Helgesson called the Adjourned Meeting of the City Council to order at 4:00 Ptd in the Chambers of the City Council, 26379 Fremont Road, Los Altos Hills, California. A. ROLL CALL: Present: Councilmen Cheney, Grabowski, McReynolds, Councilwoman Miller, Mayor Helgesson. B. CURRENT BUSINESS: 1. Adopt Ordinance No. 214 being an Ordinance of the Town of Los Altos Hills amending Chapter 6 of Title 3 of the Los Altos Hills Municipal Code entitled "Sales and Use Taxes". ` Mr. Frank Gillio, City Attorney, stated that this was the second reading of the above Ordinance in order to insure that it is in effect by January; otherwise, the Town would lose this revenue from the State. MOTION, SECONDED AND CARRIED: Councilman Grabowski moved, seconded by Councilman Cheney and unanimously carried to adopt Ordinance #214. 2. Approve agreement between the Town of Los Altos Hills and Mr. William Henry relative to the purchase of 2.03 acres (M.O.L.) of open space located on Purissima Road adjacent to the Little League Ball Field for $10,000. Mayor Helgesson said that Mr. Lawson, City Manager, had been asked to enter into negotiations for said property with the present owner, Mr. Henry. City Manager, Mr. Bruce Lawson, stated that he had talked with the owner who agreed to sell the above mentioned property for the sum of $10,000 with the stipulation that the Town obtain ingress and egress to another parcel owned by Mr. Henry on the opposite side of IS280, which presently is land -locked. Mr. Lawson said that this easement could be granted to him when either of his present neighbors come in for subdivision. �. At the request of Mayor Helgesson, Mr. Lawson showed a copy of the Assessor's parcel map to Council. CITY COUNCIL MINUTES - November 14, 1973 Adjourned Meeting Councilman Grabowski asked how the Town intended to provide access for Mr. Henry's porperty on privately owned property, and if this would not fall under eminent domain. City Attorney, Mr. Frank Gillio, explained the agreement and the legality of the Town entering into such an agreement. Councilman Cheney said he did not feel that this was a matter that should be discussed at this meeting. He objected to the terms of the agree- ment and asked if the Town did not have an Open Space Committee that could take the matter under study. Councilman Cheney then motioned to agenda this matter until next meeting. Councilman Cheney seconded the motion. Councilman ficReynolds agreed with Councilman Cheney but thought the matter should be referred to the Planning Commission. He inquired as to how long the offer would be good. Mr. Lawson stated that since Mr. Henry was also offered more money from another party, he thought the offer would be good for the day only. Mrs. Miller said that it was her understanding that Mr. Lawson was to ` proceed with an agreement if it fell within a certain amount and she could not understand Council's change in thinking. Mayor Heigesson said that this was a matter of urgency because of other offers, and his feeling was that the City Council should act on the agreement at this meeting. Councilman Grabowski said that he would not be willing to vote for the agreement in view of the conditions set forth therein - namely, the egress and ingress to other property owned by Mr. Henry. Councilwoman Miller asked Councilman Grabowski if that particular re- quirement were reproved and Mr. Henry agreed, if he would be in favor of the purchase of this land. He responded affirmatively. Councilwoman Miller then amended the motion of Mr. Cheney's to ask Mr. Lawson to negotiate with Mr. Henry to delete the condition of ingress and egress on his other property. Councilman Grabowski seconded this amended motion and it was unanimously approved by Council. 3. Request for approval by Land Resources Corporation of Final Map of Matadero Oaks Subdivision (Cont'd from Nov. 7, 1973). Councilman McReynolds asked the City Engineer if the potential slide areas in the vicinity of the subdivision had been corrected, and about access restriction at the boundaries of Palo Alto. -2- CITY COUNCIL MINUTES - November 14, 1973 Adjourned Meeting Mr. Alex Russell, City Engineer, responded that the slide areas referred to can be corrected, and that there is a 5' access easement at the boundary of Palo Alto which is shown on the final map. Mr. Russell, at the request of Councilman McReynolds, pointed out all of the pathway and equestrian easements on the subdivision map. A question was asked about the size of lot 41, and Mr. Russell responded that he had talked with the Town Planner about this lot and it was Staff's opinion that this lot would have to be planned carefully, but it could be developed within the Town's acreage restrictions. At the request of Mrs. Miller, Mr. B. LaShell, Vice President of Land Resources, explained