Henley, at 7:55 T. N'`. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. ROLI: CALL: FRP=ldT: Councilmen Aiken, Bowler, Mayor Henley ABSENT: Councilmen Clayton, Fowls Mayor Henley apologized for any inconvenience to the Town's people due to the April 18m meeting being adjourned to April 19, 1966, for lack of a quorum. The following statement prepared by Councilman Aiken and at his request and without objection is incorporated in the Minutes at this point: "I wish to state that, contrary to word that was passed around, I was here for last nite's meeting as were 4 of the 5 councilmen. I understand Mr. Clayton had signified he would and wanted to attend. I have objected to Mr. Henley the cancelling of this meeting when so many townspeople were known to have made arrangements to attend." APPROVAL OF MINUTES: April 4, 1966. Omission: Page 2, Item 3, McCulloch Investment Co. (318-66), add "Councilman Aiken requested the City Council to consider the requirement of fire resistant plantings, as recommended by the Fire Chief, be placed on all Tentative Maps and will submit a recommendation on methods for its incorporation into the Town's requirements." ACTION: That the Minutes of April 4, 1966 be approved, subject to the inclusion of Councilman Aiken's remarks on fire resistant plantings. NOTION: Bawler; SECOND: Aiken VOTE: Tossed unanimously. GENER6L M[JNICIFAI ELECTION: (a) Ballots of the General Municipal Election, held April 12, 1966, were canvassed.. Resolution No. 346, a Resolution of the City Council of the Town of Los Altos Hills, declaring the result of its canvass of the precinct election returns of the General Municipal election held on April 12, 1966, was introduced and read in its entirety by the City Attorney. ACTION: Adopt Resolution No. 346 as read. - MOTION: Bowler; SECOND: Aiken ROLL CALL: AYES: Aiken, Bowler, Mayor Henley NOES: None ABSENT: Clayton, Fowle (b) Administration of Oath of Office. Oath of Office was administered to Mary C. Davey by the City Clerk. City Council extended congratulations to the newly elected Councilman. It was noted at this time the offices of Mayor (2 -year term) and Deputy Mayor (1 -year term) will be vacant in May, 1967 and May, 1966, respectively. COMMITTEE REPORTS: 1. Law Enforcement Committee: Re Swimming Pool Fencing. City Manager read letter dated April 8, 1966 from Mr. A. E. Corduan, Chairman of the Law Enforcement Committee, replying to the City Council's request of February 21, 1966 that the above subject be added to its overall safety program, and therein stating it was the concensus of the Committee that the problem was more directly related with the Planning Commission function, as well as the City Attorney's office regarding the legal aspects of such an ordinance. _ Mayor referred this matter to the Planning Commission for their early advice. Since it was through a request from a worried father of a young child that Councilman Bowler brought this matter before the Council, he requested that the Flanning Commission give considerable thought to this complex problem, keering in mind the Town's responsibility to the parents of young children. -2- OLD BUSINESS: .r )' 1. Planning Commission Arpointments. Mr. Charles A. Walter, Jr., 24240 Summerhill Road (substitut- ing for Mr. Randall L. Jones, 10791 Magdalena Road) presented and read a petition signed by approximately 500 residents of Los Altos Hills, requesting that Dick Towle and Priscilla Weisbart be appointed to the Planning Commission, since they are known to be especially firm in regard to the Town's zoning and in this way, the Council will be showing good intentions and its responsiveness to the wishes of the people. Mr. Richard W. Towle, 26493 t^;eston Road, submitted a written statement dated April 19, 1966 withdrawing his name and deferring to Mrs. Weisbart since he was informed Mr. Prentice would be reappointed to the Planning Commission, should he wish to continue. Mr. Towle further stated his interest and avail- ability should future openings occur. Mayor Henley acknowledged the petition, stating it should and will receive consideration from this Council. However, during ensuing discussion, Council was not in full agreement as to how much consideration should be given a petition in relation to,. an appointive office. Comments regarding the