CVSENT CALENDAR: At the request of Deputy Clerk Norma Hislrp, the Minutes of May 6, 1976 were removed from the Consent Calendar; Councilman Brown requested the removal of Item 3 b); Councilman Proft, Item 3 a); and Councilman Grabowski, Item 2. fiOTION SECONDED AND CARRIED: Councilwoman Hillestad moved, seconded by Councilman Proft and unanimously carried to approve the remaining items on the Consent Calendar, specifically: 1. Approval of Minutes: May 24, 1976 (Adjourned fleeting) 4. Resolutions for Adoption: a) Resolution #956 setting time and place for public hearing to consider amendment to General Plan pertaining to removing designation of historical point of interest, LANDS OF ROSSI. b) Resolution #957 accepting certain streets and roadways into the Street System of the Town, and accepting certain easements as shown on "flatadero Springs", Tract #4378. The Mayor noted that this would reduce Staff time in the preparation of the Minutes, and unless there were Council objection this would be the Council policy; in all other cases where the public addressed Council from the Floor, the Minutes would reflect only that the person spoke for or against an item. 2. Approval of Uarrants: $31,866.04. City Manager F.cbert Crowe responded to Council Member's questions regarding several warrants on this evening's warrant list. Mayor Cheney suggested that checks to the Inter -City Council meetings attended by Council Members be paid Ly Rep rata warrant in t{le future, rather than having the disburseroent from the Lily Fianager's account. council menbers agreed. Actions of the Planning Commission: a) LANDS OF ROSSI. APN336-15-007 - Recommended Council approval of request for exemption from subdivsion moratorium subject to conditions - Councilman Proft wished it noted that on subjact request, as well as all such requests in the past, it was his understanding that in voting for such ex- emptions, the tentative maps submitted would be in conformance with the subdivision ordinance adopted by the Coancil. Councilman Brown moved, seconded by Councilman Proft to approve the request for exemption from the subdivis@cn as recommended by the Planning commission with the condition that: the applicant submit a tentative map that is in conformance with the subdivision ordinance a adopted by the City Council. Councilman Brown pointed out that in order to rectify the tax inugniti2s, the Town must seek action through the Legislative representatives in Sacramaato, to which all Council members agreed. P^;otion carried unania.Dusly. b) Mr. Crowe noted the request by the Los Ai:os Hire for consent from Council to proceed with the abatement of fire hazards which were located on properties within the Town. counciW.F..n Grabews!ci asked ` about Y,'hdt redrP,_s the property owners hau in this regard, sicca It appeared such a directive by Council.ould be oucs-,de the confirms of due process, and thers:fore could not support any such motion. _n_ CITY COUNCIL MINUTES - June 2, 1976 STAFF REPORTS (CONT"D): Fire Hazards (Cont'd.): Mr. Crowe explained that action is not requested from Council until the Fire Department had notified the property owners several times that a fire hazard existed on their property, and that, after council action, On owners would be notified one more time and given a certain period of time during which they could have the discing done by themselves. It was only after this procedure had been completed that the Fire Department procceded to abate the hazard themselves. Councilman Proft moved, seconded by Councilman Brown to approve the request of the Fire Department to proceed with the abatement of fire hazards on thc-e?,'lot carried by the following their roll Memo cto the City Manager dated htey 26, 19116. Mr. Crowe noted that the Guidelines for lease proposal which had ����:❑ pr�,.- pared were general in nature, with a few specifics. He noted tisat the City Attorney had reviewed the guidelines and that they covered his major concerns Council Members expressed concern regarding ingress and egress to the barn via the road thru Byrre Preserve. Mr. Crowe noted that he had talked with a representative from the Nature Conservancy, who stated there was no ab- jection to using this road for access as long as the Town was not divesting itself of the property. Council discussion included concerns over length of lease; installation of a sprinkler system, which 'the City Manager felt was a structurala improvement and therefore the responsibility of the owner of the property; parking facilities; public address system. The following amendments to the pro.osed guidelines were made by Council Members: Guideline # Amendment 2 add the words "and a minicum Gf dusi:" to and of sentence. 5 To the end of the sentence aid tha w:,rds, "except as limited by number (7), below." 