HomeMy WebLinkAbout10/03/1966CITY COUNCIL TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING October 3, 1966 The Regular Meeting of the City Council of the Town of Los Altos Hills was called to order Monday, October 3, 1966 by Mayor Albert T. Henley at 7:50 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. ROLL. CALL: PRESENT: Councilmen Bowler, Davey, Fowls, Mayor Henley ASSENT: Councilman Aiken APPROVAL OF. MINUTES: September 19, 1966. Councilman Bowler referred to letter dated 9/28/66 from F. M. Oliver, 25617 Elena Road requesting consideration of an amendment to the above Minutes. Approval of Minutes of September 195 deferred to end of Agenda. COMMUNICATIONS: j 1. Mrs. Randall Jones, President of the Los Altos Hills Association, letter dated September 30, 1966, regarding a real estate listing for multiple dwelling at 10477 Magdalena Road (McDougall property). Letter was read by City Clerk. City Clerk and City Attorney were instructed by Council to immediately investigate the matter, and if the situation is as charged, prompt notice should be given to the owner and a report made to the Council of the results of such investigation and notice. Councilman Bowler pointed out that at the time of construction of the dwelling a protest by a citizen was made a matter of record that a duplex was being built and that Council Action of May 4, 1964 reflected its intentions should other than the permitted use be noted. Petition dated September 26, 1966 containing thirteen signatures, calling attention to Council of the situation noted above. Petition was acknowledged by Council. ANNOUNCEMENTS: 1. Inter -City Council Monthly Dinner Meeting, Thursday, October 65, Host City Saratoga, at the Plumed Horse. Mayors' Committee Meeting at 6:30 P. M. UNSCHEDULED ITEMS: 1. Clark, Dr. Dean (BSA -30-66) 1 lot - Engr. Mulberg. The City Clerk read recommendations of Planning Commission and Check List. Council concurred with the City Engineer's recommendations that a Parcel Map be filed in order to re - subdivide the 31 lots into one parcel. The City Engineer assured the Council that all conditions of the Check List must be met before the Parcel Map will be signed and recorded. Regarding improvements of Kingsley Avenue, it was discussed that it is of no value except to Dr. Clark and could be treated as his private driveway, until some other need is developed. ACTION: That the request of Dr. Dean Clark (SSA -30-66), 1 lot, be approved in accordance with the Check List submitted by the Planning Commission, and subject to improvements of Kingsley Avenue as specified by the Town Engineer. MOTION: Bowler; SCOND: Fowle Dr. Clark stated that at some future time he planned to seek abandonment of the northerly part of Kingsley Avenue and there fore Kingsley will just be his driveway. The Question was called: VOTE: Passed unanimously. SCHEDULED ITEMS: 1. Discussion of Private Roads - Deferred to conlusion of Scheduled terns. 2. City Engineer - Sewer Report. City Engineer, G. E. Cook, submitted engineering report dated August 1966 concerning the feasibility of constructi and trunk line sewer system within the Town of Los Altos y reported on the conclusions of said report. Council concurred that the report was too new to generate a general discussion at this time, and the Mayor instructed the City Clerk to make five copies (since there is a limited supply) available to interested citizens for study at the Town Hall so that at an early date a general discussion can be held. ACTION: That the Sewer Report dated August, 1966, as submitted by the Town Engineer, be accepted. MOTION: Bowler; SECOND: Fowls; VOTE: Passed unanimously.- -2- SCHEDULED ITEMS: 3. E. R. Hanna - Altamont Basin Sewer Report. Mr. E. R. Hanna, Consultant to the Town of Los Altos Hills, submitted and read a written report to the Council, received September 26, 1966, on sewering of the Altamont Basin. It was Mr. Hanna's recommendation that the Council institute Proceedings in accordance with recommendations of the Bond Counsel, in order to secure the necessary facts upon which the Council and property owners may base a decision; however, a statement from the County Health Departmentis necessary to initiate the action. The City Clerk was instructed to obtain such a statement. ACTION: That the Council go on record as adopting the recommendations of Mr. E. R. Hanna as set forth in his report dated September 26, 1966. TIOTION: Fowls; SECOND: Bowler Mr. H. W. Crane, 25434 Altamont Road, did not wish,tb_be included in the assessment district.' The Mayor advised Mr. Crane that .protests will be heard in .the appropriate order of Proceedings. The Question was called: VOTE: Passed unanimously. 