HomeMy WebLinkAbout04/26/1972CITY COUNCIL TOWN OF LOS ALTOS HILLS MINUTES OF A SPECIAL MEETING April 26, 1972 REEL 42 Side 2 Track 2 00-30 Mayor Leslie A. Helgesson convened this special meeting at 7:48 P.H. at Los Altos Hills Town Hall, with the following members answering roll call. Present: Councilmen Davey, Kubby, Miller, Mayor Helgesson. Absent: Councilman Grabowski. Mayor Helgesson announced to the approximate 100 citizens that had turned out, that he had called this special meeting in accordance with the Town's Municipal code for the purpose of a special litigation session, regarding the pending suit against the Town, that resulted from the formation of Sewer Assessment District #9. Prior to adjourn- ing to the Litigation Session at 7:50 P.M., the Mayor noted that as the agenda indicated, it was the Council's intent to reconvene following this closed meeting to consider the Town's sewer policy (Resolution No. 458). Upon reconvening at 5:55 P.M., Mayor Helgesson reported that the Council had met with the Town's attorney J. J. Lynch to discuss pos- sible areas of agreement in the suit: Mr. Lynch had then met with Mr. Michael Di Leonardo, Attorney for the plaintiffs, to determine any areae of agreement; and then the Council had met jointly with both attorneys. The Mayor stated that "the Council had found no areas of agreement on which we can agree as to the disposition of the suit, 90 we feel any further discussion at the Council level or between the audience and the Council would not be pertinent to our business to- night." Also he noted that Councilman Grabowski who was in Sacramento attending the League of California Cities Legislative Conference, had requested and Council concurred that they would not take any action in regards to the Town's Sewer Policy tonight. Since several residents had indicated their displeasure at calling a Special Meeting on short notice (32 hours) to cnnsider a controversial issue, Mayor Helgesson recognized Councilman Miller who then read the following applicable paragraph from the Municipal Code regarding Special Meetings. TITLE 2. ADMINISTRATION Sec. 2-1.102 Special Meetings. Special meetings may be called at any time by the Mayor, or by four (4) members of the Council, by delivering personally or by mail written notice to each councilman and to each local newspaper of general circulation and radio and televi- sion station requesting notice in writing. Such notice shall be delivered personally or by mail at least twenty-four (24) hours before the time of such meeting as specified in the notice. The call and notice shall specify the time and place of the special meeting and the business to be transacted. No other business shall be considered at such meetings. Such written notice may be dispensed with as to any Councilman who, at or prior to the time the meeting convenes, files with the City Clerk a written waiver of notice. Such waiver may be given by telegram. Such written notice may also be dispensed with as to any Councilman who is actually present at the meeting at the time it convenes. All special meetings of the Council shall be open to the public. (Par. 2 63 Ch.III. Ord. 171. %W She concluded by noting that this meeting had been called and con- ducted in accordance with the Town's Municipal Code and that contrary to rumors, there was no violation made. Mayor Helgesson thanked the large citizen turnout for their attend- ance and acknowledged that many of them would like to have spoken but reiterated that in view of the pending litigation, no useful purpose would be gained by a public discussion at this time.
