Mayor Pro Ten Leslie Helgesson called the regular meeting of the City Council to
order at 7:39 P.M. in the Council Chambers of Toi;!n Hall, 25379 Fremont Poad:

R. CONSENT CALENDAR:
At the request of Councilwoman hiller, Items 3 a) and b) were removed from the
Consent Calendar for separate consideration.
MOTION SEWED AIHD CARRIED! Councilwoman hiller moved, seconded by Councilman
Cheney and unanimously carried to approve the remaining items on the Consent
Calendar, namely:
1. Approval of Minutes: August 2O, 1975 (Renular Meeting)
2. Approval of "arrants: 414,509.70.

Commissioner Hillestad and Town Planner Ven Pastrof responded to Councilwoman
Miller's questions concerning the motion made by the Planninn Commission
renardinn the easements, in that the Commission felt that easements requested
,,ere an undue burden on the property owner.
After discussion, Councilwoman Miller moved, seconded by Councilman Cheney
and unanimously carried ,o '^^—v2 the request for Building Site Approval,
Lands of Jensen, as recommended by the Planninn Commission.

b) Accepted Tentative 11ap, LANnS OF BROHH-HUBMTH2O16-75, Sandis Assoc.,
Engineers:
Councilwoman Miller questioned the need for a conservation easement being
required on this subdivision, since the terrain precluded the building
of any additional structures. She also noted that Lot 1 would be paying
all of the costs for the installation of water lines, and wondered if
there could be a reimbursement agreement so that some of these costs would
be returned to the owner of Lot I.
She also thought the road in -lieu fees were punitive in that there vias no
access from Elena Road for the lot in question. She questioned the need
for a geology report in light of the Environmental Impact Report.
Discussion ensued between Council, Staff, and the applicant's engineer,
Hr. John Humber, Sandis Associates, relative to the conservation easement
and whether such an easement were necessary. Other alternatives were
discussed, including the filing of a Declaration of conditions, re-
strictions, and covenants pertaining to the development of Lot 2.
City Attorney Frank Gillio stated that Council did not have direct control
4Wover water requirements; that this rested with a Special District. He
did say that a Hater Reimbursement Agreement was possible if it were
approved by the Uater District.
Discussion continued on the water charges and road in -lieu fees, and lir.
Ken Pastrof stated that the geology report was required, citing a
typographical error In the Environmental Impact Report.
Councilman Cheney moved, seconded by Councilwoman Hiller to approve the
Tentative Man, LANDS OF BROHM-HUBB, subject to the conditions recommended
by the Planning Commission, but deleting the requirement for a Conservation
Easement and adding the condition that a Declaration of Conditions, Re-
Strictions and Covenants with regard to the development of Parcel 2 be
submitted at the time of filing the Final Hap which would be based on
the final determination of the Health Department concerning the building
elevation line. Motion carried by the following roll call vote:
AYE: Councilman Cheney, Councilwoman Miller, mayor Pro Tem Helgesson.
NO: Councilman McReynolds

Mayor Pro Tem Helgesson read the Proclamation issued by Mayor Grabowski in
which he had proclaimed the Month of September as "Constitution Observance
Month," and presented the Proclamation to Mr. Harold Lesser, Chairman of

