B. Clayton, at 7:55 F. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowls Mayor Clayton ABSENT: Councilman Henley MINUTES: January 20, 1964. ACTION: Adopt Minutes of January 20, 1964. COMMUNICATIONS: None. ANNOUNCEMENTS: None. _ CQ°21ITTEE REPORTS: None. OLD BUSINESS: 1. Clark Subdivision Tract No. 1583 - The City Manager read the Town Engineer's report dated January 27, 1964 and submitted their estimated costs to complete improvements. In the absence of the City Attorney, action was postponed. NW BUSINESS: 1. Tract No. 2374 - Fremont Pines) 2. Tract No. 3091 - Robleda Hills) Acceptance of Improvements. 3. Tract No 3410 - McNeil, Bruce) _ Resolution No. 261, a Resolution of the City Council of the Town of Los Altos Hills, accepting improvements in Tract Nos. 2374, 3091, and 3410, was read in its entirety by the City Manager. Moody Court - Unsafe Structure. 5. Dan Dana - Page Mill Road Sewer Line. Items Nos. 4 and 5 were deferred until the return of the City Attorney. In the meantime, Mayor Clayton requested that a policy be established on daytime use of the Town Hall. ACTION: It is the policy of the Council to prohibit the use of the Town Hall for meetings during working hours, 8:00 A. M. to 5:00 P. M., Monday through Friday, but that the City Manager may at his option admit groups of limited attendance. MOTION: Bowler; SECOND: Fowle; VOT'�: Passed unanimously. 4. Moody Court - Unsafe Structure. The City Manager reported inspections of the abandoned residence had been made by the Los Altos Fire Protection District, the 1 County of Santa Clara Health Department, and the Staff of the Town of Los Altos Hills and that it has been declared an unsafe structure and a nuisance. Photographs were shown to the Council. ACTION: That, in the opinion of the Council, the abandoned structure on Moody Court is unsafe and a nuisance, and that the City Attorney be instructed to take the necessary legalstepstoward abatement. N10+10 7V: t' Siam. ---W 5. Dan Dana - Page Mill Road Sewer Line - Acceptance of Improvements. The City Manager read the Staff Recommendation dated January 30, 1964. The Council determined the penalty is still imposed upon Mr. Dana. ACTION: That the Dan Dana, Page Mill Road Sewer Line improvements, be accepted. Tract No. 3244 - Abandonment of Public Utilities Easement. Resolution No. 262, a Resolution of the City Council of the Town of Los Altos Hills, vacating a public utility easement on Lot No. 2, Tract No. 3244, was read in its entirety by the City Manager. ACTION: Adopt Resolution No.. 262 as read. MOTION: Aiken; SECOND: Bowler ROLL CALL: AYES: Aiken, Bowler, Fowle Mayor Clayton NOES: None ABSENT: Henley VARIANCES: 1. Farrell Robert S. (V-165-64) - Request for Reduction of Side Setback to 20 to accommodate carport. ACTION: That the request of Robert S. Farrell (V-165-64) for reduction of side setback for carport be approved as submitted on Map dated January S, 1964: MOTION: Aiken; SECOND: Fowle,; VOTE: passed unanimously. 2. Bulmore, Robert R. (V-166-64.) - Request for overhead electric and telephone service. ACTI OPT : That the request of Robert R. Bulmore (V-166-64) for overhead electric and telephone service be approved; providing, however, that the wire portion of the line is formally screened by the planting of Monterey Pines, or the equivalent of dense, fast- growing trees, along the property lines at the corner where the existing pole stands. MOTION: Aiken; SECOND: Bowler; VOTE: Fussed unanimously. While it is not the criterion of the Council, as a rule, it is felt that this planned planting would achieve the desired effect. -3- VARIANCES (Cont'd.): 3. Johnston, Wendell K. (V-164-64) - Request for Overhead Electric and Telephone Service. The City Manager read the recommendation of the Planning Commission, dated January 27, 1964, Mr. Johnston said he had the verbal consent of