Hillestad, that, prior to the Council's acceptance of the requirements of Items "f" and "g" of the Conditional Use Farmit, a plot plan be drawn by a Civil Engineer at a scale of 1" + 201, which adheres to the foilowinq sections of the Municipal Code: -2- CITY COUNCIL MINUTES - April 12, 1976 ADOBE CREEK COUNTRY CLUB USE PERMIT (Cont'd): ADOBE CREEK Section " Section 9-3.302, sub-paragraph a), 1 thru 5. Section Section 9-4.405, sub-paragraphs j, li, 1, n> P. Section 9-4.411, sub-paragraphs g, h, i, k, o, p, and q. 41't Section Section 9-4.502, sub-paragraphs a and f." ' Motion s AYE: Councilmen Brown, Proft, Councilwoman Hillestad, Mayor Pro 'rc;n Grabowski. NO: None. ABSENT: Mayor Cheney ABSTAIN: None Council and Staff then discussed the recommendation by both the City Engineer and the Traffic Engineer that Moody Road be re -aligned with the entrance to the Country Club, and the fact that the present map does not tie the proposed tennis courts to any permanent monument. Councilman Proft moved, seconded by Councilman Brown, that the map showing the tennis courts be tied into at least two (2) permmn-int monuments which can be either along the exterior boundary of the property, or individual monuments which are in turn tied into the exterior boundary of tha property, prior to the commencement of construction of the tennis courts. Motion carried by the 4 following roll call vote: AYE: Councilmen Brown, Proft, Councilwom:.n Hillestad, Mayor Pro Tem Grabowski. NO: None ABSENT: Mayor Cheney ABSTAIN: None Councilwoman Hillestad moved, seconded by Councilman Brorr„ that when the permanent monuments are tied into the map in relation to the tennis courts to the satisfaction of the City Engineer and the City Manager, the applicant may proceed to apply for his building permit for the censtruction of the courts. Councilman Bram expressed concern that, should this motion be approved by Council at this time, it might negate any future recommendations made relating to the entrance to the Club and a possible re-aligmner-t of Moody Road. Answering Councilman Froft's question regarding the possibility Cf moving the entrance of the Club in a westerly direction, City Engineer Alex Russell stated there would be a problem because of the topography of the land. Councilwoman Hillestad did not think there was any difficulty with the entrance, and stated a sign could be changed to t;xe oirpacite side of the read, but saw no other difficulty. she felt the moiicn g:): made (above) was in order. Mayor Grabowski also felt Councilwoman Hillestad's motion was in order since the applicant was aware of the risk that this condition might be imposed if it were deemad racessary by Council. Both Councilmen Proft and Brown wished to have the applicant clearly made aware of this possibility should Council permit the applicant to proceed with the tennis court construction. -3- CITY COUNCIL MINUTES - April 12, 1976 ADOBE CREEK COUNTRY CLUB USE PERN:iT (Cont'd): There being no further discussion or comments by Council, Mayor Grabowski called for the vote, and Councilwoman Hillestad's motion (above) carried by the following roll call vote: AYE: Councilmen Brown, Proft, Councilwoman Hillestad, Mayor Pro Tem Grabowski. NO: NONE ABSENT: Mayor Cheney ABSTAIN: NONE. Council also directed Staff to make the new plot plan that is to be submitted by the applicant available to the Pathway Committee which they can utilize in ma!,,ing their recommendations for paths along the subject property.
