Correction: First Para., 4t1i line amended to read: 'adjourned, due to the lack of a Quorum, to Tuesday, 7:45 P. M., .April 21, 1964, at the Town Hall, 26379 Fremont Road, Los Altos Hills.' April 21i1964_ Corrections: Omit words "and Snecial Meeting" where men- tioned in Minutes of :April 21, 1964. Variances, Item 3, Lindell, 3rd para.: Public should read 'Pacific'. Divisions of Land, Item 1, Greene, 3rd para.: Commis sissioner� should read 'Councilman'. ACTION: Adopt Minutes of April 20, 1964 and April 21, 1964 as corrected. COMMUNICATIONS: 1. Letter dated April 28, 1964 from the County Executive relating to Puss Transportation Study Financing for Santa Clara County. The Coordinated Mass Transportation Planning Program Report to the County Mass Transportation Committee, dated February 5, 1964, was distributed to the Councilmen for their study. ATTNOUNCEMEN_TS : 1. Santa Clara Inter -City Council fleeting, Thursday, May 7, 1964, 7:30 P. P.., at the ull Brave BRestaurant, Ios Altos Host City. Program: 'Mass Transit in Santa Clara Count The Mayor encouraged all Council Members to attend. 2. Peninsula Division, League of ualriornla Thursday, May 21, 1964, 7:30 F. M., Host City San Jose, at Flateau 7, 777 North First Street, San Jose. COMMUNICATIONS_(AGENDA): 1. California Water Service Co. - Notice of Filing Application £or Rate Increase. This matter is on the Agenda in order to bring to the attention of the Council the intention of the California Water Service Co. to apply for a rate increase. The City Attorney and City Clerk will keepinclose touch with this matter. The City Attorney requested a Study Session after the meeting to discuss franchise payments. COMMITTEE REPORTS: None. PLP_T.NING COMMISSION REFERRALS: 1. Letter o£ Objection_to Secondary Living Unit. The City Clerk referred to Mr. Wayland C. Griffith's letter of objection dated April 22, 1964. Mr. Griffith was present and as per his letter stated his objections to a construction with separate living quarters and only an external connection. Mr. McDougall was present and stated the building plans remained the same as approved and claimed it was not a two-story apartment but that its use was a single residential dwelling. The City Clerk explained that when Mr. McDougall desired a second .kitchen, a variance was applied for and thus the petition was circulated. However, upon clarification from the City Attorney, it was deemed that a variance was not necessary as the Town's Ordinances do not control the number of sinks or kitchens in a single residence. The City Attorney further clarified that use is the governing factor and that the Town does not have control over architectural design, plans or facilities (except in the case of a secondary dwelling with kitchen facilities on 1.99 or less acre); that in case of any violation of the use, there are several quick and effective avenues to take. -2- PLANNING COMMISSION REFERRALS: Letter o£_211jection (cont'd.). Mr. Richard Towle was concerned in this matter with more Il than a passing interest in view of Foothill College. Councilman Bowler offered a criterion which might pass a valid test - a single family residence would have a community entrance, while separate entrances to separate living quarters would constitute otherwise. ACTION: That the referral of the Griffith -McDougall matter from the Planning Commission be accepted and that the Council go on record as stating that the plans as submitted are in accordance with the Town's Ordinances, but at the same time, instruct the City Manager to inform Yr. McDougallas to the substance of our Zoning Ordinance and watch particularly the use of the subject residence in the future and bring to the attention of the Council any likelihood that it is being used for other than the permitted use. MOTION: Fowle; SECOND: Bowler; VOTE: Passed unanimously. OLD BUSINESS: 1 Selection of Mayor. The choice of Mayor and. Deputy Mayor was deferred until the presence of a full Council. 2. Miriam E._Volff - Claim. The City Attorney stated he had had no contact with Mrs. Wolff since her return from New York, and asked that this matter be placed on the Agenda for the May 18Uh meeting.. 3. Adobe Creek Lodge. The City Manager reported that Tir. Bellucci will present a master over-all plan to the Planning Commission at the May 250 meeting. The Council asked for a progress report on June let. ACTION: That prior to the Council Meeting of June 1, 1964, Mr. Bellucci shall have submitted to the Planning Commission a plan for the development of the Adobe Creek Lodge property and lacking such a formal submittal, that legal action will be taken. MOTION: Bowler; F,ECOND: Aiken; VOTE: Passed unanimously. -3- OLD BU51MESS (Cont'd.): y 4. Bryan N. Shieman - Violation of Zoning and Building Code. The City Clerk read a letter dated April 30; 1964 from Dr. B. T?. ,5hieman stating he could not attend the Council meeting because of a prior County Medical Society Council meeting. It was the opinion of the City Attorney that Dr. Shieman's letter constituted an appeal to the Council and that it would be appropriate at this time to consider the merits of the variance. The P",.ayor deferred the matter to the May 18Th meeting