of the Constitution Observance Committee.
Mr. Lesser thanked the flavor and invited Council and members of the Public to
celebrate the signing of the Constitution at a Program to be held on Tuesday,
September 30, 1975 at Flint Auditorium, neAnza College, Cupertino. The time
is 7:30 P.H., and admission is free.
C. SPECIAL REPORTS:
1. Reports of Standing Committees:
a) Traffic and Public Safety Committee - Mrs. I. Goldsmith, Chairman:
Following is a verbatim transcription of the report submitted by the
Committee which Mrs. Goldsmith requested be entered into the record:
"I have spoken on the need for basic improvement and safety in our trans-
portation system consisting of narrow winding roads Plus adjacent Town
Paths. Town Paths along our paved roads are not being maintained, there
are many missing sections resulting suddenly in no path continuityc this
endangers the safety of those pedestrians, equestrians, joggers and
bicyclists; there are many more children using oaths to walk to school in
the L.A. District since there are no bus services offered this year.
"Let us then honestly face the Tovm responsibility to provide for a con-
tinuous Town Path system, certainly alonn our main well -travelled paved
roads where people must travel to their work, schools, shopping, other
business. Now radar can be used as of July 7, 1975 and this should be
expedited with no further delays. This may bring certain resentment with
citations for speeding violations, but it is also expected that there will
be increased revenues and better control with no larger law enforcement
staff. The Town receives from the county WZ of fine and forfeitures now
noina into the General Fund to he used for miscellaneous expenses. It is
fair to return this income in fines derived from traffic violations,
placed in a Special Fund and used to improve the very situation of traffic
need and safety. Resentment would, naturally, be far less if those thus
cited knew that such monies would be used for their own and that of their
loved ones safety while using Town Paths. Additional building to shore
un the missing connections, adequate maintenance, clearance of brush,
poison oak, large boulders, signs, etc. will do a nreat deal to olcase
residents. Only after Town Paths are brought up to par for safety and ease
of travel should these funds be used for general road improvement where
they would be most insignificant.
"Traffic and Public Safety recommends: Revenue developed from use of radar
and other traffic fines be nut in a Snecial Fund rather than the Present
General Fund; fund be used in building and maintaining in good condition
(E the Torn Paths adiacent to, elevated or below as the terrain permits,
the Town's paved roads in general busy use, that brush, thistles and
poison oak, boulders, Binns, etc. be cleared for the safety and ease of
travel for equestrians, pedestrians, joggers and bicyclists. Motion by
Ryiell, second Stewart, yes unanimous passed.

"It is suggested that the use of radar publicity for the Town he re-
leased with this resolution, if passed by Council and legal advice,
simultaneously to offset the effect of the radar announcement."
Sneaking from the Floor:
I"rs. R. joy n2 Hilltop Drive: Expressed concern for children who most
wa k or ri a bicyc es to sc ool now, particularly in the Summerhill Rd.
area of the Town. Requested that a pathway be installed for their safety
and protection.
Mrs. Jean Struthers, Robleda Rd: Concerned over the shoulder area of
roads in many Parts oTown where children could not get safety out of
the way of on -coming traffic because of the unsafe conditions which existed.
She urged Council to consider favorably the recommendation of the Traffic
and Public Safety Committee.
I•Irs. Sue Mansene, Summerhill Rd: Commented that she had had many dis-
cussions with Suoervisor teinberg and others in the County regarding the
unsafe conditions of the pathways along Summerhill and supported the
recommendations of the Committee.
Discussion continued between Council and Staff regardinn the pathway
situation along Summerhill, and Bayer Pro Tem Helgesson instructed the
Citv Manager to tall: with the City of Los Altos and the County of Santa
Clara with renard to this matter.
Mrs. Gloria Parks, Templeton Place, Los Altos: Spoke regarding the paths
along Robleda Road. Suqqes a homeowners be notified as to what their
responsibility was in the upkeep of pathways.
Fars. T. Schick, Weston Road: Suggested an article be contributed to the
homeonwer s Assn. news etter regarding the pathways. Mayor Pro Ten
Helgesson requested that the City Manager see that such an item was sub-
mitted to the newsletter.
Councilman McReynolds felt the points raised this evening were good ones
and should be considered along with traffic control. He spoke regarding
the upgrading of Town naths in leveling some areas and clearing the
weeds and possibly extending the road for bicyclists.
After further discussion, Mr. Crowe was directed to report back to Council
at the next meeting as to how the upgrading of the paths and setting aside
traffic fine revenue would affect the budget. Council accepted the
Committee's report, and directed that their recommendation be placed on
the Agenda for the next Council meeting for further consideration.

of Santa Clara for the sum of 4390.00. Motion carried unanimously.

