MINUTES OF A REGULAR MEETING
September 5, 1973

Mayor Leslie Helgesson called the regular meeting of the City Council
of the Town of Los Altos Hills to order at 7:55 P.M. in the Council
Chambers of Town Hall, 26379 Fremont Road, Los Altos Hills, California.
A. ROLL CALL:
Present: Councilman Grabowski, Councilwoman Miller, Mayor Helgesson.
Absent: Commissioner Lachenbruch for the Env. Planning Commission,
B. SPECIAL PRESENTATION:
Q At the request of Mayor Helgesson, the Special Presentation was
delayed until later in the meeting. The Mayor took this time to
introduce the new City Attorney, Mr. Frank Gillio, replacing
Mr. Robin Faisant who resigned his position as of Sept. 1, 1973.
C. CONSENT CALENDAR:
At the request of G. Ferrari, Item 3 was removed from the Consent
Calendar for separate discussion.

Calendar for separate discussion.
Item 2 was removed from the CONSENT CALENDAR at the request of
Councilman Grabowski.
.MOTION, SECONDED AND CARRIED: Councilman Grabowski moved, seconded
by Mayor Helgesson and carried unanimously to adopt the remaining
item on the CONSENT CALENDAR, namely:
4. Resolution 716 indicating the Building Permit System and Review
Procedure in Flood Prone Areas:. and
Resolution No. 717 indicating the Building Permit System and
Review Procedure on Mudslide Prone Areas.

ITEMS REMOVED FROM COP!SEP!T CALENDAr,' FOR SEPARATE CONSIDERATION:
1. Approval of Hinutes:
In the Minutes of August 15, 1973, Item C - Presentations from
the Floor, page two: The meeting attended by Mrs. Florence Fava,
Town Historian, took place in Menlo Park and not San Jose as
noted.
Under the same Item on page 3: Mrs. Dorothy Gray represented the
Santa Clara County Historical Heritage Commission (Heritage had
been omitted from the Minutes).
Under the same Item, page 3: The LAH Historical Site in question
is the Juan Prado Mesa Adobe. Prado had been misspelled and the
word "Adobe" had been omitted.
The other meetings held by the City Council should be changed to
"Adjourned Meetings,' and not "Special" Meetings as indicated in
the r1inutes.

Councilman Grabowski and unanimously carried that the Minutes of :he

MOTION, SECONDED AND CARRIED: Following questions pertaining to
specific war ants, Councilman Grabowski moved, seconded by flayor
Helgesson and unanimously carried to approve the Uarrant list
totaling $15,500.11.
3. Notion approving Sewer Reimbursement Agreement, Almond Estates
Subdivision (367-70), Gerald B. Ferrari.
;ir. Ferrari told Council that he was ^eov2sting their approval
of this agreement so that it could be signed by Staff, but
since he had just received another request for an additional
sewer hook-up off his line, the n,^ice woulri be adjusted accordingly
if the "gentlemen's agreement° :cent through as anit'An, ted. In
this case, an addendum would be added to the Reimbursement
Agreement with the Town.
Mr. Gillio, City Attorney, advised tiia Council that the Agreement
might be approved with an addendum to the Agreement being
approved at the next Council meeting.

,LOTION, SECONDED AND CARRIED: Councilma Grabowski ;aovad, seconded
by Councilwoman Puller and carried unanimously that the Agreement be
approved with the understanding that the Addendum would be reviewed
and approved at the next Council meeting.
END OF CONSENT CALENDAR
At this point, Mayor Helgesson wished to insert an Item in the Agenda,
asking Mr. D. Spencer to report to Council on the meeting of the Planning
Policy Concntte2. of Santa Clara Country (PPC) oihi'ch'he a?tart'ed•receritl.y
as the To,an reprosentative.
Mr. Spencer reported on the voting structure now being considered by the
PPC and said he woula like Council's opinion or weighted voting. .After
some discussion the Council concurred that the PPC should I:eep their
members confined to two per community, and were also against weighted
voting.
D. PRESE•!TATIONS FROli THE FLOOR:
`, 1. Mr Dan Haney, Liddicote Circle: Mr. Haney p•atitioned CovnCil to
waive a penalty imposed on him by the Town because of his fa{lure to
take out a building permit for the decking he was installing around
a pool. He contended that he was not informed by his contractor that
another permit was required. This was th^_ second time -1r. haney
appeared before the Council, the Previous occasion bain when ns
requested a waiver for failing to take out permit before construction
began on his pool.
Mr. Gillio explained Section 9-5.227 of the Code to the Council and
a discussion ensued regarding the ambiguity of the Code. Mr. Oillio
was asked to look into this matter and to make recommendations which
would clari4, Lhe Code so that such cases as Mr. Haney's did not
become routir:a.
Councilman Grabows!J also felt that the homeovnier should not be fined,
but that :ha contractor, whose negligence it was, ba the person or
whom the fine should be imposed.

Councilman Grauows!:i and unanimously carried to waive the penalty
invoked on Mr. Haney by the Town.

