MINUTES OF A REGULAR MEETING
February 17, 1964
4.� The Regular Meeting of the City Council of the Town of Los Altos Hills
was called to order Monday, February 17, 1964, by Mayor Wm. B.
Clayton, at 7:53 P. M. at the Town Hall; 26379 Fremont Road, Los
Altos Hills, California.

Page 2, Item 4 - Add "Motion" to Action as follows:

It was the opinion of the Council that the above requests and future
proclamations should be acted upon at the discretion of the Mayor,
since this is a traditional function of his Office.
3. Board of Su ervisors Count of Santa Clara - Letter dated
February 6, 1964 requesting that the Uuuucil adopt a resolution
granting its consent to the resolution adopted by the Board of
Supervisors declaring Prospect Avenue West, Los Altos Hills, to
be a County Highway:
This item was deferred to RESOLUTIONS on the Agenda.

was read by the City Manager.

February 28, 1964, at 3:30 F. M., County Welfare Building,
San Jose, presenting Mr. Edgar May to discuss the nation's
public welfare controversy.
3. Notice of Public Hearing before the Santa Clara County Local

Agency Formation mission, on March 3, 1964, 2:00 P. M.,
San Jose, to consider proposed annexation designated as
UPPER BLANCO ANNEXATION to the Purissima Hills County Water
District
PUBLIC HEARINGS:
1. Solicitation Ordinance - Ordinance No. 97•
The Mayor declared the Public Hearing open and asked for comments
from the Floor.

�--� Messrs. Bedell, Rubin, Lee, Cathcart and Mrs. Sedlacek spoke
in favor of the Ordinance.
Mr. Rubin and Mrs. Sedlacek asked if public service organizations
were exempt. They were informed that this is an Ordinance
prohibiting all solicitations without prior consent of the property
owner, and any attempt on the part of the Town to differentiate
for public service organizations would invalidate the Ordinance
and be discriminatory. However, it is assumed that such
organizations as Girl Scouts, Boy Scouts, Community Chest Drives,
etc. would not warrant complaints from the Town's people and
even this situation could be avoided by obtaining prior consent
of the property owner with a telephone call. This might prove
more advantageous in saving time and energy in view of the
acreage lots and in addition would be entirely proper and legal.
There being no further comments, the Public Hearing was closed
at 8:13 P. M.
OLD BUSINESS:
1. Don Clark Subdivision - Improvements.
The City Manager reviewed the City Engineer's report and cost
estimates dated January 27, 1964.

The City Manager stated in order to alleviate the drainage
condition, it would be first necessary to require the granting
of drainage easements. Also, in view of the amount, it would
be his recommendation to include this item in the Budget for
the next fiscal year.
ACTION:
That the City Manager and City Engineer mutually
agree upon a compromise and an economic solution
to the drainage problem resulting from the Don
Clark Subdivision, Tract No. 1583, and present
it at some time prior to the adoption of the
1964-65 Budget.

NEW BUSINESS:
1. Page Mill Estates - Improvements.
This item is on the Agenda at the request of the Planning
Commission.
The City Manager reported that this matter of completion of
improvements was brought to the attention of Page Mill Estates
�---` in September, 1963, but through unforseen circumstances, was
overlooked by the developer. At this time there is a letter
on file at the Town Hall dated February 17, 1964, from the
Page Mill Development Co. requesting an extension to
December 12, 1964 for completion of improvements.
Mr. T. Gamboa, representing Page Mill Development Co., stated
rough grading was completed in the subdivision, all water mains
in and pressure tested, and hydrants; all staking for curbing
and gutters should be finished in 60 to 90 days.
The City Manager recommended that the developer be allowed to
complete this subdivision in stages, as long as each phase is
completed before going on to the next, with a definite time
schedule and development plan presented to the Council.
Adherence to such a schedule could be controlled by the Town
Building Department.
The City Engineer commented in case of an extension or extensions,
such inspections would not be covered by the present fee
schedule. The Mayor suggested that this matter be studied and
that a letter be submitted to the Council.
ACTION:
That the request of Page Mill Development Co. for
time extension from December 12, 1963 to December 12,
1964 be granted, without penalty.

