Altos Cl iyton at %58 P. M• at the Town Hall, 26379 California. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowle, Henley Mayor Clayton ABSENT: None MINUTES: December 16, 1963• ACTION: Adopt Minutes of December 16, 1963 as submitted. COMMUNICATIONS_: 1. Santa Clara County, Bayshore Line Development Meeting; January 171, 8500 P. M. - Councilman F6wle will represent the Town. 2. Postcard dated December 31, 1963 from Mr. Gene Breyman while in Sydney; Australia - Read by Mayor. ANNOUNCEKMTS: C1, Santa Clara County Tr�afficways Committee Meeting - Wednesday, January -9--15-6, 4, ']30 P. M., 70 West Hedding Street, San Jose. 2. League o£ California Cities, Peninsula Div:, Rescheduled Meetings January Meeting - January 30th; March Meeting - March 31st, 1964. COMMITTEE REPORTS: 1. Report of Legal Committee, dated December 18, 1963, lubmitted by, Chairman A. T. Henley. Regarding C, 1 and 2 (Don Clark Subdivision) as to the drainage problem at the intersection of Vista de Valle and Taa££e; it was recommended that the Town Engineer be instructed to report on the means and cost of necessary work at the earliest date and that consideration then be given to use of Town funds for this purpose ACTIONS That the Town Engineer be instructed to report on Item C; 1 and 2, as stated in the December 18, 1963 report of the Legal Committee. MOTION: Henley; SECOND: Aiken; VOTE: Passed unanimously. OLD BUSINESS: None. 1 NEW BUSINESS 1. Claim: Wallace F. and Lucille Davis. The City Clerk explained the claim against the Town was for automobile damage and mental and physical pain, occurring on Page Mill Road, southerly of Arastradero Road. ACTION: That the claim of Wallace F. and Lucille Davis against the Town of Los Altos Hills be denied. NOTION: Fowle; SECOND: Bowler; VOTE: Passed unanimously. 2. MCS Project, Elena Road - Acceptance of Improvements. Resolution No. 253,a Resolution of the City Council of the Town of Los Altos Hills, accepting improvements, Elena Road, M.C.S; Project No. 9, was read in its entirety, by the City Attorney. ACTION: Adopt Resolution No. 253 as read. MOTION: Henley; SECOND: Aiken; ROLL CALL: AYES: Aiken, Bowler, Fowle, Henley, Mayor Clayton NOES: None ABSENT: None 3, Tract No. 2906 (Adams, Mrs. F.) - Acceptance of Improvements. Resolution No. 254, a Resolution of the City Council of the Town of Los Altos Hills, accepting improvements in Tract No. 2906, was read in its entirety, by the City Attorney. ACTION: Adopt Resolution No. 254 as read:, MOTION: Bowler; SECOND: Aiken ROLL CALL: AYES: Aiken, Bowler, Fowle, Henley, Mayor Clayton NOES: None ABSENT: None Mr. J. W. Riley, representing the principals of Tract No. 2906, requested that a Maintenance Bond be allowed to be filed in lieu of a ten percent cash deposit. ACTION: That Maintenance Bond, No. 505151, be accepted in lieu of a cash deposit for Tract No. 2906. MOTION: Henley; SECOND: Aiken; VOTE: Passed unanimously. -2- NEW BUSINESS �Cont'd.): 4. Tract No. 2842 (Fremont Hills Unit No. 6) - Engr. L. G. Brian. i The City Clerk read the remaining deficiencies as noted in the Town Engineer's report dated December 17, 1963, and referred the Council to a six point letter from Fremont Hills Develop- ment Co. dated January 2, 1964, each point of said letter being acted upon separately as follows;: ITEM ACTION: 1 and 2 No action required. 3 That Mr. Fitzpatrick's proposal on Item 3 be accepted,, after deletion of the last sentence of said Item; and this will assume that the normal amount of the Maintenance Bond will be sufficient to insure his guaranty. MOTION: Fowle; SECOND: Aiken; VOTE: Passed unanimously. 4 That the $2,000.00 referred to in Item 4 be accepted as in lieu payment. MOTION: Bowler; SECOND: Aiken; VOTE: Passed unanimously. 5 and 6 No action required. Page 2 That Mr. Fitzpatrick's request for termination of the ten-year agreement be denied. MOTION: Fowls; SECOND: Henley; VOTE: Passed unanimously. Resolution No. 255, a Resolution of the City Council of the Town of Los Altos Hills, accepting improvements in Tract 2842, was read in its entirety, by the City Attorney. ACTION: Adopt Resolution No. 255 as read. MOTION: Fowls; SECOND: Aiken ROLL CALL: AYES: Aiken, Bowler, Fowle, Henley Mayor Clayton NOES: None ABSENT: None DIVISIONS OF LAND: Tentative Maps: 1. MacDonald, Frank P. (268-63) 2 lots - Engr. Mastin-Kingston. 1� The City Clerk read the conditions of the approving agencies. ACTION: That the Tentative Map, dated October 26, 1963, of Frank P. MacDonald (268-63) be approved, subject to the conditions of the Ch$ck List and approving agencies; but without any payment for paths. MOTION: Aiken; No Second. AMENDED MOTION: Such approval to include the resurfacing of the entire width of the road as per the requirements of the Town Engineer. MOTION: Aiken; SECOND: Bowler. Discussion followed and the above motion and second were with- drawn and restated as follows: ACTION: That the Tentative Map, dated October 26, 1963, of Frank P. MacDonald (268-63) be approved, subject to the conditions of the Check List and approving agencies; such approval to include the resurfacing of the entire width of the road as per the requirements of the Town Engineer and with the condition that a path be constructed along the frontage of the property. MOTION: Aiken; SECOND: Bowler; VOTE: Passed unanimously. RESOLUTIONS: 1, Resolution No. 256, being a Resolution of the City Council of the Town of Los Altos Hills, concurring in the appointment of County Director of Civil Defense as Operational Area Coordinator, was read in its entirety by the City Attorney. ACTION: Adopt Resolution No. 256 as read. MOTION: Aiken; SECOND: Bowler ROLL CALL: AYES: Aiken, Bowler, Fowle, Henley, Mayor Clayton NOES: None 1 ABSENT: None L_ -4- WARRANTS: 1. Bills, in the amount of ELEVEN THOUSAND, SIX_ HUNDRED AND EIGHTY-FIVE DOLLARS and Two Cents 011,685.02) were presented by Councilman Fowl&. ACTION: That the bills be approved as presented; that the City Clerk be authorized to draw the appropriate warrants. MOTION: Fowle; SECOND: Henley ROLL CAIL: AYES: Aiken, Bowler, Fowle, Henley, Mayor Clayton` NOES: None ABSENT: None OTHER BUSINESS: 1. Signaling System - Foothill College. Even upon completion of the construction at E1 Monte (:venue, there will still be a traffic problem andthe only solution seems to be an electric signaling device. The Mayor reported on such a plan in cooperation with the County, with design and planning being offered to the Town for prior approval. 2. Mr. C. Garbett commented on the inability of the school bus to make a complete turn on sago Mill Road at Arastradero due to eucalyptus trees. He was advised that these trees are on school property and should he care to write the School District concerning this dangerous condition, he could add the concern of the Council. 3. Councilman Bowler reported that Mrs. L. A. Roselaar protested against the quality of the service from a Town Deputy Sheriff. The City Clerk was so directed to contact the Sheriff's Office to investigate tb_is matter and submit a written report. ADJOURNMENT: MOTION: Aiken; SECOND: Fowle MEETING C.DJOURNED: 9:30 F. M.
