B. Clayton, Monday, Novem- ber 16, 1964, at 7:53 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowle, Henley, -- Mayor Clayton ABSENT: PLANNING COMMISSION COMMISSION REPRESENTATIVES: Commissioners Alter, Ashby, Hibner -- Chairman Garbett MINUTES: November 2, 1964. Correction: Approval of Minutes, ACTION: Change November 2, 1964 to October 19, 1964. ACTION: Adopt Minutes of November 2, 1964 as corrected. ACTION: Adopt Minutes of October 19, 1964 as amended. League of California Cities .Peninsula Division - Bi -monthly Dinner Meeting, Monday,- November 30, 1964, at7:30 F. M., Host City - Palo Alto, to be held at Rickey's Hyatt Nouse, 4219 E1 Camino Real, Palo Alto. Guest Speaker: Mr. Patrick Healy, Executive Director., American Municipal Association. Since the majority of the audience were present to be heard on the proposed Palo Alto improvements for Manuella Road, the Mayor changed the order of business, taking first, Item 1 of New Business. NEW. BUSINESS: -) 1. Petition Re: Proposed_ Manuella Road Improvements. At the request of Mr.'Jerry Parks, 14710 Manuella Road, the City Manager read the petition signed by 70 Los Altos Hills residents and 32 Palo Alto residents requesting the Council of the Town of Los Altos Hills to reject any requestfrom the City of Palo Alto for extra -territorial jurisdiction over portions o£.Los Altos Hills territory for the purpose of widening Manuella .Road.. Such petition is on file at the Town Hall and hereby made a part of the Minutes. firs. J. Parks submitted additional signatures, bringing the total to 77 Los Altos Hills residents, and 44 Palo Alto residents, requesting these\signatures be incorporated into the Minutes. ACTION: - That the additional signatures be added to the petition as part of the resolution read into the Minutes. Green, 14840 Manuella Road Upon Councilman Fowle's assurance and Councilman Aiken's unrelinquishable statement that the rural character of the Town .and the road and trees will not change, the Mayor informed the audience there had been no communication from Palo Alto regarding this matter and that legally they had no authority over the property rights of Los.Altos Hills residents. In any event, the Council, in complete agree- . ment, assured the petitioners that the rural character of the Town will not change. In this respect, Councilman Bowler proposed the following resolution: RESOLVED, That it is the sense of the Council that the Town of Los Altos Hills will continue _ its present policy with respect to roads in the Town of Los Altos Hills, particularly with respect - to retaining the rural atmosphere of the roads and the preservation of trees along the roads; WHEREAS, and if the Council is approached by any neighboring municipality on the subject of widen- ing roads or changing traffic patterns, that it will hold public hearings before taking any action whatsoever upon such a request. Otto Kohl - Re: Completion of improvements in Page Mill Estates. Mr. Kohl has foreclosed on Page Mill i965tesnsand perwill histake possession on or before February 15, letter dated November 11, 1964, he is requesting a reasonable extension of time past the due completion date of December 15, Q-) 1964 in order to complete improvements. -3- NEW BUSINESS: Otto Kohl (Cont'd.): 1, ,l Since Mr. Kohl could not be present, it was discussed that i. additional information would be required, such as, the adequacy of funds, estimated costs of completion, whether additional bonds might be required, landscaping, etc.; ACTION: That the request of Mr. Otto Kohl be referred to the City Attorney for a full report at the next Council Meeting, December 7, 1964. DICTION: Fowle; SECOND: Aiken; VOTE: Fassed unanimously. 3. Fire Prevention Problems - D. Hibner, A. Alter and R. Bassett. Chairman of the Los Altos Fire protection District Hibner, Fire Commissioner Alter and Chief Bassett were present and urged the Council to take positive action by formulating a new ordinance which would alert home owners to fire hazards and their responsibility in assisting in fire prevention. Fire Commissioner Hibner pointed out that the areas of Los Altos Hills, .the Country Club area, and Los Altos are pro- tected by three fire stations located in donmtown Los Altos, , Loyola, and Foothill, but that this is a small force in rela- tion to an assessed valuation of !28,000,000. Both Commissioners Hibner and Alter stated that the Hills area is most hazardous - an area where a great conflagration started by brush fires could result in great loss of lives and property. Experience has shown that the months of June, July, August, and September bring the same approximate number of brush fires every year; 53 (83%) within the past year were in these dry months when there is a greater probability. of extreme conflagration. Chief Bassett amplified these remarks and proposed the follow- ing measures: For the Home Owner: 1. Fire extinguishers. 