HomeMy WebLinkAbout69-84 . • _ • 111 • �', RESOLUTION NO. 69-84 RESOLUTION APPROVING LOT LINE ADJUSTMENT RESOLVED, by the City Council of the City of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, Dean 0. Morton and LaVon Morton as Trustees of the Dean O. Morton and LaVon Morton Trust Agreement dated September 20, 1978, are the owners of the real property described in Exhibit "A" attached hereto and incorporated herein by reference, herein called the "MORTON PROPERTY" : and WHEREAS, Dean O. Morton and LaVon Morton desire to adjust the lot line between Lot 1 and Lot 3 of the MORTON PROPERTY whereby a portion of Lot 1 would be conveyed to and added to Lot 3; and WHEREAS, the City Council desires to approve the adjustment of the lot lines of Lots 1 and 3 'which lots are contiguous one to the other, NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED,AND ORDERED as follows: 1. The proposed lot line adjustment between Lots 1 and 3 of the MORTON PROPERTY is between two. existing adjacent lots, and the land to be taken from Lot 1 would be added to Lot 3 . 2. Approval of the lot line adjustment would not result in a greater number of parcels than originally existed being created thereby. 3 . Pursuant to the authority of Subsection (d) of Section 66412 of the Government Code of California, the City Council of 01 -1- , . 111 • • 411 the City of the Town of Los Altos Hills hereby approves the lot line adjustment referred to above. 4. The new boundary line between the two lots described above is more particularly described in Exhibit "B" attached hereto and incorporated herein by reference. 5. The foregoing lot line adjustment is approved subject to the following conditions: (a) Dean 0. Morton and LaVon Morton shall (i) Cause a parcel map with the title "Lot Line Adjustment" to be prepared and filed with the City of the Town of Los Altos Hills (herein called the "TOWN") for recordation with the County Recorder, and which parcel map shall comply with the provisions of the Town's sub- division Ordinance and the California Subdivision Map Act, to the satisfaction of the City Engineer, and which parcel map shall be filed with the Town not more than two years from the date of approval. (ii) Restore the Type II B Path along La Paloma Road to Town Specifications following completion of construction work if restoration work is required in the opinion of TOWN. (iii) Execute and cause to be recorded a Covenant in form approved by the City Attorney and relinquishing their privilege and the privilege of their respective successors and assigns to apply for variances under the TOWN' s Zoning Law or for Conditional exceptions under the TOWN's Subdivision Ordinance concerning Lot 1, which Covenant shall be executed in consideration of the granting of the within lot line adjustment and in recog- nition of the fact that Lot 1 already a small lot would become a smaller lot by reason of the lot line adjustment. EXHIBIT "B" A line situate in the City of the Town of Los Altos Hills, State of California, lying within Lot 1 as shown on that map-entitled "Tract No. 6928" recorded inBook483 of Maps at pages 30/ 31, and 32, File No. 7042973 , on April 27 , 1981, Records of Santa Clara County, California, and more particularly described as follows: .
