TOWN OF LOS ALTOS HILLS
MINUTES OF A CONTINUED SPECIAL MEETING
May 23, 1966
The Continued Special Meeting of the City Council of the Town of
Los Altos Hills was called to order Monday, May 23, 1966 by Mayor
Albert T. Henley, at 7:40 I.. M. at the Town Hall, 263']9 Fremont
Road, Los Altos dills, California.
ROL1. CALL: PRESENT: Councilman Davey, Bowler, Fowls,
Mayor 'ienley
ABSENT: Councilman Aiken
Before proceeding with the Special Meeting, the Mayor announced
receipt of a gift from Gertrude Sherlock of a United States flag
given her in memoriam of her late husband, Thomas Sherlock, which
will replace the Town's flag which was apparently stolen. The
flag was acknowledged with extreme appreciation and thanks to
Mrs. Sherlock.

Trucking Violations on Magdalena Road.
At the Special Meeting of the City Council called to order on
Monday, Play 23, 1966 at 8:30 I'i., Councilman Fowls was re-
quested to submit a report on the possibility of alternate
routes and Deputy City Clerk Smith requested to report on the
cost of recent improvements to Magdalena Road and the estimate
of repairs, as well as the reconstruction of same.
Councilman Fowls stated his oral report was not a recommendation,
but a determination of facts. Routes were observed with the
help of Mr. George H. Neary, Jr., 24840 Prospect Road, Los altos,
and the Deputy City Clerk. Summarily, Councilman Fowle's report
discounted rerouting over the Freeway and Expressway as
impassable and Summerhill Road as not feasible, and offered the
following possible alternate routes:
1) Via E1 Monte and Fremont Road, or
2) Via presently used route of Magdalena, or
3) Possibility of a combination circular route froom. quarry
via El Monte -Fremont and return empty trucks via
Magdalena Road.
Councilman Fowle reported he had conferred with the County, who
is responsible for the granting of contracts for the paving of
the General Expressway System. The County indicated their
willingness to cooperate, however, suggested that a voluntary
�) arrangement between the three major contractors involved would
be a better solution, if the request appealed to their sense

of cooperation and in a reasonable way. Mr. Neary has offered to
negotiate with these contractors.
Deputy City Clerk reported the portion of hagdalena between
Ravensbury and Hooper Lane, a strip 1265' long, was repaved
by the Town in April, 1964, at the cost of 12,300; today, it
would cost approximately 12,900. due to increased costs for
labor and materials. The cost to replace in the condition it
was a month before the trucks would be approximately 1650.00.
Reconstruction of that area wouldbe approximately 19,600., or
greater if an increased amount of base rock were necessary.
Mr. George H. Neary, Jr. commented on his negotiations and the
proferred solutions. Mr. Neary did not agree that he does not
have the right to use this road for trucks and any compromise
would be on the basis of reasonableness.
Mr. A. S. Alter, 24290 Elise Court, commented that the present
ordinance should be enforced.
In reviewing Councilman Fowle's report, Council discussion
suggested two courses open to the Town - 1) enforce the
ordinance as written, taking the legal view that it is
enforceable, or 2) enter into a compromise with the contractors
involved (for whom Mr. Neary is only the supplier), and enforce
that compromise by not relying on expressions of good will but
enacting an emergency amendment to the existing ordinance to
cover the situation, which at a later date could be repealed
when the situation has been accomplished.
The Mayor requested comments from the Floor. There were none.

That the City Attorney be instructed to prepare
a temporary emergency ordinance covering a period
of thirty (30) days and providing for a temporary
alternate truck route for unladen vehicles going
in a westerly direction over the Town -owned portion
of I;agdalena Road.
MOTION: Bowler; SECO_^D: Fowle
There being no objection, the I',ayor instructed the City Attorney
to so proceed.
Comments regarding the Motion were heard from Messrs. G. Bullis,
14085 Hanuella Road, J. D. Giulie, 11181 Magdalena Road, and
Mrs. J. Sweeney, 27990 Via Ventana.
At 8:35 F. M., the Mayor adjourned the Continued Special Council
i meeting to the adjoining offices within the Town Hall to continue
its meating in order the Planning Commission might call to order
its regularly scheduled meeting in the Council Chambers.

CONTINUED DISCUSSION OF TRUCKING VIOLATIONS:
_4t 8:40 P. M., the Mayor reconvened the continued Special
Meeting, at which time the City Attorney read., in full, a
proposed emergency ordinance, being No. 114, an Ordinance of
the City Council of the Town of Los Altos Hills, amending
Ordinance No. 87 of said Town by adding a temporary additional
truck route and declaring the existence of an emergency.
ACTION:
Adopt Ordinance No. 114 as read.
MOTION: Bowler.; SECOND: None
Following discussion by members of the City Council, the
Mayor declared the Motion had died for lack of a Second.
The Mayor instructed Police Chief C. J. Smith, of the Town of
los Altos Hills, to contact the Santa Clara County Sheriff's
Office to enforce any violations of the existing ordinance.
There being no objection, the Mayor adjourned the meeting at
9:10 I. P,. to the next regularly scheduled meeting.