4. E. R. Hanna - Consultant's Final Report. Mr. E. R. Hanna submitted his final written report to the Council, received October 3, 1966, and presented a brief oral report. The Mayor instructed the City Clerk to reproduce fifty copies of Mr. Hanna's report for distribution to the Council and Planning Commission, and that the remaining copies be made available at the Town -Hall for interested residents. ACTION: That Mr. E. R. Hanna's report be accepted with gratitude. MOTION: Davey; SECOND: Fowls; VOTE: Passed unanimously. The Scheduled Item of Private Roads was then discussed, as follows: ( -3- SCHEDULED ITEM: 1. Discussion of Private Roads. Councilman Bowler referred to letter dated September 29, 1966 from Donald E. Spencer, 2%490 Sherlock Road, wherein he reauested consideration of an amendment to Councilman Fowle's report on Private Roads, dated September 19 , as "C. PRE-EXISTING PRIVC.TE ROADS - NOT FULLY DEVELOPED: 1. It shall be the policy of the Council that these roads shall be made eventually to conform to "A" above, except in those cases where a maintenance a rg eement is developed. Councilman Fowle stated this thought was implied in his report, but had no objection to the amendment. Following discussion, the word "adequate' maintenance agreement" was added to the suggested manedment and accepted by the Council. ACTION; That the City Attorney be instructed to begin preparation of the ordinances, and That the Planning Commission be advised that the City Council is prepared to receive their comments prior to formal finalization. MOTION: Bowler; SECOND: Fowls; VOTE: Passed unanimously. UNSCHEDULED ITEMS: 2. Janssen. David (326-66) 3 lots — Tentative Map. Engr. Riley. City Clerk read Planning Commission recommendations aid Check List. The question of deeded access was discussed, however, since this is an additional condition of the Check List, the requirement must be met before the Final Map is signed. ACTION: That the Tentative Map of David Janssen (326-66) be approved, subject to the Conditions of the Planning Commission Check List. MOTION: Bowler; SECOND: Fowle; VOTE: Passed unanimously. 3. Brasser 1'h l -is (143-59) Tract #4250 (formerly Phyllis Wilson, Tract 2515 - Final Hap. Engr. Riley. ACTION: That the Final Map of Phyllis Nilson Brasser, Tract No. 4250, be approved. MOTION: Fowle; SECOND: Davey; VOTE: Passed unanimously. -4- UNSCHEDULED ITEMS: 4. Clark, Dr. Dean - Request for =.bandonment of a Portion of l Lowell Avenue. City Clerk read letter dated September 7, 1966 from Dr. Dean T. Clark requesting abandonment of a Fart of Lowell Avenue. ACTION: That November 7, 1966 be scheduled for Public Hearing on the proceeding to abandon a portion of Lowell Avenue. MOTION: Fowle; SECOND: Davey; VOTE: Passed unanimously. 5. Bethel Albert L. (V-267-66) - Request for reduction of setback to 30 fob r Pool at 25360 Becky Lane. ACTION: That the request of .Albert L. Bethel (V-267-66) for variance be approved, in accordance with the recommendations of the Planning Commission. MOTION: Fowls; SECOND: Davey; VOTE: Passed unanimously. 6. Pathway on Olive Tree Lane. Council acknowledged letter dated 9/26/66 from Mrs. P. C. Armi, ( I 24721 Olive Tree Lane, and accompanying correspondence from the Los Altos School District regarding paths within the Olive Tree Hill Subdivision. City Clerk read letter dated 10/3/66 from Councilman i.iken, who was unable to be present, expressing his feelings in regard to the need for a path on blandor qday and vicinity. Following a previous on-site inspection with the City Clerk and Councilman Davey, Mrs. E. I. Ginzton, Vice -Chairman of the Pathway Committee, submitted a written report dated 10/3/66 recommending a paved path along Olive Tree Lane between Blander ',Jay to the turnaround and that Olive Tree Court be graded Ind weed control applied; also the recommendation for paved paths along Magdalena Road to San Antonio Road, while the equipment is in the area. Mrs. Ginzton stated that Councilman Aiken was advised of these recommendations. G vote of thanks was given to Mrs. Ginzton for the sound concrete proposal submitted. ACTION: That the Council adopt Mrs. E. L. Ginzton's report dated 10/3/66 and authorize construction. ( MOTION: Davey; SECOND: Bowler; VOTE: Passed unanimously. -5- UNSCHEDULED ITEMS Cont'd.: 7. Los Altos Chamber of Commerce - Agreement for Service. Mr. J. T. Price, 12215 Edgecliff Place, representing the Los Altos Chamber of Commerce, explained that the consideration O of the sum of $400.00 covered approximately 900-950 inquiries a ye^r (telephone, personal contact, letters and issuing of City maps at 250 each) and that there was no intent to promote Los Altos Hills, but merely provide the services the public requests of a Chamber of Commerce, for which they are asking reimbursement. Mr. W. C. Griffith, 10401 Magdalena Road, stated his appreciation of the services but felt they had already been paid for by ether means. Councilman Davey was of the opinion the expense was fully justified. %.CTION: That the Council accept the sum of $400.00 for the Los Altos Chamber of Commerce and authorize the Mayor and City Clerk to enter into the pro»osed agreement and expend the funds stated therein. MOTION: Davey; SECOND: Fowle; ROLL Cf.IL: LYES: Bowler, Davey, Poole, Mayor Henley NOES: None ABSENT: Aiken Santa Clara County - Propos^l for Unified Civil