when Dr. Shieman could be present. P":' DUGI SSES�: 1. Los Altos Hills Association Brochure. R. George, representing the Los Altos Hills Association; brought to the attention of the Council the Association's efforts toward publishing a brochure on the Town of Los Altos Hills. At present they have a rough draft and statistics for such a brochure entitled "The Three R's - Rural, Residential and Restful", informing the Town's people and prospective - buyers of what kind of a Town we are, why we have incorporated this tyre zoning and why we are going to stay this way. r= stumbling block has been reached revolving around costs and additional editorial talent in order to do this in a profession- al manner. I"r. George askedthe help of the Council to carry out this proposal, suggesting a Citizen's Committee be appointed, on which he offered to serve. Chairman Garbett, of the F.lanning Commission, commented the Green Foothills Association has been in touch with him regard- ing a similar brochure to provide developers and builders some idea of what can be built here and the development we would like to see here. Chairman Garbett thought they would be eager to cooperate. Council,een Fowle and Aiken were in favor of the Town bearing the expense of this project. The Mayor will appoint a Citizen's Committee, with this guideline in mind - to investigate the costs involvedin publishing the brochure in a professional manner. Mr. G. Cowie praised the Association and Mr. George for the hard work they had accomplished. He commented they did not :rant this booklet to become a "Chamber of Commerce" booklet to help realtors sell their lots, but to give the history Of the Town, the rural h.•ray o£ life, incorporating the zoning restrictions, etc. -4- NEI_! BUSINESS: Brochure Cont'd.): ACTION: That the Mayor appoint a Citizen's Committee to carry out the proposal of a brochure, investigate the cost, and report to the Council. MOTION: Aiken; SECOi1D: Fowls; VOTE: Passed unanimously. VkRI_ANCES: 1. Flood, David J. (17-184-64) - Request for ^eduction in Setback Requirement. The request was for a twenty-one foot reduction in sideyard setback for residence to allow location of drainage field. The City Manager recommended, that if the variance is approved, that the location of the driveway be offset (following the 300' contour) from directly opposite St. Wrancis Drive. -.CTI O:T That the request of David J. Flood. (V-184-64) for reduction of twenty-one feet (21') for sideyard setback for residence be approved, in accordance with the recommendations of the City Earager. Fowle; S�iC07D: Aiken; VOTE: Passed unanimously. OF LL -"D: Tentative Mans. -i, ,Telson. Hilmer C. (211-61)_4_lots - Appeal of Conditions of Azproval ofof Tentative Pap. - Engr. John Riley. The City Manager read a letter from Engr. J. 'd. Riley dated :',rril 29, 1964, on behalf of Colonel Filmer Nelson, appealing Item 8 of the planning Commission Check List reouiring the developer to dedicate and improve to Town Standards the strip of land as indicated on accompanying Tract Map. The City Manager also read Pir. George S. Ferham's letter dated Play 1, 1964. It was noted that 40' of the 60' strip in ques bion is property of Perham, andthat a covenant is recuirefl to be filed for maintenance. Access, use and condition of road was discussed. I"TION: That only that portion of the roadway owned b•, Colonel nelson from Ravensbury Road to the Lands of Ferham in the County be dedicated by him, and that the o££ -tract street in that area be improvedaccording to the Town Engineer. No. 3486 be approved. :OTIOtT: Aiken; 3ECOND: Fowle; 4. Macdonald, Frank F. (268-64) 2 lots - Engrs. Fastin o.. Kingston. Mr. Mackay, representing Mr. Greene, and Mr. Macdonald were present. Mr. Macdonald's letter of April 20, 1964 was read. The Council, in reviewing the situation, agreed that any new Proposal should not increase Mr. Macdonald.'s cost of improvements. Mr. Mackay said his client would like to place a deposit for the fire hydrant and, when such time the California Vater Service Co. completes its installation, the money would be available. fie was advised this matter might be resolved by speaking with the Fire Chief. The City Manager suggested Greene -Macdonald share on a per foot frontage cost for resurfacing twenty-four feet of Magdalena Road (plugging in the soft spots), with berms on either side, and a path - fill not required and there would be no removal of acacia trees, cost not to exceed their individual costs. Mr. Macdonald objected to the construction of a path. .9s no conclusion was reached, the Mayor again suggested all parties concerned meet with the City Manager in order to arrive at a conclusion. ACTI Ott : That the Final Map of Tract No. 3486 be approved. :OTIOtT: Aiken; 3ECOND: Fowle; VOT3: Passed unanimously. -6- ORDINANCES: �l 1 Ordinance No. 99, an Ordinance -of the Town of Los .Altos Hills 1 requiring Approval of Certain Sites before Issuance of Building Permits, Establishing a Procedure therefor, and Establishing Penalties for Violations. The City Attorney read the Title of Ordinance No. 99 and discussed the provisions of the Ordinance. l =cq : That further reading of Ordinance No. 99 be waived.
