MINUTES OF A REGULAR MEETING
1 August 15, 1966
The Regular Meeting of the City Council of the Town of Los Altos Hills
was called to order Monday, August 15, 1966 by Mayor Albert T. Henley
at 7:54 P. M. at the Town Hall; 26379 Fremont Road, Los Altos Hills,
California.

ACTION:
That the Council approve the expenditure of funds for
attendance at the conference of Councilman Davey, the

Letter of August 5, 1966 from Wayne H. Miller, Miller Properties,
requested an extension of time, to August 16, 1967, to file the
final map of Tract No. 4115.

ACTION:
-� That the request for an ,extension of time to file the final
map of Silent Hills Ranch Subdivision Tract No. 4115 be
approved, subject to approval of the bondholder.

2. BrasserPhyllis E. - Request for Extension of Time to File Final
Map an omp ete Improvements.
The City Clerk explained that letter of August 6, 1966, -from
Mrs. Brasser, requested an extension of time to file final map
of 3 -lot subdivision (Phyllis Wilson, Tract 2518). He further
stated that the Council has granted two previous extensions.
ACTION:
That Phyllis E. Brasser be granted a thirty day extension,
to September 15, 1966, to file final map of Tract No. 2518.

SCHEDULED ITEMS:
1. Carson, M. A. V-263-66) - Appeal of Planning Commission Recommend-
ation £or Request for Reduction of Setback Requirement.
Councilman Fowle absented himself from discussion and action on
this request.
The City Clerk stated that all objections have been withdrawn,
with the exception of Mr. David M. Fleming (letter of July 11, 1966).
AC'TIOi?:
That the Council approve the request of M. K. Carson (V-263-66)
for reduction of the setback requirement, subject to the cond-
ition that the building permit require the conditions as set
forth in Mr. Carson's letter of August 9, 1966..

The City Clerk read the recommendation of the Planning Commission
of August 8, 1966 approving the Tentative Map of Dusenberry and
Bewley (326-66) Mark I, dated July 29, 1966.
Letter of August 9, 1966, from Mr. Dusenberry requested waiver of
the requirement for filing a Record of Survey until such time as
the property is subdivided, and the use of metes and bounds
description to transfer title.

ACTION:
{� That the request of Arthur W. Dusenberry (326-66) for an
adjustment of the property line (Duzenberry-Bewley), by
metes and bounds description, be approved, subject to
the condition that Parcel I be designated as 'Not a
Building Site'.

Note: No map will be filed at this time; survey and recorda-
tion of map will be required prior to issuance of any
building permits for this property.
The Question was called.

SCIEDULED ITEMS:
2. Rose Hill Estates (322-66)_26 lots. Final Map Tract No. 4215.

The City Clerk read theprovious action of the Council, approving
the Tentative Map, and explained that the bond and the Subdivi-
sion Agreement have not been filed due to involvement in a pro-
posed assessment district for sanitary sewers. He explained that
his signature will be withheld from the final map until all re-
quirements have been complied with.
Councilman Fowls explained problems relative to the proposed
sewer assessment district.
ACTION:
That the Final Map of Rose.Uill Estates Tract No. 4215 be
approved, subject to the Planning Commission's recommenda-
tion, approval of cognizant agencies, and the withholding
of signature on the map until all requirements of appli-
cal ordinances have been complied with.

3. Private Roads in New Subdivisions.
Committee Report of Councilmen S. M. Fowls and G. E. Bowler, of
May 16, 1966 as revised August S, 1966, was discussed by Council-
man Fowls along with the letter to him (May 26, 1966) from Com.
M. L. Hawley of the Planning Commission.
Discussion was mainly relative to private roads in new subdivi-
sions, the present allowance of five lots being served from a
private road; the inclusion/exclusion of private road area from
net acreage of a subdivision; the possibility of a provision

for a future subdivision being served from a private road already
serving five lots; covenants and/or assessment districts for
maintenance of private roads, standards for private roads, and.
the possibility of a private road becoming a public road.
In reference to Commissioner Hawley's letter, discussion followed
relative to criteria for allowing private roads serving more then
five lots under special circumstances, i.e. covenants for mainten-
ance and standards.
Councilmen concurred in that consideration should be given to the
possibility of allowing more than five lots on a private road
under specific conditions and providing the road could eventually
become a public road. The same intent was expressed with reference
to pre-existing private roads where there is a new subdivision,
and that maximum standards should be maintai-ned in order- that rrivgte
roads are free from hazards.
The City Attorney commented on the difficulties with covenants
and future buyers, and questioned whether this type of covenant
could be binding. He stated that most cities are against private
roads, and expressed his disfavor.
Comments were heard from Messrs. Robert J. Nyren and Donald E.
Spencer and Mrs. Lynn W. Hunton, all residents on private roads.
Mayor Henley tabled further discussion to September 5, 1966 and
requested Councilman Bowler to edit the points discussed, and
instructed the City Clerk to have the matter placed on the Agenda
for twenty minutes discussion.
4. Gould, Richard V-265-66) - Request for Twelve Foot (121) Fence
Within Twenty- ive Feet (25') of the Property Line for a Tennis
Court.
Recommendation of the Planning Commission, for approval, was read.
ACTION:
That the request of Richard Gould (V-265-66) be approved as
recommended by the Planning Commission, subject to the
condition that the two planted areas (north and eastsides)
outside the proposed fenced court, be properly maintained..