7 "Four limited shows" amended to "f°.•w linitcd si-ows", and the addition at the end of the sentence, "to be held be- tween the hours of 10:00 A.M. and 5:00 P.M." g To the end of the sentence, add the following: "other than a fire sprinkling system, and shall become the property cf lessor et the termination of the lease. -5- 4W CITY COUNCIL MINUTES - June 2, 1376 STAFF REPORTS (Cort'd): Westwind Farm Guidelines Cont'd : Guideline # ;Amendment 20 At beginning, change "Lessor" to "Lessee". After the word "manner", delete the words "except Lessee" and substitute "and." 21 Clean up wording of this guideline. 22 Minimum monthly rent shall be nine hundred dollars ($900), 'y­1'�z,rs) P-" :-orse. 23 Change proposed term of lease to three (3) years. Motion carried unanimously by roll call vote. E. SPECIAL ORDERS: 1. Ordinance for Adoption: Ordinance 41 amanding Chapter 4 of Title 9 of LAX Municipal Code entitled "Subdlvsions." Mayor C cney requested comments or statements from members of the public in this reg,ard. There being none, discussion returred to Council, and at the request of the Maysr, Mr. Crowe read the title of the proposed Ordinance. Councilman Brown noted that he had same ho :,nuld like to suggest to the Ordinance as proposed by Staff. In view of this, i:a suggested an Ad- jeurned Council meeting for the purpose of a Study Sessicn to review the Ordinance. council so agreed and set the Study Session for June 8, 1976 at 2:30 P.M. 2. Request for Extension of time to complete improvements for Variance, Lr,NDS OF SMITH, File i''Var.7013-74: 10 4 CITY COUNCIL MINUTES - June 2, 1976 SPECIAL ORDERS (Cont'd): Mr. Cro:ae explained that, under the conditions imposed in granting the subject Variance, the applicants were given a time frame in which to complete the improvements required. Because of costs, most of the work was being done by the applicant, who had not finished the work, and the time was expiring. He noted improvements completed to date, and that the applicant was asking for an additional time extension in order to complete the remaining improvements. Mrs. Phil Smith, applicant, addressed Council concerning her reasons for their request, and felt that all improvements would be completed within three months. Councilman Grabowski moved, seconded by Councilwoman Hillestad, and carried unanimously to grant an extension of time of three (3) months to complete the improvements under conditions previously set forth in granting a Variance, LANDS OF SMITH, File #Var.7013-74. 3. LANDS OF WRIGHT, File 1PT612027-75 - Request for Tentative Map approval: 1Sr. Crowe noted that the Planning Commission had voted to deny the subject tentative map, and that their main concern was the ingress and egress from the property. T:wn Planner Ken Pastrof stated that this sLbdivision had been worked up in conformance with the pro:osed Ordinance, and that in considering the develop- ment of this property, Staff also took into consideration other lands in the area that were further subdividable. Mr. Pulliam Henry, an adjacent property er!ner, addressed Council regarding an agreement not yet executed relating to ingress and egress from his property, requesting that acceptance be ccm'.itioned upon the execution of such an Agreement. Mayor Cheney noted that Council was not in a position where such a condition could be imposad,, how=:ver, he 'received the assurance of the Developer, that this Agreement would be executed. Council and Staff discussion ensued re;3rding the candid en imposed relative to pathways,drainage in the area, and adjacent property development. Sneaking from the Floor opposing tentative map as submitted Mrs. Irma Goldsmith, Elena Road. Mrs. Rosemary Meyerott. Mr. Paul Nowack, Engineer, addressed Council concerning the time and study involved in the tentative map as submitted, which took into consideration the CITY COUNCIL MINUTES - June 2, 1975 SPECIAL ORDERS (Cont'd): LANDS OF WRIGHT (Cont'd): development of adjacent properties, traffic conditions which would result, and based on this study, he felt the map presented was the most reasonable solution. Councilman Grabowski moved, seconded by Councilwoman Hillestad, to approve the tentative map, LANDS OF WRIGHT, File ,YTM2027-75, subject to conditions recommended by Staff and amended by the Planning Commission at their meeting of flay 26, 1976. Motion carried unanimously by roll call vote. 4. LAH Historical Society requests for clarification re History Room: Mr. Crowe noted the letter received from the Town's Historical Society re- quFsting clarification on insurance for the History Building, the legal cwner of artifacts and historical objects contained in the room, and access by the public to the room. Council Members concensus was that it was their