Benson called the Regular Meeting of the City Council of the Town of Los Altos Hills to order at 7:45 P. M. in the Council Chambers of the Town Hall, 26379 Fremont Road, Los Altos Hills, with the following members answering mil call: Present: Councilmen Corbett, Davey, Grabowski, Helgesson and Mayor Benson. PLANNING COMMISSION REPRESENTATIVE: Chairman Weisbart APPROVAL OF MINUTES: March 1, 1971 Councilman Helgesson moved, seconded by Benson and carried unanimously that the minutes of March 1, 1971 be approved as written. COMMUNICATIONS: 1. Mr. John Meccarello, 24699 Olive Tree Lane, requested attention to a cinderblock (Air wall erected by his neighbor, which is falling over and is considered dangerous. The Town Engineer reported that the neighbor, Mr. K. C. Imus,24627 Olive Tree Lane, has been advised and that he will take corrective action. 2. Mrs. Florence M. Fava submitted her resignation as Town Historian, effective immediately. 3. Mr. H. N. Reiser, 27660 Central Drive, requested that the Town make available to interested neighbors copies of subdivision tentative maps which have been filed with the Town. Council reconsidered this subject which had been discussed at the last meeting and concurred that staff, when possible, could order the drawing but the billing would be sent to the party requesting the maps. 4. Mr. J. R. Nabers, 13900 Fremont Pines Lane, objected to excessive noise from aircraft, minibikes, etc. 5. Information on "How and Where to Recycle in the Bay Area" was received and is available at the Town Hall. 6. Pacific Gas 6 Electric notified they have applied for an electric rate increase. 7. Palo Alto Mayor, Jack Wheatly, extended an invitation to all interested Council members to attend an informational tour of the Regional Water Control Plant on March 18, 1971. r 8. Assembly Committee on Elections and Reapportionment will hold a public hearing wft► in Sacramento on March 26, 1971. ANNOUNCEME9TS: 1, A Public Nearing will be held on March 29, 1971 at 7:45 P. M. at the Town Hall to discuss the financial crisis that the Town faces in meeting its contractual obligations with Palo Alto for sanitary sewer capacity rights, In addition to the discussion of the problem, possible solutions will be outlined. It was noted that no action will be taken since the intent of the meeting is to gather ideas and answer questions. UNSCHEDULED ITEM N0. 1: AFPOINT PLANNING COMMISSIONER TO FILL UNEXPIRED TERM OF DON T. RIMER. Council concurred to defer this item to the next regular meeting, April 5, 1971. UNSCHEDULED ITEM N0. 2: REPORT FROM PLANNING COMMISSION re: WILLIAMSON ACT. Staff reported that the Planning Commission, after extensive study of the Williamson Act, unanimously recommended that the Council take appropriate steps to establish the entire Town as an agricultural or open space preserve. The Commission had reviewed the resolution adopted by Portola Valley and concurred that this resolution, with appropriate changes, embodied the necessary points that would create a workable document for the Town of Los Altos Hills. The Planning Commission recommended that the Town consider contracting only with those parcels which are yet subdividable or those parcels yet unimproved to their fullest use in accordance with our current zoning ordinance. Council discussion concurred. MOTION, SECONDED AND CARRIED: Councilman Grabowski moved, seconded by Helgesson and carried unanimously that the City Attorney be directed to prepare a resolution that incorporates the entire Town under the Williamson Act and that it be submitted to the Council for review as a preliminary resolution at the April 5, 1971 meeting. It was noted that the Planning Commission is continuing their study on all other methods available for establishing open apace e.g. "open space easements". UNSCHEDULED ITEM NO. 3: REPORT ON OPEN SPACE - COUNCILMAN STAN CORBETT Councilman Corbett reviewed the status of the Town's open apace study that is being conducted by Mr. Charles McCandless. He reported that a map of the Town is being prepared which indicates those areae yet in open space. From this base map he proposed numerous planning areae be established and that representatives be selected from each one by the Council. Based upon guidelines as to the types of open space considered desirable by the Town, these representatives would than evaluate their assigned areas for available open space that could be acquisitioned by the Town as private funds become available. Once the priority grouping is established Mr. McCandless could then proceed with solicitation from interested citizens of gifts of land or monies. Since the map being prepared would soon be completed the Council concurred that further discussion of this subject should be agended at the April 5, 1971 meeting. dWAW -2- UNSCHEDULED ITEM NO. 4• REPORT ON NOISE