the Pacific Gas & Electric Co. and Mr. D. D. Foley, on the points requested by the Planning Commission. ACTION: That the request of Wendell K. Johnston (V-164-64) for overhead electric and telephone service be approved, providing the easement is obtained from Mr. D. D. Foley and that the Pacific Gas &. Electric Co. be requested to leave maximum possible slack - in the wire so as to provide a minimal obstruction of view from adjoining lots. MOTION: Aiken; SECOND: Fowle; VOTE: Passed unanimously. DIVISIONS OF LAND: Tentative Map: 1. Council Crest (269-64) 10 lots - Engr. John W. Riley. The City Manager read the recommendations of the Planning Com- mission and Check List, dated January 27, 1964. Paths were thoroughly discussed as to easements, types of construction and connecting pathways. ACTION: That the Tentative Map D-177 of Council Crest (269-64) be approved subject to the conditions of the Check List and approving agencies, with the exception that in lieu payments for paths along Todd Lane are waived; and such approval contingent upon the following: 1) The granting of a 10 -foot wide pathway easement between Lots `4 and #5- 2) The granting of a 10 -foot wide pathway easement along the back of Lots §16 and 1=7, with the construction of a path on this easement. 3) An easement along the southerly boundary of Lot #7 to meet the existing easement from Lot #5, Tract /'3280. ( 4) The reconstruction of the existing pathway �.J along LaPaloma Road, substantially in accord with the diagram on the subject map. MOTION: Fowle; SECOND: Bowler; VOTE: Passed unanimously. / RESOLUTIONS: 1 1. Resolution No. 2�1 - F. Resolution of the City Council of the Town of Los Altos Hills ordering, calling, providing for and giving notice of a General Municipal Election to be held. on the 14th day of April, 1964, for the purpose of filling three Councilmanic Vacancies, was read in its entirety by the City Attorney. Resolution No. 264 - !a Resolution of the Town of Los Altos Hills authorizing the City Clerk to contract with the Santa Clare. County Registrar of Voters for Election Services, was read in its entirety by the City Attorney. &CTION: l.dopt Resolution No. 264 as read. MOTION: Aiken; SECOND: Bowler ROLL CALL: :.YES: Aiken, Bowler, Fowle, Mayor Clayton NOES: None ABSENT: Henley 3. Resolution No. 265 - A Resolution of the City Council of the Town of Los Altos Hills objecting to subdivision of lands entitled "Olive Tree Hill North" was introduced and read in its entirety by Councilman Bowler. ACTION: 1.dopt Resolution No. 265 as read. MOTION: Bowler; SECOND: Fowls ROLL CALL: AYES: Aiken, Bowler, Fowle Mayor Clayton NOES: None ABSENT: Henley -5- ORDINANCES; 1. Ordinance No.97, an Ordinance of the Town of Los Altos Hills prohibiting solicitations upon private property, declaring violation would be a nuisance, providing for penalties for violation and declaring existence of an emergency, was read in its entirety by the City Attorney. ACTION: Adopt Ordinance No. 97 as read. MOTION: Aiken; SECOND: Bowler ROLh C'.LL: AYES: Aiken, Bowler, Fowls, Mayor Clayton NOES: None ABSENT: Henley Ordinance No. 97 is effective immediately. ACTION: .- That there be a Public Hearing on Ordinance No. 97 at the next Regular Meeting of the City Council, February 17, 1964, at the Town Hall and that the City Clerk be so directed to give such notice. Ordinance No. 98, an Ordinance of the Town of Los Altos Hills, 1 amending Ordinance Be. 86,"relating to General Purpose Paths, was introduced and read by the City Attorney. Second Reading will be February 17, 1964. '=Ii.RR,NTS 1. Bills, in the amount of SEVEN THOUS "JSD, THRE'7 HUNDRED AND SEVENTY-FOUR DOLLARS and Ninety-eight Cents (917,374..98), were presented by Councilman Fowle. ACTION: That the bills be approved as presented; that the City Clerk be authorized to draw the appropriate warrants.
