Henley called the Regular Meeting of the City Council of the Town of Los Altos Hills to order at 7:53 P. M. in the Council Chambers of the Town Hall, 26379 Fremont Road, Los Altos Hills, with the following members answering Roll Call: Present: Councilmen Aiken, Benson, Davey, Fowle, Mayor Henley. Absent: None. The Planning Commission was represented by Commissioner Gordon B. Bowler. APPROVAL OF MINUTES: 04 MOTION: Councilman Davey moved, seconded by Councilman Fowle, that the Minutes of September 10, 1967 be approved as circulated. Motion was unanimously carried by Voice Vote. WRITTEN COMMUNICATIONS: 1) Letter from David Janssen, 27440 Sherlock Road, dated September 25, 06 1967, requesting twelve (12) months extension to file final subdivision map (326-66). MOTION: Councilman Benson moved, seconded by Councilman Davey, that the request of David Janssen for extension of one (1) year to October 3, 1968, to file final subdivision map (326.66) be approved. Motion was unanimously carried by Voice Vote. 2) Letter from Assemblyman George W. Milias, dated September 26, 1967 17 relating to the steps he has taken regarding the traffic noise problem on the Junipero Serra Freeway. The Mayor directed the City Manager to convey the appreciation of the Council for Assemblyman Milias' efforts and continued concern. 3) Letter from Robert B. Ward, 12910 Robleda Road, dated September 27, 22 1967 regarding landscaping to diminish sound on the Junipero Serra Freeway, and enclosing a copy of sound level recordings. The Mayor instructed the City Manager to refer all such data to Mr. Donald Miller, Chairnan of the Sound Abatement Committee and to advise Mr. Ward of such action and that the Highway Department has promised to send an acoustical engineer to advise the Council on this matter. 4) Letter from Stanley Grabowski, 25660 La Lanne Court, dated September 23, 39 1967, regarding the traffic noise situation on the Expressway affecting �.� Los Altos Hills residents. The Mayor directed that the Sound Abatement Committee also be charged with looking into the Expressway problem and instructed the City Manager to so advise Mr. Grabowski and the Committee. ANNOUNC3MENTS• 1) The Mayor announced the formation of a Town -wide Drainage Committee 62 consisting of members Leslie A. Helgesson, Francis J. Jean, Albert R. Clark, and Clyde C. Shaw, who have been charged to advise the Council on drainage problems in the Town and assist the Planning Commission when called upon to do so. 2) Inter -City Council Monthly Dinner Meeting on Thursday, October 5, 66 1967, Host City of Monte Sereno, to be hald at the Plumed Horse, Saratoga, at 3:00 P. M., was announced by the City Manager, 3) At the suggestion of Councilman Davey and with the concurrence of 66 the Council, the City Manager was instructed to obtain a film on under - grounding of utilities, "Poles Coxae Tumbling Down", to be shown before a Council meeting, and to ?ully publicize the date and time of the showing so that the public may be fully informed and invited to attend, 4) The City Attorney announced that the Public Hearing regarding Ordin- 72 ante No. 127, adopting various codes, was publicized as being heard at 8:00 P. M., and requested the Mayor to open the Public Hearing at this point and continue it to 9:00 P. hi. as stated on the Agenda. The Mayor so directed. DISCUSSION OF RECENT CHANGE IN COUNCIL MINUTE PROCEDURES - Councilman 76 OBenson. '— Councilman Benson stated this item was on the Agenda at the request of many residents in the Town that Council Minutes be recorded with back- ground discussion, as well as the action taken. MOTIO14: Motion by Councilman Benson, seconded by Councilman Aiken, that the Council go back to the previous method of record- ing Council Minutes. Council discussion followed. City Manager read written communication from Mrs. R. W. Towle, 26493 Weston Road, objecting to the lessening of contents of Minutes. Oral testinoney from the Floor in favor of the Motion was heard from: Messrs. Bill Marsh, 25541. Altamont Road, Thomas H. Marshall, 25560 Altamont Road, E. C. Railey, 13482 La Cresta Drive, and Mrs, D. Spencer, 27490 Sherlock Road. General oral testimony from the Floor relating to the discussion was heard from: Mmes. D. A. Miller, 13076 Vista del Valley Court, P. Weisbart, 27709 Via Ventana, and Messrs. E. A. Breyman , 13456 Wildcrest Drive, and G. E. Bowler, Planning Commissioner. The Mayor directed the City Manager to obtain an estimate of the cost