CONTROL AT FOOTHILL COLLEGE - COUNCILMAN STAN GRABOWSKI Councilman Grabowski reported on a meeting he and Dr. Bob Ward of the Noise Abatement Committee had had recently with Foothill College representatives as a result of numerous complaints received following an "Auto Cross" rally held several months ago. He noted the cooperative spirit extended by the college in that all vehicles participating in future events will meet the requirements of the State Vehicle Code and that such events will be conducted in a manner least offensive to citizens residing in the area. UNSCHEDULED ITEM NO. 5• REQUEST FOR A REDUCTION OF CHARGES AGAINST RHOS RIDGE RANCHO SUBDIVISION Staff reviewed a request from Bassett Lane Associates for the Town to waive certain fees which were charged against the Rhus Ridge subdivision for work done in connec- tion with their five acre park donation along Adobe Creek. Council concurred that in view of the generous donation it would be inappropriate to charge the applicant with staff's time for the review and processing of the open space dedication. POTION, SECONDED AND CARRIED: Councilman Davey moved, seconded by Grabowski and `, carried unanimously by roll call vote that the Town Engineer and City Manager's time amounting to $260.00 be credited to the subdivision charges against the Rhus Ridge Final Subdivision Map. UNSCHEDULED ITEM NO. 6: REQUEST FOR PERMISSION TO BE OUT OF TOWN - CITY MANAGER City Manager requested permission to take one week of vacation - March 22 through March 26, 1971. POTION, SECONDED AND CARRIED: Councilman Corbett moved, seconded by Helgesson and carried unanimously that Mr. Fritschle be granted leave for one week of vacation March 22 through March 26, 1971. UNSCHEDULED ITEM NO. 7: STAFF REPORTS 1. The Town Engineer reviewed the status of the sewer pump installations in Rosehill Estates I and II. In addition, he recommended that the City Attorney be directed to take appropriate legal action if work on the incompleted subdivision improvements is not initiated within two weeks. 2. City Attorney reviewed progress of numerous suits pending in which the Town is involved. PRESENTATIONS FROM THE FLOOR: 1. Mrs. Edward Ginzton, 28014 Natoma Road, former chairman of the Pathway Committee, requested that the Council approve posting of bike paths as recommended by the Planning Commission in May, 1968. Council concurred that this request be referred to the Pathway Committee. -3- ` 2. Mrs. J. D. Steers requested that the Council override the Planning Commission requirement that all material be submitted 14 days prior to an agended date when a continuance is granted. She noted that this automatically entailed a 30 day delay regardless of how minor the reason for continuance. Council requested that Staff study this request and advise. ORDINANCES: 1. Ordinance No. 181, Second Reading, an ordinance of the Town of Loa Altos Hills re: Noise. Staff noted that there had been some questioning of the maximum decibel limits allowable that are shown in Section 4 of this noise ordinance. Mr. Don Miller, former chairman of the Noise Abatement Committee, requested that if specific limits were concluded to be incorrect, that they be changed now so that the Council could proceed with the second reading. Since no one present objected, the Council agreed to proceed with the second reading of the ordinance and allow it to be amended later if deemed necessary. The City Attorney read the title of Ordinance No. 181, An Ordinance of the Town of Los Altos Hills Prohibiting Conduct which Produces Noise Levels which Exceed Specified Standards, Providing a Schedule for Implementation, and Prescribing Penalties for Violation. MOTION, SECONDED AND CARRIED: Councilman Helgeason moved, seconded by Grabowski and carried by unanimous roll call vote that further reading be waived. 6 MOTION, SECONDED AND CARRIED: Councilman Davey moved, seconded by Helgeason and carried by unanimous roll call vote that Ordinance No. 181 be adopted as read. WARRANTS: MOTION, SECONDED AND CARRIED: Councilman Helgeason moved, seconded by Grabowski and carried by unanimous roll call vote, that the warrants as presented in the amount of SIX TUOU'^ IID, FIVE 1?21LRED T .TPITTY `UTE DOLLAPS and thirty Wo cents ($6,529.32) be approved and the City Clerk authorized to draw the appropriate warrants. OTHER BUSINESS BY COUNCILMEN: 1. Councilman Helgesaon suggested that the Council, in accepting the resignation tendered by the Town Historian, Mrs. Florence M. Fava, express thanks for her many hours expended in compiling and maintaining the Town 'a historical records. Council concurred. MOTION, SECONDED AND CARRIED: Councilman Helgesaon moved, seconded by Grabowski and carried unanimously that the City Attorney be requested to prepare a resolution of commendation for presentation at the April 5, 1971 meeting.