Defense Office. Mr. F. E. Holt, of the Santa Clara County Unified Civil Defense Office, presented an oral report to the Council regarding the proposal and that the cost would be approximately $1200 per year, beginning in January with a payment of 11600.00, to hire additional people in the Office of Civil Defense for planning purposes only for a program of cooperation of Cities for large scale disasters, the County being the coordinating organization. The City Attorney recommended the proposal and that there is a basis and justification for this expense. However, following Council discussion as to the organization of a Town plan, Staff responsibility, involvement of the various service agencies and the obligation of City funds, the matter was deferred for further study to the October 191 meeting. 9. Council Recommendations re: County Planning Committee. Councilman Davey reported orally on the County Planning Committee and that a committee member from the Planning Commission and City Council of Los Altos Hills is required to participate in the Countywide Committee. ICTION: That the City Council of the Town of Los &1tos Hills approves of the County Planning Committee and that the Inter -City Council be so advised. MOTION: Davey; SECOND: Powle; VOTE: Passed unanimously. -6- UNSCHEDULED ITEMS Cont'd.: 10. Nestor Barrett - Planning Report. Councilman Davey read Mr. Nestor Barrett's proposal dated 9/19/66 for the preparation of a planning study and referred to his latter letter dated Septer_ber 22, 1966 in that a further study indicated the estimated cost limit be increased to $11500.00. ACTION: Adopt Mr. Nestor Barrett's plan as outlined in letter dated September 191", and as amended by his letter of September 22, 1966, and That expenditure of these funds be authorized. MOTION: Bowler; SECOND: Fowle; VOTE: Passed. unanimously. 12. _City Manager's Expense Account. Y.CTION: That the request for a Checking ccount established at the local bank in the City Manager's name be approved, and that there will be Council approval of expenditures before reimbursement to the i.ccount. MOTION: Fowls; SECOYD: Davey; ROLL CALL: AYES: Bowler, Davey, Fowls, Mayor Henley NOES: None ABSENT: Liken 13• City of Palo '-Ito - Bandera Drive Extension. ACTION: As requested by the City of Palo Alto in its letter dated September 15, 1966, the City Council of the Town of Los Altos Hills is not interested in the extension of Bandera Drive. MOTION: Bowler; SECOND: Davey; VOTE: Passed unanimously. -7- UNSCHEDULED ITEMS: (cont Id.): 14. City Attorney - Page Mill Estates Improvements. ACTION: That the City Council accept the recommendations of the City Attorney to accept improvements in Page Mill Estates as outlined in memorandum dated September 21, 1966, and that the Mayor and the City Clerk be authorized to execute the necessary agree- ment. MOTION: Bowler; SECOND: Fowle ROLL CALL: .AYES: Bowler, Davey, Fowle, Mayor Henley NOES: None ABSENT: .liken 15. Johnson, M. R. - Request for reimbursement by the Town for Culvert Installation, Tract No. 4034. City i.ttorney advised the Council that the Town has no obligation in this matter since no agreement was executed by the City Council. Council concurred. Mr. M. R. Johnson was presont and explained the situation as stated in his letter of September 10, 1966. During discussion, the City Attorney advised there was a possibility of legal action in the near future. ACTION: That the matter be deferred. MOTION: Fowle; SECOND: Bowler; VOTE: Fassedunanim_ously. 16. Santa Clara County Flood Control Easement, Tract No. 1684. Councilmen Bowler .and Fowle were opposed to restating the original Resolution (;1250) as requested by Mr. D. Y. Curlin, of the S^nta Clara County Flood Control and Water District, in his letter dated April 29, 1964. Mr. E. R. Hanna reported a conversation with Mr. Carlin who stated the District would make no substantial changes without a Town Hearing, but would not want to be bound by such Public Hearing but merely that the change be substantiated. Following discussion, no action was taken by the Council, but the City Engineer was requested to make a cursory estimate of what the cost would be to brush out the channel to a point that it is reasonably safe from bad flooding. rRESENT '.TIONS FROM THE FLOOR: None. mm RESOLUTIONS: t, 1. Resolution No. 363, amending Resolution No. 152. The City l,.ttorney introduced and read Resolution No. 363, a Resolution of the City Council of the Town of Los Lltos Hills amending Resolution No. 152, of said City Council, by fixing certain additional charges to be made in connection with subdivision of land. Resolution was amended by striking out last phrase charging the purpose of expenditures. LCTION: 2.dopt Resolution No. 363 as amended. The City Lttorney introduced and read Resolution Ido. 364, a Resolution of the City Council of the Town of Los :ltos Nilis pertaining to Town policy regarding swimming pool safety. ACTION: j Adopt Resolution No. 364 as read. MOTION: Bowler; SECOND: Davey ROLL CALL: DYES: Bowler, Davey, Fowls, Mayor Henley NOES: None ABSENT: Aiken ORDINANCES: 1. Ordinance No. 116 - Dedications for parks and recreational land in subdivisions. Second Reading. The City Attorney read the titlo of Ordinance No. 116, an Ordinance of the City Council of the Town of Los Altos Hills establishing regulations for dedications of land, payment of fees, or both, for parks and recreational land in subdivisions. The proposed ordinance would require that .0125 percent of the gross area of the subdivision be dedicated for park purposes where the density was one dwelling unit per acre or more and that .0250 percent be dedicated where the net density was one dwelling per unit per half acre to one acre. :CTION: That further reading of Ordinance No. 116 be waived. Councilman Bowler received Council approval of a letter he prepared to the Transportation Policy Committee, representing the position of the Town in regard to phase II of the Express- way program. This letter incorporated the concepts of Councilman Davey and the proposal ^s submitted by Mrs. E. L. Ginzton. 2. Councilman Davey - Mid -Peninsula Foothills planning Committee. With the approval of the Council, Councilman Davey will attend. the October 6t meeting of the Mid -Peninsula Foothills planning Committee. 3. Councilman Davey - Letter dated 9/30/66 from A. Ginzton. Mrs. Ginzton has requested a work session date with members of the City Council and the planning Commission with the Pathways Committee. Councilman Davey and Chairman Hibner will attend the next Pathways Committee meeting to outline_a program for a study assion for the combined groups at a later date. 4. Councilman Davey - Staff Reports. Councilman Davey commended the Staff for its back-up material for this meeting. 5. Councilman Davi - Los Altos Hills Association Newsletter. Council concurred the Los Altos Hills Association was doing a fine job on its Newsletter. At 11:10 F. M., the Mayor adjourned the meeting for recess. At 11:23 P. M., the Mayor reconvened the meeting. OTHER BUSINESS (Cont'd.): 6. City Attorney - Correspondence from Farmer Insurance Gmip. Ginzton, Vice -Chairman of Pathways Committee Date: October 3, 1966 PATHS - OLIVE TREE LANE Olive Tree Lane 1194' Blandor Way 830' Olive Tree Court 365' Magdalena to San Antonio ------- Statement prepared as requested in letter from Mr. Smith, dated September 23, 1966. A. Ginzton An examination indicates that there is enough room on the right .hand or northern side of Olive Tree Lane, between Blandor Way and the turnabout, to place -a path between the edge of the road and the toe of the bank. It can be five feet wide most of the way but may have to narrow to four feet or less in one place. The owner of Lot #15 should be contacted because of a bank which has been planted and a rock accent that has been installed where the path would normally end. Construction cost for the path should fall below normal because headers are not needed and only minimal grading will be required. While the equipment is in the area, would recommend that the east side of Olive Tree Court be graded and weed control applied as well, if the cost is reasonable. �.� This request from the residents in Olive Tree Lane Subdivision for a path for children to use to reach the bus stop on Blandor Way points up vividly a recommendation that the Pathways Committee has prepared to submit to the Planning Commission and the Council for consideration. I would like to read it at this point. "We propose that in considering the -paths to be required for any new subdivision that easements should be granted by the subdivder, or obtained. by him, if necessary, and the paths installed to Town Standards so that children can enter and leave the proposed subdivision safely and conveniently to walk to the nearest bus stop and/or to each of the public schools, which any children from the subdivision will attend. Ne believe that it should be the responsibility of each subdivider to provde this facility for future residents of the subdivision. "Actually this was done in this subdivision and required on the Check List but was eliminated in favor of in -lieu payments in 1965." Furthermore, if I was a resident of this area, I would want to have a safe bicycle route for my children to reach theEastbrookSchool, the junior and senior high schools they will attend, as well as the Rancho and Loyola Corners Market. I would also want a separated horse path along Magdalena and Ravensbury; not necessarily paved but physically separated from the pavement. r�"fihe path along Magdalena was a part of the original Check List for this subdivider. Paths - Olive Tree Lane p. 2 A. Ginzton (� I would like to point out that this frontage along Magdalena was considerable and would have taken the path from Olive Tree Lane area safely down to San Antonio Road - a public right of way in Santa Clara County. It would add considerably to the safety of children in this area if this entire stretch of path along Magdalena was completed, while the equipment is in the area.