3. City Planager: Street Resurfacinn Proaran 1975-76.
Iir. Crowe corrected his Plemo to Council wherein it was stated that
t10O,000 had been budneted for street improvements, and said the correct
finure should be $170,000. He reported that subsequent to the adoption
of the budget figure, Elena Road, from Robleda to Orowne's Hill was
added, which was approximately 1950 lineal feet additional.
P:r. Crowe also recommended that the balance of Miranda Avenue be included
from Carado Court to Estacada, and Chapin from Robleda to Burke. Ile
also reported that, in conjunction with the overlay nrogram, several shall
drainane improvements would he installed, the funds coming from the To m'
Drainane Fund.
Council requested that the City Manaqer investigate the possibility of
overlaying Town paths at the same time, and P1r. Crowe said he mould in-
vestigate the matter and report back to Council.
MOTION SECONDED AND CARRIED: Councilman Cheney moved, seconded by Councilwoman
Miller and unanimously carried to adopt Resolution 1901 ordering the performance
of certain work and directina the solicitation of bids for the 1975-75 Street
Resurfacing Proqram.
F. SPECIAL ORDERS:
1. Request for relief from Check List Condition reg Road Improvement: !Ir.

Discussion ensued between Staff, Council, and 11r. Jones concerninn the re-
quirements of the Tman's Ordinance and whether it applied to an individual
developing his property as opposed to a subdivider. In response to a question
from Council, Mr. Russell, City Engineer, stated that the fee required in this
condition was to brinn the surface of the roe." un to Town standards.
Councilman Cheney sugoested that the road in -lieu fee be lowered to the cost
of resurfacing as opposed to brinninn the road un to Torn standards. This
anoint was determined to he 1900.00. Councilman Cheney made this into a
motion which was seconded by Councilman McReynolds and unanimously carried.
This condition will replace the condition on the Check List regarding road
in -lieu fees.
2. Request for exen?tion from subdivision moratorium, LAMS OF STOtlEBROOK
Mr. Crowe stated that this matter was before Council, having been for•+jarded
by the Planning Commission. The Commission, at their last meeting, had

recommended anproval of the request.
MOTION SECONDED AND CARRIED: Councilwoman Miller moved, seconded by Councilman
Cheney and unanimously carried to approve the request for exemption from the
subdivision moratorium, LANDS OF STONEBROOK #2.
F. GENERAL ORDERS AND UNFINISHED BUSINESS:
1. Request by Foothill Construction Company for abandonment of, and
sition of real property, Robleda Road east of Alta Tierra Road:
fir. Crowe stated that the above request had been received by the Town, and a
Memo had been forwarded to Council from the City Engineer explaining the
reason for the request. He said that if it was Council's desire to consider
the matter further, a motion directing Staff to proceed was in order.
MOTION SECONDED AND CARRIED: Councilwoman Miller moved, seconded by Councilman
Cheney and unanimously carried to accept the concept of the request for abandon-
ment of real property and direct Staff to proceed with the preparation of the
necessary paper wort; for Council consideration.
G. NE4 BUSINESS!
1. Ordinances for Introduction:
Ordinance # amending subsection (b) of Section 4-2.116 of Chanter 2 of
Title 4, and—subsection (c) of Section 6-4.119 of Chapter 4 of Title 6 of
Los Altos Hills Municipal Code.
Mr. Crowe explained that this Ordinance would amend two sections of the
Municipal Code, the first to allow for a faster response to the Fire District
for weed abatement; the other section relating to new septic tank permits to
require a re -issuance of said permit after one year.
Councilwoman Miller requested that Staff indicate what a new Ordinance re-
lates to v!hen doing an Agenda for public information purposes.

MOTION SECONDED AND CARRIED: Councilman Cheney moved, seconded by Councilman
McReynolds and unanimously carried to waive further reading, of the Ordinance.
NOTION SECONDED AND CARRIED: Councilman Cheney moved, seconded by Councilman
McReynolds and unanimously carried to introduce the Ordinance by Title.