petition and the Planning Commission appointments were heard from the following residents: .Ralph M. Towle, 26493 Weston Road Mrs. Frank Olgiati, 25960 Vinedo Lane Mrs. Janice Micheletti, Becky Lane Upon Mrs. R. L, Jones' (10791 Magdalena Road) request and upon instruction from the Mayor, it is hereby a part of the record that Mrs. Jones has indicated her dissatisfaction of Commis- sioner Prentice's attendance as officially listed within the last three years. Mayor Henley suggested the City Council defer consideration for the appointment to the seat of Charles R. Garbett, since he has asked Commissioner Garbett to do his last service for the Town by representing the Town as Commissioner before the Highway Commission in Sacramento with regard to the crossing at Page Mill Road and the Freeway. The Chair then asked for Nominations for the appointment of the seat now occupied by Mr. Prentice. -3- _OLD BUSINESS: Planning_ Commission Appointments (Cont'd.): NOMINATIONS: That Alexander C. Prentice, Jr. be nominated to continue in the Office of Planning Commissioner. MOTION: Bowler; SICOND: Davey Councilman Bowler stated heh)s been assured by Commissioner Prentice that he will be able to participate fully. ACTION: That Nominations be closed and a SJhite Ballot be cast. MOTION: Bowler; SECO D: Davey ROLL C:J,L: AYES: Bowler, Davey, Mayor Henley FOES: Aiken ABS7NT: Fowle Councilman Aiken voted "No" because of Commissioner Prentice's attendance record. Councilman Aiken further objected, in view of the inconvenience caused by the recently adjourned meeting and this evening's full audience participation, that any further deferment of the appointment of the Commission vacancy was not acting in good faith to the Town's people and suggested Commissioner Garbett be retained for the special assignment but that the City Council pass on an appointment now, of£ective at a later date. NOMINATION: Councilman Liken nominated Priscilla Weisbart for Office of Planning Commissioner. Mayor Henley reported his discussions with other possible appointees and in view of Commissioner Garbett's important cop tribution to the Town, he felt a delay and more deliberation was necessary. Councilmen Bowler and Davey also agreed a delay for fo.ther consideration of an appointee was desirable. Councilman Bowler stated he was absolutely non -committed on the appointment of any specific individual. It was pointed out the Council must be free to choose its own advisors, since the ".cats Law makes it clear the Planning Commission is an appointive office. Iiayor Henley declared the Public Hearing open at 9:12 F. H. and asked for bids on the 10' strip of public land as described in Exhibit 1 of Resolution No. 345. The City Attorney announced he was in receipt of one bid., in the amount of ''$25.00 cash, submitted by John E. Warner, 25631 LaLanne Court, Los Altos Hills. The Mayor called for further bids. There were none. The Public Hearing was closed. at 9:16 F. M. The City Attorney introduced and read in its entirety Resolution No. 34'7, a Resolution of the City Council of the Town of Los Altos Hills pertaining to sale of certain City - owned property. ,CTI ON : That Resolution No. 347 be adopted as read. City Manager read letter dated ADril 11, 1966 from Maynard B. and Shirley .L. Stevenson, requesting de -annexation from Los IItos Hills. Mrs. Janet Germane - Request for adoption of name for private .road in Page Mill Estates. City Manager read letter from Mrs. Gayton Germane dated a.rril 12, 1966, requesting Council approval of street name for private road, submitting the names 1) Radcliffe Lane, or, 2) Bucknell Drive. City Manager reported it is the desire of the lire District to have all private roads named, .^.nd the names submitted have been approved by the Fire Chief and are in keeping ;with the names of the public roads within the subdivision. ACTION: That the first choice, Radcliffe Lane, is acceptable to the Council.. "OTION: Aiken; SECOT_dD: Bowler; VOTE: Passed unanimously. 