understanding that the Room set aside by Council for the housing of historical artifacts would be a shared and cooperative effort between the Town Historian, Mrs. Fave, and the Historical Society. Councilman Grabowski questioned whether the City Hanager had tried to resolve any differences that might exist between the parties concerned. Flr. Crowo responded that the only knowledge he had of the matter was the Mayor's request to have the matter placed on the Council Agenda. Speaking from the Floor: Mrs. Lurille Gould, Member of Historical Society. hlrs. Rosemary Heyerott, Member of Historical Society. Mrs. Florence Fava, Town Historian. After discussion between Council Members and all parties concerned, it was Council concensus that Hr. Crowe should meet with the Mayor and represent- atives from the Society and the Town Historian in an effort to resolve and reach agreement regarding the use of the Town's History Poem. F. GENERAL ORDERS & UNFINISHED BUSINESS° 1. Authentication of Historical Sites: Action defered by Council to meeting of June 15, 1976. 2. Continuation of Bicentennial Commission: Councilman Grabowski moved, seconded by Councilwoman Hillestad and carried unanimously to continue the Bicentennial Commission to the end of 1976, and inform Mrs. Carol Incerpi to continue her duties as the Town's representative 410. to tha County Bicentennial Commission. -8- CITY COUNCIL MINUTES - June 2, 1g75 GENERAL ORDERS (Cont'd): 3. Request from County to participate in County -wide Land Use Study. �1,116,. This matter was struck from the evening's agenda since it was moot. 4. Consideration of Resolution pertaining to the acquisition of Open Space. Councilwoman Hillestad presented Council with a proposed Resolution, the essence of which was the establishment of a policy that all public lands a�:quirpd by end in the Town for public use shall be solely owned and/or controlled by the Town. Council meribors suggested several minor changes in the wording of the Resolution as presented. Councilman Grabowski moved, seconded by Councilwoman Hillestad to adopt Resolution #959 stating the policy of the City Council with regard to the acquisition of land purchased for public use. Motion carried unanimously. G. NE41 BUSINESS: Ordinance for Introduction: Ord. #_ amending LA.H Municipal Code as it pertains to dog licensing fees. G Mr. Crenae noted that the proposed Ordinance would raise the fees for dog licenses from the present $4.00 to MOO, which was requested by Santa Clara County, and which would bring the fee in line with all ether cities within the County. At the request of Council, Mr. Crowe read the title of the proposed Ordinance. Councilman Grabowski moved, seconded by Mayor Cheney, and unanimously carried to waive further reading of the Ordinance. Councilman Grabowski moved, seconded by Councilwoman Hillestad, and carried unanimously to introduce the Ordinance by its Title. Councilman Grabowski: Councilman Grabowski requested Council consideration of his proposal to establish the former Ad Hoc Committee on Legislative Reviera as a Standing Committee, because he felt it important that the Town reii.ain in close contact with the Legislators in Sacramento. He suggested that Councilman Brown and Councilwoman Hillestad be considered as the Council's representatives on this committee since both wore interested jr. the legisiativz process. Councilman Grabowski gave a brief summary of the duties of such a Committee, and re- quested favorable action by Coaocil on the matter. Council concensus was to direct Staff to prepare the proper Resolution which would create such a Standing Committee for presentation to Council as soon as possible. -9- CITY COUNCIL MINUTES - June 2, 3976 NE11 BUSINESS (Cont'd): Mayor Cheney: Mayor Cheney noted that a resignation had been received from Commissioner Schick, relative to her appointment to the Planning Commission. He felt that, in view of the fact that Mrs. Schick was presently in the hospital, that Council should take no action on the letter of resignation until she was feeling better, at which time, she might want to reconsider her letter. Council concensus was to agree, and directed the City Manager to have flowers sent to Mrs. Schick in the hospital on behalf of the Council. Councilman Graboejski: Requested status of draft Ordinance Council had directed to be prepared relative to street excavations. Mr. Crowe noted that the City Attorney was in the process of preparing it, and would have it btfnre Council as early as possible. Councilwoman Hillestad; Noted that she had received several telephone calls about the iaestwin Barn, and wondered if the City Manager could instruct the 11aintenance Crew to board the windows for the tir�.e bring. Mr. Crn•ae noted that this matter had been taken care of today. R.