2. Remove brush from around dwelling and replace with fire resistant plants and slow -burning shrubs. 3. Clear ravines and gullies of brush. 4. Incorporate fire resistants into shingle roofs. 5. Education and publicity on fire prevention. For the Town: 1. Weed abatement ordinance (discing fire -breaks and fire trailsalong roadsides, etc.). 2. Fire ordinance (30 -foot disced fire -break around house, removal of brush from ravines and down slopes, pools to have fire department connections, etc.) -4- NEW BUSINESS: Fire Prevention (Cont'd.): Since this matter is of such importance to the welfare of the people of Los Altos Hills, Fire Commissioner Hibner requested that the Mayor.appoint two Councilmen to join with Fire Chief Bassett, two Fire Commissioners and the City Attorney in a study session to formulate a fire ordinance that will be effective by next spring when the hazards of brush fires are again present. Mr. Hibner requested an ordinance that' will be articulate and comprehensive, throughtfully prepared, and enforceable. Player Clayton thanked Fire Commissioners Alter, Hibner and Fire Chief Bassett for their pertinent report and announced that he would appoint immediately two Councilmen to join in an early study session with the City `.ttorney and the Fire Committee. Commissioner Hibner thanked Mayor Clayton for his cooperation and assurance of the early expediting of a fire prevention ordinance. The Mayor called a recess at 9:35 F. M. and the meeting was re- convened at 9:44 F. M. 4. Frank P. Macdonald (268-63) 1 lot. _ Mr. Macdonald, in his letter dated November 16, 1964, advised ( the Council that since the Greene property has been sold, it is now impossible to work out a joint proposal for off tract improvement of Magdalena Road. He therefore submitted his individual proposal and cost estimate for resurfacing and path fund in -lieu payment. It was the City Manager's recom- mendation that the proposal be accepted, subject to the City Engineer's approval of the cost estimate. ACTION: That Mr. Frank P. Macdonald's offer dated November 16, 1964 be accepted, subject to the City Engineer's verification and approval. MOTION: Aiken; SECOND: Henley; VOTE: Psssed unanimously. OLD BUSINESS: L building Site Approval (Ordinance No. 99) - Continued discussion. Flanning Commissioners Garbett, Hibner and Alter were present. Chairman Garbett advised the Council the Commission did not have any recommendations but would prefer to continue with the discussion. Discussion centered on the purpose, and need of Ordinance No. 99, �) accuracy of record of surveys, requirements for off -tract improvements, burden of cost and delay, monuments; with suggestions to omit the Tentative Map, substituting an -5- -OLD BUSINESS: Ord. No. 99 (Cont'd.): engineered survey certifying the points, or limit the ordinance to lots created by metes and bounds. Commissioner Hibner was of the opinion these lots could be handled on a record of survey with an inspection by the FlanningCommis- sion through its Map Committee, at which time a check list could be developed if off -tract requirements were required. Mayor Clayton interrupted the discussion to.hear Mrs. Smith's report on PATH411YS: Gardner Bullis School Vicinity. Mrs. Emerson Smith, of 25293 Cantata '.Jay, reported that numerous attempts to contact the owner of property on Fremont Road to discuss a path easement had failed. Condemnation was discussed butrejected, the only apparent alternative being an additional crossing guard; however, it was suggested the road might be moved to utilize the right - o£ -way as a path., as opposed to the cost of a crossing guard. The Mayor directed the City Manager to prepare a comparative report at the next Council Meeting of December ']L^. DISCUSSION OF ORDIN„NCE N0. 99 CONTINUED: It was discussed that the purpose of the ordinance was one of review to make sure that the lot conformed to present day standards and that off -tract improvements and dedications could be reouired without being compelled to issue building permit on every lot submitted. The Council was willing to entertain any recommendations for modification, but remained adamant in their right of review and to require improvements.nd. dedications which "may” be deemed necessary. With this in mind, the Mayor instructed the City Attorney and City Engineer to make recommendations for written modifications to ;existing Ordinance No. 99• A� 14LRR2,NTS : 1.
