MINUTES OF A REGULAR MEETING
December 20, 1965
The Regular Meeting of the City Council of the Town of Los Altos Hills
was called to order by Mayor Albert T. Henley, Monday, December 20,
1965 at ?:50 P. M. at the Town Hall, 26379 Fremont Road, Los Altos
Hills, California.
ROLL CALL: PRESENT: Councilmen Aiken, Clayton, Fowle, Mayor Henley
ABSENT: Councilman Bowler

ACTION:

COMMITTEE REPORTS:
1. Player Henley reported he had not been in contact with Foothill
College regarding lights at athletic events due topressure of
business and asked Councilman Aiken to accompany him when an
appointment can be arranged.
OLD BUSINESS:
1. Fremont Hills Development Co. - Drainage Agreement.
After numerous meetings, the City Attorney reported a compromise
has been reached and the 55,000.00 drainage deposit will be
released to the Fremont Bills Development Co. An additional
payment of 11,000.00 will be returned to the partnership for the
costs borne for the existing culvert, with a contract to be
drawn for additional reimbursement on a pro rata share on future
properties subdivided in this water shed. City Attorney recom-
mended the. Council proceed on this basis.
ACTION:
That the Council proceed as outlined by the
City Attorney.

Council instructed the City Attorney to drain up the Forementioned
contract.

NEW BUSINESS:
1. Los Altos Garbage Co. - Renewal of Contract.
City Manager explained there were .only two changes in the
renewal contract:
1) Duration of contract changed from 5 to 10 years;
2) Rate increase of 252 per month per customer.
ACTION:
That the Los Altos Garbage Co. contract be
renewed as submitted.
MOTION: Fowls; SECOND: Aiken
Councilman Clayton abstained from the voting due to a conflict
of interests.

VARIANCES:
1. Richard E. Gross (V-241-65) - Request for 10' Fence for Games
Court.
ACTION:
That the request of Richard E. Gross (V-241-65)
be approved, as recommended by the Planning Commission.
MOTION: Clayton; SECOND:. Aiken
Councilman Fowls requested his vote be recorded since his
interest of several weeks ago is no longer vested in this matter.
The Question was called: VOTE: Passed unanimously.
DIVISIONS OF LAND: Tentative Maps:
1. George Seidman (309-65) 3 lots - Engr. Coburn.
ACTION:
That the Tentative Map (Revised October 4, 1965)
of Foothill Meadows be approved, subject to the
Check List and approving Agencies, with in lieu
payment for path and the improvement of h of Josegha
Lane to Town Standards, and that Lot #,`-1 is not a
building -site until such time as sewers are available.

In accordance with the Planning Commission's recommendation,
the following .Motion was proposed:
ACTION:
That the City Engineer be instructed to make a
study of Josephs Lane as a possible assessment
district and report to the Council as soon as
possible.
MOTION:- Fowls; SECOND: Clayton; VOTE: Passed unanimously.
2. Wheeler, Oliver. P. (310-65) 2 lots - Engr. Mastin.
Due to business commitments, Mr. Wheeler has requested his map
be withdrawn and placed on the Agenda for the February 7t
meeting.
Since there has been considerable interest from property owners
in this subdivision and as a serious condition exists as to road
patterns, the City Manager most strongly recommended that the
City Engineer also be instructed to make an investigation of
the possible establishment of a plan line, service roads, etc. in
the area bounded by Moody, Page Mill and Altamont Roads.
ACTION:
That the City Engineer be instructed to conduct
study of the road pattern in the Altamont, Central
Drive, Page Mill and Moody Road area and have a
tentative report for the Council at the February 7t
meeting when the Wheeler map will be considered,
to be followed by a more detailed report as soon
thereafter as possible.
MOTION: Fowls; SECOND: Aiken; VOTE: Passed unanimously.
3. Stephen James (297-65) 2 lots - Engr. Riley.
ACTION:
That the Tentative Map, Mark IV, of Stephen James
(297-65) be approved, in accordance with the
recommendations of the Planning Commission and
approving Agencies.
MOTION: Clayton; SECOND: Fowle; VOTE: Passed unanimously.
In response to Councilman Clayton's questioning, it was
determined from Engr. Riley that the bridge is maintained by
the property owners and users:

�._). 4. Robert D. Clement (313-65) 4 lots - Engr. Riley.
Regarding Health Department's condition of approval, Item 2,
that the well on proposed Lot #4 be abandoned and sealed,
Councilman Aiken requested it be made certain the well is
properly sealed to protect the children from any hazard.
ACTION:
That the Tentative Map (Mark I) of Robert D. Clement
(313-65) be approved, in accordance with the Flanning
Commission's recommendations and the Check List.