to transcribe the tape of a full Council meeting. Motion failed by majority Voice Vote: Ayes: Councilmen Aiken, Benson. Noes: Councilmen Davey, Fowles Mayor Henley. Absent: None. -2- PRESENTATI0N OF METCALF & EDDY REPORT: 173 Mr. Dean F. Coburn, of Metcalf & Eddy, submitted Progress Draft upon Alternate Methods of Sewage Disposal dated October, 1967. Council accepted the report for further study and the City Manager was instructed to agenda a Study Session on Tuesday, October 10, 1967 at 6:00 P. N. in the Council Chambers with members of the Sewer Committee. Councilman Aiken submitted for record excerpt from Regional Exchange, August -September issue, on "The Future Land Requirements for Sewage Treatment Plants". COUNTY LIB181RY COI&IISSION - Consideration of Nominee: 265 No action was taken by the Council in view of the highly qualified nominees already submitted by other Cities to represent the County at -large. ASSEMBLY JOINT RESOLUTION NO. 29 re FEDERAL TAX' SHARING: 253 City 11anagcr read letter from Assemblyman Bob Monagan, Twelfth District, dated Zepteribar 4, 1967 regarding support for AJR 29. Council discussion /- followed and matter was deferred to Agenda Item R35OLUTIONS for adoption. 1, CONSIDcRaTION OF APPOINTAMFNT C1Z AUDITOR FOP. 1967-65 FISCAL YEAR:. 2?2 MOTION: Council:aan Fowle moved, seconded by Councilman Aiken, that the Council retain the firm of C. G. Uhlenberg & Co. for the 1867-63 audit for a fee not to exceed $900.00 as per their proposal dated September 29, 1967. Motion was unanimously carried by Roll Call Vote: Ayes: Councilmen Aiken, Benson, Davey, Fowle, Mayor Henley. Noes: None. Absent: None. USE A3RMIT - STUERS, MARY G. (UP -297-67) - Request for Secondary Dwelling 307 on 14+ acre parcel at 11641 Buena Vista Drive. MOTION: Councilrian Aiken moved, seconded by Councilman Benson, that the request of Nary G. Steers (UP -207-67) be approved, subject to the conditions as set forth by the Planning Coc:r,ission. Council discussion followed and City Attorney was instructed to take tha proper steps to determine the status of Buena Vista Drive, Central Drive, and Moody Court. Motion was unanimously carried by Voice Vote. PUBLIC HEARING REGhRDING ORDINANCE NO. 127 ADOPTING VARIOUS COD35: 36:: <) At 9:00 P. M., the Mayor declared the Public Hearing on Ordinance No. 127 open. The City Manager advised that notice of the hearing had been duly given as required by law. There was no written communication filed or oral testimony given frog: the Floor. At 9:02 P. M., the Mayor declared the Public Hearing closed. -3- PUBLIC FEARING - ORDINANCE NO. 127 continued: 370 { The City Attorney read title of Ordinance No. 127, an ordinance of the Town of Los Altos Hills, adopting the Uniform Building Code (1967 Edition) of the International Conference of Building Officials, The Uniform Plumbing Code (1567 Edition) of the International Association of Plumbing and Mechanical Officials, and The National Electrical Code (1965 Edition) of the National Fire Protection Association, regulating the construction, alteration, renovating and remodeling of building, the installation of plumbing, gas and electrical facilities and appliances, the installation of certain utilities underground, the issuance of permits therefor, providing for the fees, administration and enforcement thereof, and ponalties for its violation, and repealing all ordinances or portions thereof in conflict therewith. (Second Reading.) MOTION: Councilman Aiken moved, seconded by Councilman Powle, that further reading of Ordinance No. 127 be waived. Motion was unaniiaously carried by following Roll Call Votr. There was Council discussion on direct burial cable and clarification was requested of the Building Inspector for the n_xt uceting.. BUILDING SITE APPROVAL - LIGTELYN,-RUDI (BSA -35-67) - 1 lot at and of 403 La Loma Drive. MOTION: Councilman Benson moved, seconded by Councilman Davey, that the request of Rudi Ligtelyn (BSA -35-67) be approved, subject to the conditions of the Planning Commission. Motion was unanimously carried by Voice Vote. 14ATADERO SPRINGS (330-67) TENTATIVE AW - 6ngr. C. E. Randlett: [.22 MOTION: Councili::an Benson moved, seconded by Councilran Aiken, that the Tentative Map of Matadero Springs (330-67) be approved. Motion was seconded for the exprass purposes of discussing the Santa Clara County Health Department's raquirements. 