4. Adoption of Variance Application Form. City Manager submitted revised variance application form, as recommended by the Ilanning Commission. ACTI0F: That the revised variance application form be adopted pursuant to Ordinance No. 78, Section 13:10. NOTICE: liken; ::FCOND: Bowler; VOTE: reseed unanimously. USE PERMIT: 1. Fremont 'stills Country Club (UP -250-66) - Request for Additional Tennis Courts. City Manager read Planning Commission's recommendations, particularly noting its recommendation regarding the service road, ,and letter from the City Engineer dated April 18, 1966, objecting to the proposed location of the service road. -6- USE FERMIT: Fremont Hills Country Club (Cont'd.)o � Mr. John Hays, President of the Fremont Hills Country Club, stated he was convinced the proposed service road could be made safe with a minimum expenditure (a necessary factor for the Club), proposing the removal of two trees and a grading of a "shelf" at the intersection. In view of this new proposal, the Mayor suggestedthat a com- promise solution, be worked out with the City Engineer. Mayor Henley noted for the record that he was not a member in good standing in the Club .and therefore had a free choice of voting on this matter. f CTION: That the request of Fremont Hills Country Club (IIF -250-66) for three additional tennis courts and service road be approved, subject to a solution satisfactory to the City Engineer upon review of the more recent proposal, and subject to the road being restricted entirely as a service road and not as an auxiliary exit. AMENDED MOTION: If the trees are to be removed, that a suitable replacement be planted and care be provided for two summers, as a condition of the Use Permit. !=,i,iDED BY: Bowler; ACCEPTED BY: Aiken; Councilman ;iken commented that the City Council has refused Mr. Bellucei's enlargement of ,'.dobe Creek Lodge and that it has improved the Fremont Hills Country Club, and questioned whether the Club was put in at the insistence of the City Council at the time it was ap^roved. The City Manager reported the Town did request a recreational element be installed in the area and was given anrroval subject to specific conditions, and suggested that the con- ditions of this use permit, as well as others within the Town, be reviewed. Only in the absence of comments from the Floor and that the results were to the satisfaction of the City Engineer, was the following Notion made: ACTION: That the Tentative flap of Hillcrest Estates Unit No. 3 (319-66) be approved, subject to the recommendations of the Planning Commission and Approving agencies. MOTION: Bowler; SECOND: Liken; VOTE: Passed unanimously. 2. Pa&emont Hills (315-66) 24 lots - Engrs. Riley R Floyd. Arplicant requested the Tentative hap of Pagemont Hills be withdrawn from the Lgenda, without prejudice. Council had no objection. RESOLUTIONS: 1, Abandonment_ of Public Utility -Easement - Tract No. 3425. The City Lttorney introduced and read in its entirety Resolution No. 348, a Resolution of the City Council of the Town of Los Altos Hills vacating a certain public utilities easement. COMMUNICATIONS: 1. Norman K. ''dessells, 27855 Moody Road., letter dated Arril 17, 1;06, complaining of the use of property at 27861 Moody Road, on a number of grounds, particularly the fire hazard, and requested the Council to take stens to alter the situation. Mr. D. Spencer, 27490 Sherlock Read, spoke on the problems of this situation. With full consent of the Council, the Mayor referred this matter to the City Attorney for investigation and a report at the earliest Dossible date. S`Z r,NNOT10ED77TS : 1. City Clerk `1,/3/man Town of Los lltos Hills RESOLUTION NO. 346 A RESOLUTION OF THE COUNCIL OF THE TOWN OF LOS ALTOS HILLS, DECLARING THE RESULT OF ITS CANVASS OF THE PRECINCT ELECTION RETURNS OF THE GENERAL MUNICIPAL - ELECTION HELD ON APRIL 12, 1966. WHEREAS, by Resolution No. 337, passed and adopted on the 7th day of Februar , 1966, the CiTy Council called and ordered a General Municip- a�'Rlection pursuant to Section 22803 of the Government Code of the State of California for the purpose of elect- ing two councilmen; and WHEREAS, notice of said General Municipal Election was duly published as required by law and by said resolution; and WHEREAS, it appears that said General Municipal Election was duly held in accordance with the law and said call on the 12th day of April, 1966, and that the polls for said election were kept open during the time required by law, and that said election was held and conducted, and the votes thereat received andr declared, all as provided by the laws of the State of California; and.