5.George T. Hemmeter (289-64) 4 lots - Engr. Riley.
Always a matter of Council review is the Planning Commission's
recommendation, Check List and letters of approving agencies, but
because of the considerable interest shown by the surrounding
property owners, it is herein specifically recorded that the
recommendationsof the Planning Commission, Check List, and the
letters of the City Engineer and Fire Chief were read by City
Manager and the three-page comprehensive report from the Health
Department was summarized by the City Manager. Council noted
Health Department report was a full perusal of this subdivision
and the above documents, together with the governing ordinances,
would -allay any fears the interested property owners might have.
Since Mr. R. L. Jones, 10991 Magdalena Road, was present, Council
asked if he were satisfied with the conditions of approval.
Mr. Jones stated he wished to go on record that he is concerned
about the driveway bordering his property, but is sure the City
Engineer will give the interest indicated; Mr. Jones also men-
tioned that the easements over lots #1 and #2 remain:.
Council assured Mr. Jones that these easements must be removed
before the Final Map is presented to the Council.
Mr. Jones also pointed out there is a blind intersection at the
entrance of X Lane and Magdalena. Councilman Aiken suggested a
warning sign be placed at this point because of the number of
children and equestrians in this area. -
In lieu path payment was discussed and it was Councilman Liken's
opinion that while the residents on Magdalena below this sub-
division do not want paths, the owners in this particular area
are unanimous in wanting paths. Since it is in line with the
Town's -present policy, he would be in favor of paths being
�1 built by the developer.

ACTION:
That the Tentative Map (Revised November, 1965) of
Geo. T. Hemmeter be approved, subject to the,
Planning Commission's recommendations, Check List
and approving Agencies, including the building of a
path to Town specifications and such improvements as
the City Engineer might recommend at the intersection
of X Lane and Magdalena Road, in the interest of
safety.
MOTION: Fowls; SECOND: -,iken; VOTE: Passed unanimously.
ORDINANCES:
1. Ordinance No. -110 - Second Reading.
City :Attorney read the title of Ordinance No. 110, an Ordinance
of the Town of Los Altos Hills amending Ordinance No. 52 of
said Town by adding provisions exempting County Water Districts
from certain of the requirements of said Ordinance No. 52.
ACTION:
That the balance of the reading of Ordinance No. 110
be waived.

2. Ordinance No. 111.(Parade Control) - First Reading.
City Attorney read the title of Ordinance No. 111, an Ordinance
of the Town of Los Altos Hills regulating parades, providing
for the issuance of permits therefor, and providing for
penalties for, its violation.
City Attorney summarized the contents of Ordinance No. 111,
stating that copies will be sent to the Council for its further
study.

Second Reading - January 3, 1966.
3. Ordinance No. 112 (Preliminary Soils Report) - First Reading.
City Attorney read title of Ordinance No. 112, an Ordinance
of the Town of Los Altos Hills requiring preliminary soil
report of subdivisions and specifying the conditions under
which a soil investigation of each lot is required.
City attorney summarized the contents of Ordinance No. 112,
stating that copies will be sent to the Council for its further
study. City Attorney reported revisions to the Zoning and
Subdivision Ordinances will be forthcoming and requested the
Planning Commission to submit any written recommendations.
ACTION:
That the. balance of the reading of Ordinance
No. 112 be waived.

Second Reading - January 3, 1966
COMMUNIC,TIONS:
1. Request from the County of Santa Clara for extra territorial
jurisdiction relative to the proposed Los Altos Country Club -
Summerhill Sanitary Sewer Improvement District, to include
that portion of Dawnridge Drive, Princess Eleena Court,
Hillview Road and a portion of Hilltop Drive (map of area on
file at Town Hall) within Los Altos Hills.
CTION:
That the City Council hold a public hearing
on the County's request for extra territorial
�.;• jurisdiction to be held January 3, 1966.

2. Councilman Aiken, letter dated December 17th regarding
accidents on Robleda Road. Discussion deferred to January 3rd
meeting. -
SLdRRGNTS :
1. Bills, in the amount of TWENTY THOUSAND, FIVE HUNDRED EIGHTY-
SEVEN DOLLI:RS and Fifteen Cents ($20, 587.15), were presented
for payment by Councilman Fowle.
ACTION:
That the bills, as presented, be approved and the
City Clerk be authorized to draw the appropriate
warrants.
