MINUTES OF A REGULAR MEETING
July 6, 1964
The Regular Meeting of the City Council of the Town of Los Altos.
Hills `"was "called to order Monday, July 6, 1964, byMayor Wm. B.
Clayton, at 7-:55P• M, at the Town Hall, 26379 Fremont Road,
Los Altos Hills, California.
ROLL CALL: PRESENT Councilmen Bowler, Fowls, Henley
Mayor. Clayton -
ABSENT:. Councilman Aiken
MINUTES: July 15, 1964.
Correction:
Divisions of Land, Item 1, Dreessen; ACTION,
2ndpara., delete "a non -conforming use" andamend
to read, "cons"titutes apre-existing violation of
the present setback requirements".

OLD BUSINESS:.
1. Adobe Creek Lodge - Progress Report.
Mr. Bellucci stated the improvement plans will be reviewed
by the Planning Commission at its July 13k meeting and that
he has retained the services of Wilsey, Ham & Blair to study
these plans and represent him at the forthcoming .meetings.

Agenda for the July 20mCouncil Meeting. -

)"':2. Los .:Altos School District - Request for Acceptance of Gardner:
Bullis Sewer Line.
After a study by the City Attorney and agreement by the.County
Council and...the=Los-Altos School District to amend the accept-
ance agreement to include the phrase "at least", the City
Attorney recommended the Mayor and City Clerk be authorized to -
execute the 'agreement for acceptance of the Gardner Bullis
Sewer Line.
ACTION:
That the Mayor and City Clerk be authorized
to execute the agreement of acceptance of the
Gardner Bullis Sewer Line, in accordance with
Exhibit "A", dated August 1, 1962.
MOTION: Bowler; SECOND: Henley; VOTE:. Passed unanimously.
NEW BUSINESS: -
l. Wils Foster - Status of Lot.
The .City .Clerk read a letter dated June 22, 1964, from
Fred W. Armstrong, attorney representing Mr. Foster, requesting

Council action as to the official status of Mr. Foster's lot
since the State has reduced his lot below the minimum acre lot
size by a fee "take" in order to widen El Monte Road.
The City Attorney recommended Alternative 3 of Mr. Armstrong's
letter since the Council cannot say what rights are in the
future due to unforseeable changes of agencies and bodies
of. the, Town.
Mr. Foster commented it was his understanding that thePlanning
Commission .and City Council agreed to the improvements and
"take" of certain strips of land and all agreements were based
on the contingency he had abuilding site'. After considerable
expense and effort spent on his home and landscaping, Mr.
Foster urged the approval of his building site.

It was the judgment of the Council that Ordinance No. 99 pro-
vides the proper procedure for granting approval of a building
site.
.Due to July 30th trial date set by the State, it was the
opinion of the Council that this matter could be :referred to
the Planning Commission to be taken up at its July 13t meeting.

ACTION:
That the Planning Commissionbe requested to
consider the status of Mr. Foster's lot under
the requirements of Ordinance No. 99 for build-
ing site approval, that the Planning Commission
make its recommendations atits July 13n meeting
in order that the matter may be placed onthe -
Council Agenda for its meeting of July -20m'.`

Councilman Bowler suggested that the Planning Commission be
made aware that it has been ruled that on unoccupied property
a substandard lot is not considered a building site. .The
Mayorsaid hewould :write a letter to the Planning Commission
stating the Council's policy.

1. Gibson, Dennis IV -19,-64)- Request for Reduction of Setback
Requirement £or :Swimming Pool and Pool Shelter.
The City Clerk read the recommendations of the Planning
Commission. There were no objections from property owners.
ACTION:
That the request of Dennis Gibson (V-195-64)
for reduction of setback requirements for pool
to 15' and shelter to 25' be approved.

BTJILDING SITE APPROVAL: Tentative Map.
1. Bosschart David (1-64) 2 lots - Engr. C. Coburn.
.The City Clerk read the recommendations of the Planning
Commission and Check List. Tentative Map was reviewed.
Mr. Coburn, representing Mr. Bosschart, stated Toyonita Road
'
was a private road and agreed with the Town Engineer that his
client shouldnot be required to improve Toyonita. The
.City Clerk read the Town Engineer's recommendations for
approval dated June 19, 1964.

BUILDING SITE APPROVAL:: Bosschart (Cont'd.):
Followin' discussion of the 1960 Record of Survey separating.
Lots #6-Nrcel 3) and #7 (Parcel 4) and the subsequent
3 -lot division in 1961 on which improvements were not re-
quired,.the.Council concurred with the Town Engineer that
.improvements would serve no useful purpose; butthat an
"in lieu" payment for paths should be required.
ACTION:
That .the application of David Bosschart (1-64)
for building site approval as shown on Record
of Survey Map dated April 1960 be approved,
subject to the conditions established by the
Planning Commission with the exception that
road improvements will not be required, in
accordance with the recommendations of the Town
Engineer.

OTHER BUSINESS:
1. Councilman Fowle reported to the Council he hadreceived a
communication from the Executive Director of the Santa Clara
County Heart Association (a continuation of thepetition
brought before the City Council on June 15, 1964)., together
with a recapitulation of San Jose Municipal Code regarding
solicitations and a solicitation permit form. Councilman
Fowls requested the City Attorney review these documents
and submit his interpretation in order that Dr. Lewis:'
letter may be earnestly answered.
In addition,. Councilman Fowls suggested a determination
should be made whether our ordinance, asitnow stands, is as
the Town wishes it and asked Mr. W. R. George, President
of theLosAltos. Hills Association., to determine whether the
.anti -solicitation ordinance is meeting with the general
approval and wishes of the Town.
It was suggested, however, by Councilman Bowler that before
the Los .Altos Hills Association begins this undertaking,
that .full information should be obtained to examine the
feasible alternatives as not everything that is feasible is
4, desirable. The Green River Ordinance is the most common
ordinance of its type in this Country. It is an: exceptional
community without such an ordinance,. and it is important to
keep aprospective on this.