Inasmuch as the large audience was primarily concerned with
Ordinance No. 98, the last item on the Agenda, this matter was
acted upon as the next item.
-) ORDINANCES:
1. Ordinance No. 98 - Paths. Second Reading.
Ordinance No. 98, an Ordinance of the Town of Los Altos Hills,
amending Ordinance No. 86, relating to General Purpose Paths,
was read in its entirety by the City Attorney.
The Mayor asked for comments from the Floor.
The following residents commented in opposition to the wording
of the proposed Ordinance:
Mrs. Wm. C. Sedlacek 13341 Wildcrest Drive
Mrs. Walter C. Barber 13290 Lennox Way
Mr. & Mrs. E. A. Breyman 13456 Wildcrest Drive
It was the opinion of Mrs. Sedlacek and Mrs. Breyman that such
a change in the Ordinance should wait upon the final report of
the Citizens Committee of the Piaster Path Plan.
Mrs. Barber, Chairman of Safety and Pathways, Gardner Bullis
School PTA, questioned whether the proposed Ordinance would
-.1 cancel the validity of an easement granted for pedestrian use
only.
It was explained by the Council that this rewording is solely
for clarification and applies only to subdivisions so that
the Council may have broader latitude to call for any path
which may be appropriate. This clarification does not deal with
the use of the path; only the obligation of the subdivider.
The following residents were in favor of the proposed Ordinnn,n

ACTION:
That the words "general purpose" be omitted
from. the proposed Ordinance No. 98.

VARIANCES:

ACTION:
That the request of Mario Nutini (V-167-64)
for overhead utilities be approved.

Request was denied.
2. Schwartz, James (V-168-64) - Request for Overhead Utilities.
It was the opinion of the Council that this variance could be
granted solely because it was a non -typical Los Altos Hills
situation, being in an area surrounded by half -acre sites of
the County.
ACTION:
That the request of James Schwartz (V-168-64)
for overhead utilities be approved.
MOTION: Bowler; SECOND: Fowle; VOTE: Passed unanimously.

) Requirement.
ACTION:
That the request of Calvin Quate (V-169-64) as
recommended by the Planning Commission be approved.
MOTION: Fowle; SECOND: Henley; VOTE: Passed unanimously.
DIVISIONS OF LAND:
1. Altamont Associates (199-61) 5 lots - Engr. J. W. Riley.
The City Manager read the recommendations of the Planning
Commission and Check List dated December 23, 1963. Letters
from the Approving Agencies are on file. Temporary fire
access road was discussed.
ACTION:
That the Tentative Map, C-88, dated November 1963,
of Altamont Associates (199-61) be approved as
recommended by the Planning Commission.
MOTION: Henley; SECOND: Bowler; VOTE: Passed unanimously.

RESOLUTIONS:
1. Resolution No. 266 - A Resolution of the City Council Of the
Town o£ Los Altos Hills consenting to designation of a portion
_ of Prospect Avenue West within the Town of Los ^.ltos Hills as
a County Highway, was read in its entirety by the City Attorney.
ACTION:
Adopt Resolution No. 266 as reed.

OTHER BUSINESS:

2. Purissima Hills County Water District,
Mr. M. R. Johnson, representing the Water District, stated its
policy onroquirements for the installation of water service to
new homes.
CWARRANTS:
1. Bills, in the amount of SIX THOUS.°.ND, SIX HUNDRED AND SEVENTEEN
DOLLARS and Thirty-six Cents (`->6,61'7.36) were presented by
Councilman Fowle.
ACTION:
That the bills be approved as presented; that the
City Clerk be authorized to draw the appropriate
warrants.