140TI011 AND SECOND WITHDRAWN. MOTION: Councilman Benson moved, seconded by Councilman Aiken that the Tentative Map of Matadero Springs (330-67) be U approved in accordance with the Planning Commission's recommendations and Check List, except that Lots #1 and #3 are not approved as building sites. Motion was unanimously carried by Voice Vote. -4- `..' ROSEHILL ESTATES: Deferred to end of Agenda at request of applicant. 473 OTHdR BUSINESS: 436 Councilman Benson questioned the status of the retaining wall to protect the deep cut on a lot in the Heuuaeter subdivision. City Engineer re- ported the cut will be protected as soon as possible. PART TIME SANITARY INSPECTOR - Report of City Manager: 497 City Manager read Staff Report with recommendations regarding a part time sanitary inspector, dated September 28, 1967. It was the concensus of the Council to take no action on this matter until the final report of Metcalf & Eddy is received. Regarding a new ordinance for sewers, Councilman Aiken read a prepared statement as follows: -1 believe the Town should set standards for septic systems based on present day knowledge instead of witchcraft, and institute a system of required regular inspection and maintenance. The cost of this could be carried by fees.'' STAFF REPORTS City Engineer: City Engineer submitted revised Assign of non -vehicular 557 l bridge with rounded edges as requested by Council on 8/21/67, and which CJ will be a part of the Standard Specifications. J i-Liyor advised the City Engineer to proceed with approval from Council. City Attorney: City Attorney explained letter fraa Mr. Allen Grimes, of 580 the California Code Service dated September 14, 1967 regarding codifica- tion of the Town's ordinances, and City Manager's comments dated September 25, 1967 on Mr. Grimes' letter. Staff was instructed to send copies to Council. Cit Flina er: City Manager reported the cost of acquiring the tape recorder 626 was $116.68 and requested Council approval to purchase a fireproof file cabinet fox the tapes. No action was deemed necessary by the Council since this purchase could be included in the prior authorization for the recorder. City Manager reminded the Council of the 69th Annual Conference, of the League of California Cities in San Francisco, October 15-16, 1967, which Councilmen Benson and Davey, City Engineer, City Attorney and City Manager will attend. PRESEIQTATIONS FROM THE FLOOR: 635 1) Stanley W. Corbett, III, 26,40 Anacapa Drive, spoke on the subject of available copies of the Metcalf & Eddy Report. City Manager reported that copies of the Progress Draft are limited, but that a copy is available at the Town Hall; however, the final report will be -available for circulation to the public. _ 2) Mrs, R. C. Casey, 26646 Laurel Lane, spoke on the subject of Sewer UAssessment District No. 3. 3) Mrs. D. Spencer, 27490 Sherlock Road, spoke on the subject of the Steers Use Permit. -5- RESOLUTIONS: NO. 411 654 1. City Attorney presented and read in its entirety, Resolution No. 411, a resolution of the City Council of the Town of Los Altos Hills relating to Governmental Tax Sharing. MOTION: Councilman Davey noved, seconded by Councilman Fowic, that Resolution No. 4.11 be adopted as read. Resolution was unanimously carried by following Roll Call Vote: Ayes: Councilmen Aiken, Benson, Davey, Fowls, Mayor Henley. Noes: None. Absent: None. ROSE HILL 3STi,TE5 - Request for extension for completing subdivision 700 improvements and for issuance of a building permit. Mr. T. MOTION: Councilcaan eowle moved, seconded by Councilman Benson, that tae Council concur with the City 6lanagor's recommendations \� and not allow the issuance of a building permit for lots in Rosetill astates, until the water facilities are completely installed and approved by the :Vater District and the Town so notified by the District. n ROSE ;TILL ESTATES Continued: At the direction of tie City Attorney, Council made clear to Dr. Shibuya, owner of a lot in subject tract, that there will be no occupancy until the sewage disposal matter is settlat. Notion was unanimously carried by Voice Vote. Tnere was no action taken on the request for extension of time to com- plete improvements since it was necessary for the developer to obtain supporting docunonts. However, in view of the time element, Council concurred. and the Mayor directed this meeting to be adjourned, to October 10, 1':67 as a Regular Adjourned meeting, at which time this one ite..; only would be considered on the Agenda prior to the Study Session with the Sewer Committee.
