M. at the Town Hall, 26379 Fremont Road, Los Altos .Hills, California. ROLL CALL: .PRESENT: Councilmen Aiken, Bowler, Mayor Clayton ABSENT: Councilmen Fowle, Henley. PLsTNING.COMMISSION REPRESENTATIVE: ?falter A. Benson APPROVAL OF MINUTES: January 13, 1965• Action deferred to February 1, 1965 _ Meeting. COMMUNICATIONS: None. - ANNOUNCEMENTS: None. CJ COMMITTEE REPORTS: 1. Path Construction Priority - City Manager. The City Manager submitted to the Council a priority list for path construction, which was discussed -and recommended for approval by the Planning Commission at its meeting of December. 28n, with one addition, namely: 7A -- Westerly side of Fremont Road from-Robleda Hills Unit #2 to Robleda Road; Council will study the report and the matter will be taken up at the February 1st meeting. 2. Per .Lot Assessment - City Manager.' In compliance with the Council's request for an estimate as to the time involved on a per lot assessment study, the City Manager was of the opinion if a member of the Staff or an interested individual were available to work full time on the .project, it could be accomplished in 30 to 60 days; however, under the present'work circumstances of the Staff, it would - require four to five months. It .appeared to Councilman -Bowler that determining the "per lot assessment" figure was not the critical part, and that COMMITTEE REPORTS: Per Lot Assessment Cont'd.: perhaps the time and money spent would be researching the - wrong question. He was of the opinion it would be time �{ betterspent"solving the problem of administration and whether it was'within the resources of the Town to go into the contracting business. if this research proved feasible, them a rate could be set. - Shwas also suggested at the Council Table that an alternative of anoptional procedure could be worked out similar to "in lieu" payments, to be exercised at the option of the •Council; however, Mr. E. A. Breyman objected to this approach since he felt it would encourage .Planning and Council bargaining with the .developer. Since the Planning Commission has been asking for action for some time, Councilman i-iken felt a preliminary spot check :study, with some help to the Staff and for which he volun- teered to olun-teered-to help, should be made, on the administrative portion as well as the cost figure. The Mayor referred to the City _,attorney Mr. Breyman'.s inquiry as to what had been the problems of per lot assessment in. the past. Mr. Faisant stated previous ordinances dealing with per lot assessment had been drafted before his association with the Town, his first assignment being to repeal those �. pertinent ordinances; however, it was his understanding two factors caused then to be rescinded.: 1) Wliat figure is set and hoti,: to provide for contingencies. The .setting up of the machinery governing how the Town will spend this money,. as it puts the Town on a large scale businessof contracting. - Following ,points were discussed:. inherent unfairness to subdivider with small frontage and large in -tract improve- ments as it is unfair to the developer with large off - tract improvements and no in -tract improvements; future development will be in steeper terrain and that engineering problems might cause the figure to go beyond the per lot assessment and be not properly in the purview.of the Town; in advertising for bids, can the Town compete with the kind of price the developer could improve for;. and, ti -me element having improvements completed and the Town's liability.. ,The City Attorney stated a formal questionaire has been sent to other Cities inquiring how they have handled the subject of improvements. MOTION; Bowler; .SECOND: Liken; VOTE: Passed unanimously. 3. Traffic Safety Committee - W. R. George. Mr. W. R. George, Chairman of the Traffic and Safety Committee of Los Altos Hills, reviewed the Committee's report dated January 5, 1965, on file at the Town Hall. Mr. George also interpreted the "accident" map prepared by Committee Member, Mrs. lrthur Micheletti, for the period January 1964 to September 1964. In discussing Exhibit III, Immediate Hazards, the City Manager reported some items were solved; the paths. on TYiranda (p. 14) had been in existence for two years; and the signals on El Monte Road are nowbeing installed(p. 15). Mr. George was of the opinion the complaint form (exhibit I, C� p. 8) now in use, is thesolution for a great many of the complaints from the Town's people. Mr. George reviewed the future considerations and recommenda- tions, Items I through X (pp 4,5). Mr. George felt that the - proposed 1 or 2 man permanent traffic safety commission (Item IV) for daytime hours on the traffic problem would be in a position to conduct studies from where the Committee left -off, as this is a continuing project. Regarding Item V.(landscaping along roads), the City Manager stated that certain problems in this report are not con- trollable by ordinance as they are beyond the 80' triangle intersection setback as required by Ordinance. No. 78. In discussing Item IX (radar),- the City Manager suggested the Town purchase a spot light type radar, which does not require a straight road and is effective up to 500 feet. The cost (approximately $1,000.00) could be quickly paid for by the number of increased citations. Councilman Bowler immediately suggested this matter be placed on the next agenda for action; however, the matter was temporarily postponed to ascertain if other arrangements could be made. On behalf of the Council, the Mayor thanked Mr. George and his Committee for their noteworthy effort in providing a. .format for Council action. -3- COMI iITTIE ,RErOHTS: Traffic Safety Committee (Cont'd.): �} ACTION: That the Council wishes to-errress ,its deep appreciation to the Traffic and Safety Conrittee of Les Altos Bills, namely, W. MOTION: Liken; SECOND: Bowler;.VOTE: Passed unanimously. Inanswerto Mrs. E. Smith's inquiry as to the synchroniza- tion of the signal lights on 31 Monte, Councilman i:iken stated there has been alate delivery of parts and as soon as they arrive, -signals would be timed. OLD BUSINESS: 1. Cluster Use Permit - Howard Carver. l At the request of the Council, the City Manager contacted CJ the Santa Clara County Planning Commission regarding the use of. the common area. A cony of the format was obtained (includes development rights), but the specifics relating to the control of the common areas will not be spelled out until their January. 20m meeting. A Council reviewed the map and was informed by Engr. J. W. Riley, rer:resenting Mr. Carver, the 25 lots (27 acres) would not 'exceed the total coverage of one family per acre. There is a septic tank system with individual drainfields on each lot (YS, and in the event of any failure, there are. revokable drain£iel.d easements in the reserve areas adjacent to each individual lot. Thisreserve land would not be issued building permits until,such time as sewers are available. There will be an Improvement '.ssociation controlling limita- tions, rights, maintenance, landscaping and assessments. The Council did question whether there would be a path and trail easement leading to the Foothills Fark. The Mayor asked for comments from the Floor;. however, as there were none, the Council had no objection to the issuance of the cluster use permit. The City Manager will attend the Santa Clara Planning Commission meeting, January 20th. G -4- r` OLD BUSINse: 2. ,Ordinance No. 99 -. Troposed. Revision. :. The City Attorney reported that a draft of the proposed revision will be duplicated and forwarded to the Flanning Commission and Council for review before the first reading on February. let. - NEW DU�.;INESS: - 1. Planning Commission lnointments. In the absence of afull Council, the appointments were deferred to the February lot meeting. 2. Foothill Expressway - Approval of Flans. The City Engineer commented the -Foothill Expressway will border hos ;,1tosHills for a very short distance, but that slope easements will be required. The City Manager reported the 3xpressway will reduce eight lots within the Town. The City Engineer will. review the plans at closer length and check on the right=of-ways, to be reported on at the ?ebruary lot meeting. DIVISIONS OF ILND: Final MaLs. r 1. Brian requested that the original public utility easements. across lots a`1, 2 and part of #3 be abandoned, and the X''inalMap of Tract 11'3924, showing revised easements, be approved.