5. Purchase Order of New Truck.
The Report of City Clerk was postponed to the next meeting.

7• Staff Reports:
1. Radar Unit.

The City Clerk reported that the Sheriff's Department would
go along with the plan (the Town's purchase of radar unit to
be used by Deputy Sheriff).
Councilman liken questioned the matter of maintenance of
equipment and cited the importance of accuracy of radar units
with regard to citations.
The Mayor requested the matter be put over to the meeting of
September 5, 1966.
2. CompletionDates of Junipers Serra Freeway and Foothill
The City Clerk reported the dates for completion to be as
follows:
Freeway portion through Los Altos Hills - 14arch 15, 1967,
weather permitting.
Expressway, between Page Mill Road, Los Altos Hills and
Riverside Drive, Los Altos - October 15, 1966; between River-
side Drive and Junipero Serra Freeway - May, 1967.
3. Swimming Fool Fencing•
The City Clerk reported findings on inquiries made of cities
in San Mateo ,nd Santa Clara Counties having a requirement
for fencing of swimming pools, either by ordinance or code.
In San Mateo County, six cities require fences and seven do
not require fences.
In Santa Clara County, seven cities require fences and six
cities do not require fences. Santa Clara County requires
fencing of pools in unincorporated areas.
The Clark was requested to secure ordinances or codes from
the Cities of San Jose, Falo Alto, Los Altos and from the
County of Santa Clara; to report to the Council, at the next
meeting, relative to the effect fencing regulations have had
on the number of accidents in the cities requiring fences.
It was noted that there are letters in objection to fencing
of swimming pools in Los Altos Hills as well as petitions
for fencing of pools.
4. Removal of Trees on Magdalena Road at Tract 'To. 4034.
- Letter of August 10, 1966 from Mr. George L. Stevens was read
requesting permission to remove trees on Magdalena Road with-
in the street right of way, stating the trees are hazardous

and unsightly.
The City Clerk reported that a large tree was removedto
allow improved sight clearance, and that other hazardous
dead trees have also been removed. He stated that r,r.
M. Johnson will replace these trees.
ORDINANCES:
None.
RSOLUTIONS:
None.
IFARRANTS_:
Bills, in the amount of THREF THOUSPQ TWO HUNDRED THIRTY DOLLARS
and Eight Cents (13,230.08), were presentedfor approval by Council-
man Fowle.
ACTION:
That the bills, be approved, as presented, and the Clerk
( be authorized to draw the appropriate warrants.

OTHER BUSIT,SS:
1. Councilman Fowle - Report on Meeting Re: Sewers With City of
Fale Alto.
Councilman Fowle reported that he had recently attended a meeting
called by the Mayor of Falo alto and attended by the representa-
tives of Sunnyvale, Mountain View and Los .".ltos to discuss a
proposal for a joint engineering study to be undertaken in which
cities in the north county would participate. The study is to be
made on regional sewage collection, treatment and disposal.
Mr. Henry V. Seward asked about the time table for sewers in the
area of Matadero Hills Subdivision, commenting on the number of
expensive homes being constructed in the area, with septic t.nlcs,
and the problem of requesting these homeowners to pay for sewers.
Councilman Fowle stated he couldnot give a time table at t'ais ;i -n
that tho plans discussed were for long range development due to
- increased standards set by the State regarding treatment -a'O dis-
posal of sewage.

2. Committee - Central Drive.
Mayor Henley reported that he has formed a committee to study
the Central Drive problem and that upon acceptance of in--
vitation by members, names of the committee will be announced.
3. Expressway Phase II.
Councilman Davey suggested that the Council review the Phase II
Expressway Program, stating that the material pertaining to the
Iage.Mill Road areaa is a concern of the Town.
Councilman Bowler commented on the bond election scheduled
for February 1967 which would give approval of financing of
the Phase II Program. He stated his opinion that the Council
should formulate a position with regard to the pl^n for a
four -lane scenic route for Page Pu ll Road (the only access to
a large amount of land within the boundary of the City of Palo
Alto).
L1. Tr-ansoortation rolicy Committee.
Councilman Davey accepted the appointment to serve :as alternate
representative to the Transportation rolicy Committee.
5. The City Attorney reported that he is defending a. storm
drainage suit against the Town.
The f'iayor announced the meeting would be adjourned to Tuesday,
September 6, 1966 :'t 7:45 P. M, due to the Labor Day holiday.