the charge of $25.00 made by that company on land owned by them in Palo Alto. He also said that this fee was being lifted. Mayor Helgesson asked the City Engineer to read a letter received that day from Mr. Charles Chastain of Land Resources, stating that the horse restrictions would be lifted from the Matadero Oaks Subdivision. Mr. Gillio assured Council that the lifting of the horse restriction pre- sented no problem in proceeding with the approval of the final map. At the request of Councilman Grabowski, Council was again apprised of their responsibility in approving the final map. Councilman Grabowski then moved, seconded by Councilman McReynolds to approve the final map of the Matadero Oaks Subdivision. Mr. Robert Stutz, Chairman of the Pathway Committee, speaking from the floor, said that because of the new conservation easement in the area of Matadero Oaks along Page Mill Road, the Committee had made certain recommendations regarding paths, but he realized that the request had been made too late to be considered. A representative of the subdivision stated that the developers would be willing to meet with Staff and the Committee to determine what might be done at this point. After discussion about the new conservation easement, the consensus of Council opinion was that in view of the slides and slippage and ground disturbances in the area they could not go along with the Pathway's Committee's recommendations. Councilman Grabowski then called the question. MOTION, SECONDED AND CARRIED: Council unanimously approved the motion to accept the final map of the Matadero Oaks Subdivision. -3- CITY COUNCIL MINUTES - November 14, 1973 4 Adjourned Meeting C. ADDITIONAL BUSINESS: I. Councilman Grabowski: a. Asked that Planning Commission vacancy be filled at the next meeting of the Council on December 5th. Councilman McReynolds stated that at a joint meeting held by the Council and Planning Commission it had been decided to keep the member- ship down to seven, that there was already one member extra on the Commission, and that the Commission was to keep their present number until the next term expires. Councilwoman Miller agreed with Councilman McReynolds. The vote to discuss this subject at the next meeting was as follows: AYE: Councilmen Grabowski, Cheney, Mayor Helgesson No: Councilman McReynolds, Councilwoman Miller. 2. Councilman Cheney: a. Stated that Mr. R. Hahn of Esperanza Drive, a close neighbor of Town Hall, was in the audience seeking a solution to several problems that living within close proximity to Town Hall presented. Mr. Hahn introduced himself and stated that six neighbors felt abused by Town Hall since June. Mr. Hahn listed the complaints which were: early morning starting of equipment, garbage pick-up as early as 3 AM, and mosquitos. He stated that some of the conditions had improved, such as the tree cuttings and weeds which had been in the back of Town Hall, but the early morning noise had not been abated. The City Manager said that Council had asked him to seek alternatives in the location of a corporation yard for the Town, and he had investigated the possibility of the property owned by the Los Altos Fire Department that might be leased by the Town for a yard, along with other property. Mr. Lawson said that alternatives and recommendations would be available at the Council meeting of December 5th. Councilman Cheney said that the Town could not violate its' own Ordinance regarding the operating of equipment and noise. Councilwoman Miller stated that Mr. William Minckley, Architect, had been asked to design a noise wall as a possible solution to the problem and that the plans would be submitted before the next Council meeting. -4- CITY COUNCIL MINUTES - November 14, 1973 Adjourned Meeting Councilman rmbuwski stated that he would be against moving the cur Pa.ulion yard because of possible vandalism in more isolated areas of the Town, and he felt that an accoustical wall would solve Mr. Hahn's problem. After further discussion, Staff was asked to submit a report on an accoustical wall between the Hahn property and Town Hall for the Council meeting of December 5, 1973. 3. City Engineer: Mr. Alex Russell asked that three public hearings for a division of sewer assessments be scheduled for the next Council meeting. Two of the divsions are for Sewer Assessment District 09, and one for Sewer Assessment District N4. Mr. Russell also informed Council that the County Flood Control and Water Conservation District was now undertaking a study of the flood waters in Adobe Creek from El Camino to the headwaters of the creek. There being no further business, Mayor Helgesson adjourned the Council to an Executive (Personnel) Session at 5:25 PM, stating that the next meeting of the Council would be Wednesday, December 5, 1973.
