MINUTES OF A REGULAR MEETING
April 1, 1968

Mayor Albert T. Henley called the Regular Meeting of the City Council of the
Town of Los Altos Hills to order at 7:68 P. M. in the Council Chambers of the
Town Hall, 26379 Fremont Road, Los Altos Hills, with the following members
answering Roll Call: Present: Councilmen Aiken, Benson, Davey, Fowle, Mayor
Henley. Absent: None.
PLARNING COMMISSION REPRESENTATIVE: Chairman W. F. Minckley.
APPROVAL OF MINUTES: March 18, 1968.
Upon Motion by Councilman Benson, Seconded by Fowle, the Minutes of
March 18, 1968 were unanimously approved as submitted.
i,PPROVAL OF MINUTES: March 22, 1968.
Upon Motion by Councilman Fowle, Seconded by Davey, the Minutes of
March 22, 1968 were approved as submitted by a majority voice vote, Councilmen
4W Aiken and Benson abstaining.
�a COMMUNICATIONS• 13` City Manager read the following communications:
1) Kenneth J. Dumas, M. D., 25446 Altamont Road, dated March 22, 1968, request-
ing that his property be included in Sewer Assessment District No. 2. Council
concurred that the Staff should advise Dr. Dumas of the formal procedures re-
quired to include his property in Sewer Assessment District No. 2.
2) 'Jilliz.-: J. Ruzicka, 26030 Newbridge Road, dated March 30, 1968, requesting
exclusion from Sewer Assessment District No. 3. City Manager noted this could
not be considered a formal protest since the Protest Hearing had been held
March 28, 1968.
3) Donald ,i. Spencer, 27490 Sherlock Road, dated March 27, 1968, weighing
certain fundamental factors concerning acquisition of land for open space and
recoe.¢aending that no further land acquisitions be considered until a poll of
the citizens has been made and long range priorities have been determined by
the Town.
Council concurred a long tange plan for land development should be reviewed
by the Planning Commission at its Study Session April 22nd, such review to be
considered in connection with the General Plan.
` 4) City wanager noted receipt of a suit against the Town filed by James J.

t, Garber, Jr. re: motorcycle accident on Viscaino Road on June 13, 1967.
Council concurred without objection to refer the matter to the insurance
carrier.

1) City Manager noted that the Santa Clara County Taxpayers Association's
4 Annual Meeting and Public Service Awards Banquet will be held Tuesday,
April 16, 1S63 at San Jose.
2) City Manager noted that the Inter -City Council will meet Thursday, April
1963 at Santa Clara.
3) City Manager stated that upon request by the Council, Staff had determined
that there are 313 existing residences in Sewer Assessment District io. 3. He
further stat_d that 152 letters of protest were received at the Protest Hearing
on March 28, 1968, representing 143 resid-ances. Therefore, 44.97% of the
resident homeowners in District No. 3 protestedthe formation of the District,
while 55.03% of the resident homeowners war& in favor of fornation of
District No. 3.
City Manager further noted that 32.95% of too land acreage in District Ho. 3
protested the formation of the District.
MOTION: Councilman Davey -.coved that the Staff conduct a mailing to residents
in Sewer Assessment District No. 3, giving a statistical breakdown on the
residents in waver and against the District and giving a summary of Health
Department information on failing septic systems, etc.
Mo ion died for lack of a Second.
MOTION SSCOIVDED r.ND CARRIED: Councilman Aiken moved, Seconded by Bowle, and
carried unanimously by roll call vote that the Staff conduct a separat_ mailing
to residents in Sewer Assessment District No. 3, at the sane time as the
"ailing of the asscssnant Notice, giving a summary of statistical information
relative to District No. 3 protests in regard to residences involved and land
acreage involved, and also containing an announcement of the availability of
Health Department findings in the Town Hall files.

PUBLIC HEARING - SLOPE DONSITY INTERIM ORDINANCE:

City Attorney introduced and read in its entirety Ordinance No. 13P., an ordinance
of the City Council of the Town of Los Altos Hills amending Ordinance No. 7u of
said Town by adding new sections thereto pertaining to minimum area of steep
lots and repealing Ordinance No. 135.

Mr. Frank Shrivcr presented a tape of Freeway noise levels. Mr. Miller noted
the Noise :;bot2ment Cmnittee would like to dovolop a ten minute oral and visual
presentation and requ_sted the Council to appropriate a maximum of $50.00 to
produce suc5 a documentary.

carried unanbiously by roll call vote, that the Council approve a maximum
appropriation of $50.00 for the Noise :abatement Committee.

the propos_d Council, with Floor participation by Mr. John Rutherford, Los Altos
Hills rspresontative on the Human Relaticns Conaittee, who expressed support for

City :attorney read letter from Wendell W. Roscoe, 12235 Tepa Way, requesting the
Town to enter into a. reimbursement agreement with him regarding sewers
previously installed in Pink Horse Ranch.
City Attorney noted thtn't the line installed by hr. Roscoe is a public sewer line
belonging to the Town. Council discussion enso.od with Floor participation by

carried unanimously, that the Staff be authoriz=_d to allow Mr. Crafts to
inAodiately connect to the sewer line installed by Mr. Roscoe, Fir. Crafts to
ba charged by the Town a connection charge not to exceed $756.80.
4 Council directed Staff to review the amount of construction costs to be
allocated, and to ascertain the area involved, number of connections, etc, to
be used in dwteridning the a=unt of reinbursenent.

REPORT. OF COM11ITTZa STUDYING OIKEEFE PROPERTY PURCHASE.
Mr. Milo G. Ertrard, 12760 Dianne Drive, Committee Chairman, reviewed tie
objectives and progress of the Committee and presented the following recom-
mendations: 1) that the O'Keefe property be acquired and retained by Los
Altos Hills on the open space concept, if possible; 2) that the purchase
from the State be made on an interest only agreement of 5 to 10 years duration.
Council extended its appreciation to the Cormnittee and referred the matter to
tie Sta.'f for further study and negotiation with the State.

City Managor roviewed signal maintenance agreements for three traffic signals

the signals for $c0.00 each per mond: And that Traffic Signal Repair Co„ Inc.
of Sunnyvale would maintain the signals for $52,92 each per month, noting that