2. Nr. Gerald Ferrari, Altamont Road:
a. Abandoned Autos: Mr. Ferrari told Council there was a
constant problem of abandoned autos being left on the property
adjoining his and asked Council to consider adopting an Ordinance
similar to Palo Alto's to alleviate this problem in the Town.
Mr. Gillio explained that in order to qualify for use of funds
available to haul away abandoned autos there must be a local
ordinance that complies with some sections of the --tate Vehicle
Code.
The Council requested that a copy of Palo Alto's ordinance be
obtained so this matter could be further studied.
b. Unsafe conditions on Moody Road: Mr. Ferrari thought there
should be a guard rail placed along Moody Road by Foothill
College to prevent cars from going over the embankment. 'Ir.
Faisant commented that one of the reasons a guard rail had not
been placed there previously was to prevent head-on collisions.
c. Landscaping of divider strip along El Monte: 'lr. Ferrari
pointed out the poor landscaping along this divider strip.
Councilwoman Miller agreed, and Council referred this matter to
the Environmental Design Committee for further consideration.
3. Joseph Dochnal, Central Drive: Suggested a stop sign be planed
at the intersection of Page Mill and Moody Roads. The Staff was
asked to research the question of whether this was Town or County
property and inform Council so steps could be taken to eliminate the
hazards at this intersection.
There being no further presentations from the floor, Mayor Helgesson
inserted Item 3 of the Agenda, Special Presentation.
In recognition for his fifteen years of service to the Community, a
plaque was prosented to Mr. Robin Faisant by the Town. Mayor Helgesson
thanked Fir. Faisant for his help through the years on behalf o' the
Community., and wished him success in his private law practice.
E. CONTINUING BUSINESS:
1. Submission of bids for Town Hall expansion:
Flr. '!inckley, Architect, was asked to report on the bids submitted
for the expansion of Town Hall. He reported that only three bids
had been received. Low bid was submitted by Victor Bellomo, and
44r the bid was $35,734.

OF eight companies asked to submit bids on the fire sprinkler system,
only one was subcritted by Fire Hatic. for ^410,735.
Mayor Helgesson suggested that no decisicn be mad_ regarding these
bids unt1 Council had reviawed them further in Executive Session,
after which a decision would be made.
2. Discussion of Historical Sites:
Mrs. Fava, Town Historian, came before Council to furtl.a:r exolain
the necessity of having more help with her work as historian: her
reasons being preparations to he made for the Jubilee coming up in
1976, the State Historical Heritage Commissior„ end the research
required of local historical sites.
After discussion, Mr. Lawson :as requested to in'roduce itrs. Fava
at the next Environmental Design Comaittes meeting to see if that
Committee might further assist itrs. Fava in her efforts. Tt was also
suggested that per once belonging to ties Town's Historical Society

Society.
3. Campaign Spending Ordinance:
.dr. Lawson, City tianager, gave backgroune of Ordinance and discussed
present bills now pending before the Stave Iecisl;.tune; namely:
SB65 and SB353.
Councilman Grabowski asked Mr. Gill in what the status of a locai
Ordinance would be if tha State adopted a similar bill.
.1r. Gillio advised that any such local Ordinznce would be nul Wied
if the State passed a similar bill.
Council agreed there would be no further discussion of a Campaign
Spending Ordinanc pending a move by the Stata ;.:n4slature to enact
one of the bills row before that holy.
4. Brush -Chipper Service:.
Mr. Lawson revie�.aad his Memo to the City Council regardino the
Brush -Chipper service he proposed last mazting.

After discussion, Council agreed to inplement the service on a
trial basis until the end of December to see hose it would work
out, at which time this item wouid be reviewed. 'Er. Lawson was
also asked to take a noise level reading on the Brush -Chipper.
G. CURRENT BUSPESS:
Councilwoman hiller re,ortea on hp- trip to Sacramento with the
City Manager recently regarding the landscaping of Interstate 280.
She repo+,ted that Redwood trees wcuid b® available in December and
would be planted by the State along the sight -of -wry. reel riould

J. STAFF PEPORTS:
1. Jr. Alexander Russell, City Engineer, reported on his meetinr of
".urust 26th c!ith the Santa Clara County Flood Control District.
He,stated that three people from the audience spoke in opposition to
the plan proposed by Oistrict engineers, and tl.ree people spoke in

avor. After discussion the Coard unanimously a?nroved the plan. The
district will advertise for bids to be accepted by the Board and
opene•' around t".,e middle of October. Tile contract for the work is
to be sehel-M ed over avprroximately Me, calendar. days.
2. iir. Russell reported to Council that the paintinC of the school
cross -walks should be completed ro let=r than the first part of next
week. TheCompariY machine had broker down; causin^ a delay.
3. iIr. Russell reported on the cost of p�vin2 El Nonte Road to
IS20 in conjunction with the City of Los •1tos. He stated `..hat the:
City of Los Altos had rejectec. all bids anCi would call for further
kids in the Sprint. lir. Russell said that he woul determine the exact
costs for the overlaying of El Monte and report back to Council.

J. STAFF REPORTS (coned):
City Manager, fir. Bruce Lawson:
1. Explained that the extension granted on the filing of the final
map on the lands of Costello by the Council was void since the time
that had lapsed was beyond the limit permitted by the Town. The
owners had been apprised that a new tentative map would have to be
filed, and the Town Historian had also been so informed.
At this point, Councilman Grabowski mentioned the letter written by
J. R. Nabera regarding the motorcycle riding on the Bullis School property
and requested some discrete patrolling by the Santa Clara County Sheriff's
Department during the hours when the violations occurred. Staff was
instructed to contact the School District regardinq the posting of signs
in an effort to eliminate this situation.
K. EXECUTIVE (PERSONNEL R LITIGATION) SESSION:
The Council adjourned to Executive Session at 11:00 PM.
4W L. ADJOURNMENT:
Council reconvened at 11:35 Phi at which point it was announced that
all bids on the expansion of Town Hall w=,;^e rejected, and that it was
the decision of Council to receive new bids for this expansion on
or before January 20, 1974.
The meeting was adjourned at 11:40 PM.
